Thos Martyns Bond in Bastardy
Know all Men by these Presents that we James Martyn,
Carpenter, and Thomas Martyn Woolcomber, both of the
Borough of Mitchell in the County of Cornwall, are held
and firmly bound to Matthew Robarts, Thomas Gerrans,
Andrew Buckingham, Elisha Martyn, and Henry Hawken,
Churchwardens and Overseers of the Poor of the Parish of
Probus in the said County and their Successors for the
Time being in the sum of One Hundred Pounds of lawfull
money of Great Britain to be paid to the said Matthew
Robarts, Thomas Gerrans, Andrew Buckingham, Elisha
Martyn and Henry Hawken and their Successors for the
Time being their or either of their certain Attorney,
Executors, Administrators or Assigns, for which payment
to be well and truly made We bind ourselves and each of
us, our and each of our Heirs Executors and
Administrators firmly by these presents. Sealed with our
Seals. Dated this thirtieth day of March in the year of
our Lord One Thousand eight Hundred and nine.
Whereas Joan Cocking of the said Parish of Probus,
Spinster did some time since and by her voluntary
examination and upon oath before Sir Christopher Hawkins
Baronet one of His Majesty’s Justices of the Peace in
and for the said County of Cornwall, declare that she
was great with child, and that the abovenamed James
Martyn was the Father of such child or children she was
then pregnant with And whereas the said Joan Cocking
hath since been delivered of a Male Child, which Child
was born a Bastard and is likely to become chargeable to
the said parish of Probus. Now the Condition of this
obligation is such that if the abovebounden James Martyn
and Thomas Martyn or either of them their or either of
their Heirs Executors or Administrators, do and shall
from Time to Time, and at all Times hereafter fully and
clearly acquit exonerate and discharge, or otherwise
well and sufficiently save harmless and keep indemnified
as well the said Matthew Robarts Thomas Gerrans, Andrew
Buckingham, Elisha Martyn, and Henry Hawken
Churchwardens and Overseers of the Poor of the parish of
Probus aforesaid, and their Successors for the Time
being, of and from all and all manner of Expences
Damages Costs and Charges whatsoever which shall or may
arise happen or accrue to the said parish of Probus for
or by reason of the said Joan Cocking being so delivered
of Child as aforesaid, then this Obligation to be of
none Effect, or else to remain in full force and virtue.

Be it remembered that before the
Execution of the within Bond it was agreed at a general
Easter meeting of the Parishioners held this 4th day of
April 1809 that if the said within named James Martyn do
and shall pay or cause to be paid to the said parish of
Probus the Sum of one shilling and six pence per week,
for the space of seven years towards the maintenance of
the child within mentd (if it shall so long live) it is
to be deemed and taken in full satisfaction and
discharge of the within Bond.
