The Will of Thomas Daniell,
23 July 1608/9?
In the name of god Amen The three and twentieth daie
of Julie in the yeare of our lord god one thousand six hundred and eight
I Thomas Danyell the elder of the parish of Ruan Lanyhorne in the County
of Cornwall yeoman being weak of boddie but of perfect mind & memory for
the which of do thank god, do make my last will and testament in manner
and forme followinge First I bequeath my soule to all mighty god my
saviour and redeemer and my boddy to bee buried in the parish church of
Ruan Lanyhorne.
Item I geeve to the poore of the said parish of Ruan Lanyhorne , Xs
Item I geeve to Johan Trevanyon widdowe my daughter the featherbed where
she doeth usually lye on with one bolster & other furniture belonging to
that bed & one pease of blankets one pease of sheets one rugye & one
pillowe
Item I doe geeve to Hugh Trevanyon second sonne of the said Johan my
daughter the somme of sixteen pounds which XVIth I meane and is to be
payd him in satifaction of somuch being the legacie of John Trevanyon
his deceased father otherwise I have no purpose to legacie the sayd
XVIth,
Item where as the sayd Hugh Trevanyon and one Richard Trevanyon & John
Trevanyon sonnes of the sayd Johan my daughter are soule tenets for
terme of their lyves and the longest lyver of them of land in certain
messuages lands & tenents in or called Tressilhan within the parish of
St Virrian in the Couny of Cornwall. I doe hereby legasise and demise
unto the sayd John Trevanyon the somme of XXXth of lawful monies of
England, provided all … that if the said Richard Trevanyon shall suffer
and permit the sayd John Trevanyon quietly to hold use & enjoye the
..and portion of him the sayd Richard Trevanyon of and in Tressilhan
aforesaid during the life of him the sayd John Trevanyon that then the
said legasise & demise of the sayd XXXth unto the sayd John Trevanyon
shall be voud to all intents & purposes & be in our by monayes or meanes
chargable to my executor
Item … .. the sayd conditionall demise of XXXth I doe hereby absolutely
demise legasise and give to the sayd John Trevanyon the sume of XXth of
lawful monyes to be payd him when hee shall accomplisse the age of XXIth
yeares but if hee happen to dye before the accomplishe the age then my
will is that my executor be cloarsely acquited from the payment of that
XXth
Item I give to William Trevanyon the fourth sonne of the sayd Johan my
daughter the some of XXth of lawful monyes to be payd him when hee shall
accomplishe the age of XXIth yeares but if hee happen to die before hee
accomplishe the XXIth yeares of his age then my will is that my executor
be accquited of that XXth
Item my will is and I doe hereby legasise and demise unto Edward
Trevanyon fyeuth sonne of the sayd Johan my daughter all my right estate
and tenement in the demeane or demhary lands in Ruan Lanyhorne the right
and estate of the sayd Edward which I hereby demise unto the sayd Edward
to commence & beginne therein only when hee shall accomplishe thaye
XXIth yeares and not before, provided all mayes that if the sayd Edward
Trevanyon shall dye before hee accomplish that age or if hee shall
accomplishe that age if my executor or his executor or admininstrators
shall paye unto the sayd Edward the summe of fiftie pounds of lawfull
monies within six monthes after that hee the sayd Edward shall
accomplishe the sayd age of XXIth yeares then the sayd legasie & demise
of the demeanes or demeane landes in Ruan Lanyhorne shall be void to all
intents and purposes and where as the said Edward is of tender age my
will is & unto the which Richard Trevanyon my executors agreeth & wiseth
to forme that hee the same Richard shall have the care & education of
the said Edward & that if hitt shall so fortune that the said Edward
shall after hee shall accomplishe thaye of XVI yeares dislike if his
said brothers so duration that then the said Richard shall paye yearely
to the said Edward until hee accomplishe XXIth yeares of age five
poundes yearely by XXVth quarterly but if the said Richard shall happen
to die before the said Edward shall accomplishe the age of XXIth yeares
then my will is and I doe hereby legasise and demise unto the said
Edward all my right and forme in the said demeanes or demeane landes in
Ruan Lanyhorne to be givene from and after the death of the said Richard
Trevanyon
Item my will is and unto the which my executor doth consent and agrees
that Richard Trevanyon my executor shall have the care of maintenance &
education of Jane Trevanyon & Margarett Trevanyon daughters of my sayd
daughter Johan & of eache of them until thee shall accomplishe the age
of XXIth yeares
Item I do legasise and demise unto the sayd Jane Trevanyon the some of
XXXth of lawfull monies and unto the said Margarett the …. some XXXth to
be payd unto eache of them … they shall accomplishe the age of XXIth
yeares one after the other but if they ………………..shall happen ……………dislike
of their said brothers …maintenance before the accomplishe of that age
then the XXXth unto eache of them legasised to bee payd unto them or her
so marrying or disliking maintenance within one yeare after such
marriage or disliking and if they the sayd Jane or Margarett shall
happen to die before suche disliking or marriage or before the
expiration of eache one yeare after disliking or if they or either of
them doe nott marry now dislooke neither accomplishe the age of XXIth
yeares that then the some or somes to her or them …. so dying shall
remeane unto my executors and in no waye bee chargable unto him
Item I doe leagasise and demise to Elizabeth my wife the featherbed
wherein we usually lyeth & formed
Item my will is that Richard Trevanyon my executor and unto the which my
executor agreeth that my executor shall have the care and education of
William Trevanyon his brother during the life of the sayd Elizabeth my
wife lastly I do by theis presente grant all other my goodes & chattels
moneass to or the sayd Johan my daughter & which sayd Richard & doe
hereby ordeyne to be my sole executor of this my last will and testament
I give my second …parie unto the said John Trevanyon sonne of my sayd
daughter Johan and …. doe request friends Mr Hugh Trevanyon of Gerrance
and Richard Trevanyon of Gorran of to … their best counsel towards …
executor herein & I doe geeve to the sayd Hugh Trevanyon of Gerrance ….
& to the sayd Richard Trevanyon of Gorran Xs
In witness whereof I have putto my sine & fixed to the margens of this
……. contayning my last will & testament my seale dated the .. daye &
yeare first above written 1608
Sined & sealed and acknowledged by the sayd Thomas Danyell to be his
last will & testament they daye and yeare first above written the 23 of
