Will of Hugh Bawden, dated 11 November 1797
   

EXTRACTED from the Registry of the Archdeaconry Court of Cornwall the 11th day of November 1797

IN THE NAME OF GOD AMEN I Hugh BAWDEN of the Parish of St Teath in the County of Cornwall Yeoman being at present in good health of body, and of sound and disposing mind and memory, for which I bless God, but considering the uncertainty of this Transitory Life do make declare and ordain this my last Will and Testament in manner and form following, that is to say, FIRST I give and bequeath unto my Wife Ann BAWDEN and her Assigns during her natural life All that my Tenement in Treburgett called Bawdens Tenement lying in the said Parish of St Teath And also unto my said Wife the use of one half of my Household Goods for her Life and after her decease I give and bequeath the same unto my two daughters Christian BAWDEN and Ann BAWDEN to be equally divided between them ITEM I give and bequeath unto my eldest son Giles BAWDEN one shilling ITEM I give and bequeath unto my son John BAWDEN Five Pounds to be paid him by my Executor Six months after my decease, ITEM I give and bequeath unto my said two daughters Christian BAWDEN and Ann BAWDEN the Sum of Two hundred Pounds to be equally divided between them at my decease, but in case either of them shall happen to dye(sic) without Issue during my Life, then I give and bequeath the said two hundred Pounds unto the survivor of them And I do charge my Estate of Land in Treburgett aforesaid called Langford’s Tenement with the payment of the same six months after my decease ITEM I give devise and bequeath All that my Messuage Tenement and premises with their Appurtenances in Treburgett aforesaid called Langford’s Tenement subject to the aforesaid Legacy of two hundred Pounds unto my son Hugh BAWDEN and the Heirs of his Body lawfully to be begotten and for default of such issue then I give devise and bequeath the same premises unto my son John BAWDEN and the Heirs of his body lawfully to be begotten, and for default of such Issue to my two daughters Christian and Ann BAWDEN and the Heirs of their body lawfully to be begotten to take as Tenant in Common and not as Joint Tenants and for default of such Issue then to my right Heirs for ever ITEM as to for and concerning all other my Messuages Lands Tenements and Hereditaments and premises whatsoever and wheresoever as well Freehold Copyhold and Leasehold for Lives for their and every of their Appurtenances, as also all the Goods and Chattels of what nature kind or quality soever the same may be and not otherwise by this my Will given and disposed of as aforesaid(after payment of my Debts Legacies and Funeral Expenses) I give devise and bequeath the same and every part thereof unto my said son Hugh BAWDEN his Heirs Executors Administrators and Assigns for ever, And I do hereby constitute ordain and appoint my said Son Hugh BAWDEN Executor of this my Last Will and Testament hereby revoking and making void all former and other Wills by me at any other time heretofore made In Witness whereof I have hereunto set my hand and seal this ninth day of March 1776
 
The Writing within was signed and sealed the words subject to the aforesaid Legacy of two hundred Pounds being first within interlined by the within named Hugh BAWDEN and by him published on and for his last Will and Testament in the presence of us, who have hereunto subscribed our Names as Witnesses thereunto in his presence and at his request

THE before written Will of the above named Hugh BAWDEN deceased was proved by Witnesses and a Definitive Sentence the 6 February 1778 before the Rev W Jas. Walker Clerk Batchelor of Laws Official AND ADMIN of the Goods of the said deceased and of all things howsoever concerning the said Will was granted to the executor therein named being first sworn die Saving die NO INVENTORY signed John Wallis Register
