THIS
INDENTURE made the 2nd day of May in the 31st year of
the Reign of Our Lord George the Third by the Grace of
God of Great Britain France and Ireland King defender of
the Faith and so forth in the year of Our Lord 1791
between Thomas Avery of Tintagell Yeoman of the one part
and Thomas Symons of the said Parish and County
aforesaid Yeoman of the other part WHEREAS at a public
Court held in and for the Manor of Tintagell parcel of
the Ancient possession of the said Duchy of Cornwall the
28th day of June in the Year of Our Lord 1790 the said
Thomas Symons by and upon surrender of John Panter one
of the Customary Tenants of the said Manor by an with
Covenant of the said Thomas Avery was duly admitted and
taken tenant according to the custom of the said Manor
of and for one Moiety of the fourth tenement with the
appurtenances thereunto belonging except two fields AND
WHEREAS at Law Court held in and for the Manor aforesaid
the 2nd day of May 1791 the said Thomas Symons by and
upon the surrenders of the said Thomas Avery one of the
Customary Tenants was duly admitted and taken tenant
according to the custom of the Manor of and for a Third
part of the First tenement in Trewarmetta a dwelling
house and garden (except the Higher room and chamber
over the said room in the said dwelling house) also a
Mowhay and a pair of old walls being part of the
aforesaid tenement also a sixth part of the second
tenement in Trewarmett also a Moiety (except a close and
little garden) and the residue of the sixth tenement in
Trewarmett also the eighth part of the seventh tenement
in Trewarmett with all and singular the appurtenances
thereunto belonging all which said several and
respective customary hereditaments and premises are
situate lying and being in the Parish of Tintagell in
the County aforesaid as in and by the Both or records of
the said Manor reference being thereunto had will more
fully and at large appear These presents do now witness
that the said Thomas Avery for and in consideration of
the sum of £46 lawful money of Great Britain to him in
hand paid by the said Thomas Symons at and before the
sealing and delivery hereof the receipt whereof is
hereby acknowledged doth for himself his heirs executors
and administrators covenant promise and agree to and
with the said Thomas Symons his Heirs Executor and
Administrators in manner following (that is to say) that
he the said Thomas Symons and his heirs shall stand and
continue tenant of and for the above said premises and
every part thereof with the appurtenances until the said
Thomas Avery his Heirs Executors Administrators due and
shall well and truly pay or cause to be paid unto the
said Thomas Symons his heirs executors or assigns the
said sum of £46 with lawful interest and all such
further principal sums and sums of money together with
interest for the same as the said Thomas Symons his
Executors Administrators shall or may at any time or
times hereafter advance and lend unto the said Thomas
Avery his heirs executors administrators or assigns upon
bill penal land or note together with all such costs and
charges expenses and trouble which he or they may be put
unto or sustained by reason or means of the tenure of
these lands and being repaid the said sum of £46 with
lawful interest for the same and also all such other sum
and sums of money as the said Thomas Symons his
Executors or Administrators shall hereafter advance and
lend unto the said Thomas Avery his heirs or Assigns on
bill penal bond or note together with lawful interest
for the same at any time or times hereinafter and all
costs and charges expenses and trouble as aforesaid that
then he the said Thomas Symons or his Heirs being tenant
or tenets of the above mentioned premises shall and will
at reasonable request of the said Thomas Avery his
executors Administrators or Assigns as to such payment
as aforesaid recovered the aforesaid the above said
premises with their appurtenances unto the hands of the
Lord of the said Manor for the time being UPON CONDITION
that the said Thomas Avery their Heirs Executors
Administrators or Assigns or to such other person or
persons as he the said Thomas Avery shall by any writing
under his hand and seal attested by two or more credible
witnesses or by his last will and testament in writing
attested by three or more credible witnesses Direct or
Appoint may have the same in default thereof to the
Customary heirs of the said Thomas Avery and then these
presents and every article clause covenant and Agreement
herein contained shall ? determine and be void to all
intents and purposes whatsoever AND the said Thomas
Avery doth for himself his Heirs and Executors
Administrators and Assigns Covenant Promise and Agree to
and with the said Thomas Symons his Heirs Executors and
Administrators that he the said Thomas Avery his heirs
Executors and Administrators do and shall well and truly
pay or cause to be paid unto the said Thomas Avery his
Executors Administrators and Assigns the said sum of £46
with lawful interest for the same and such other sum and
sums of money as aforesaid with lawful interest as
aforesaid free of all incumbrances whatsoever according
to the above mentioned agreement In witness whereof the
parties to these presents their hands and seals
