BE IT KNOWN, that on the twenty third day of October 1871, the last Will and Testament hereto
annexed, of James Cock late of the parish of Tywardreath in the County of Cornwall
Gentleman

deceased, who died on the 26th day of July 1871 at Tywardreath aforesaid, and
who at the time of his death had a fixed place of abode at Tywardreath
aforesaid within the District
of the County of Cornwall, was proved, and registered in the District Registry
attached to Her Majesty’s Court of Probate at Bodmin and that administration
of all and singular the personal estate and effects of all the said deceased was granted
by the aforesaid Court to Mary Ann Grigg (Wife of Isaac Grigg) and Jane Beer (formerly Cock
spinster) wife of Thomas Beer) the daughters
of the said deceased the Executrixes

named in the said Will –they having been first sworn well and
faithfully to administrate the same, by paying the just debts of the deceased and
the legacies contained in his Will __ and to exhibit
a true and perfect inventory of all and singular the said estate and effects, and to
render a just true account thereof whenever required by law so to do.

This is the last Will and Testament of me James Cock of the Parish of Tywardreath in the County of Cornwall Gentleman. If my wife Jane shall not be entitled to dower in or out of my Freehold Moiety of lands and tenements in the said Parish which were my late Fathers I give to her for and during so long as she shall remain my widow an Annuity or Yearly sum of Thirty pounds sterling to be paid to her by equal quarterly portions on four equidistant days in the year the first payment thereof to be made at the end of three calendar months next after my death And if she shall be entitled to such dower as aforesaid and the same shall not in any year during her widowhood amount to the sum of Thirty pounds then I give her such a sum as shall together with what she shall receive in respect of such dower make up the sum of Thirty pounds at the end of every such year during her widowhood And I hereby charge my said Freehold moiety with the aforesaid annual sums And subject thereto I give and devise the aforesaid moiety and all other my real estates unto and to the use of my Daughters Mary Ann the wife of Isaac Grigg Jane Cock and Ellen Cock their heirs and assigns for ever in equal shares and proportions as tenants in common And I direct that in case any or either of my said children shall die in the minority and without leaving lawful issue then the share of her or them so dying with the accumulations thereof shall belong to and be held by my then surviving Daughter or Daughters and the issue of such daughter or daughters as may be dead leaving issue taking a parents share his her or their heirs and assigns for ever in equal shares and proportions as aforesaid And I also direct that no sale of my said Freehold shall take place during the lifetime of any or either of my said children Also I give and devise to my said Wife Jane the Dwelling house garden and Premises now in my occupation with the use of my Furniture Plate Linen and China during such time as she shall remain a Widow she signing and giving to my executors an Inventory thereof and from and after her death or marrying again the said Dwelling House and Premises shall sink into and become part of the residue of my Estate and Effects and Furniture Plate Linen and China I give to my said daughter Ellen All the rest residue and remainder of my Estate and effects Goods and Chattels whatsoever and wheresoever I give devise and bequeath to same unto and to the use of my said Daughters Mary Ann Jane and Ellen their Executors Administrators and Assigns in equal shares and proportions as Tenants in Common subject to the payment of my just debts Testamentary and Funeral charges And I appoint my Friend James Polkinghorne Guardian of the Estate and effects of my said daughters during and until my youngest daughter shall attain her full age of twenty one years And I nominate my said Daughters Mary Ann and Jane Executors of this my Will hereby revoking all former or other Wills by me at any time heretofore made do declare this to be my last Will and Testament In witness whereof I have hereunto set my hand and seal the twenty third day of August in the year of our Lord One thousand eight hundred and fifty one ------------------
