A Copy of the Will of Joan Burgoyne, dated 17 September 1743
 

In the Name of God Almighty this fourteenth day of September in the year of Lord God One Thousand Seven Hundred and Forty Three I Joan Burgoyne of the parish of Poundstock in the County of Cornwall Widow being of Sound and perfect mind and memory Praised be Almighty God for the same but considering the uncertainty of this transitory life do make and declare this my last Will and Testament in manner and form following (That is to say)
First I give and bequeath my Soule unto Almighty God who gave it to me hoping through the merits and mediation of my Dear Redeemer Jesus Christ to enjoy Eleriral Happiness and my body I commit to the Earth from whence it was taken to be Buried in a Decent manner and according to my Degree by my Executor hereafter named
I Give Devise and Bequeath unto my son Richard Burgoyne and his assignes for and during the Terme of his Natural Life all my Lands and inheritance with the appurtenances scituate lying and being att or near Hilscott in the parish of Marham Church in the County of Cornwall and after the decease of my said Son Richard Burgoyne I doe hereby Give Devise and Bequeath all my said Lands and inheritance with the appurtenances at Hilscott in Marham Church aforesaid unto my Grandson William Burgoyne (son of my said son Richard Burgoyne) and to his Heirs forever.
Also I Give and Bequeath unto my said son Richard Burgoyne and his assignes for and during the terme of his Natural Life if my right therein shall so long continue all my Chattell or Lease Estate at Hilscott in Marham Church aforesaid, and after the death or decease of my said son Richard Burgoyne I due hereby Give and Bequeath my said Chattell or Lease Estate with the appurtenances at Hilscott in Marham Church aforesaid unto my aforesaid Grandson William Burgoyne (son of my said son Richard Burgoyne) his Executors administrators and assignes and all my Estate Right Title Interest and demand of in and to the same every or any part or parcel thereof Provided always and my will and meaning is that my aforesaid grand=son William Burgoyne and his Heires out of the said premises at Hilscott aforesaid shall pay unto his sisters Mary Burgoyne and Prudence Burgoyne the several sums herein after mentioned (That is to say) unto his sister Mary Burgoyne Forty pounds at the End of Three years next after the decease of his said Father Richard Burgoyne and unto his sister Prudence Burgoyne Tenn Pounds at the End of Four years next after the death of his said Father Richard Burgoyne And if it shall happen the said severall sums of Forty pounds and Ten pounds or either of them or any part thereof to be behind and unpaid by the Space of three months next after they shall become due and payable That Then is shall and maybe Lawful and I due herby desire authorize and impower my son in law John Spry and my daughter Prudence Yeo and the Survivour of them their Heires Executors or administrators and the Survivour of them into the said premises at Hilscott aforesaid to Enter and the same to Sett of Lett and keep and Enjoy until the said sums of Forty pounds and Ten pounds shall be fully satisfied and paid together with all Lawful Costs and Charges relating thereunto Provided also and my will and meaning further is That my said son Richard Burgoyne and his Heires shall and do pay unto Phillip Welsh of the Burrough of Dunhevid otherwise Launceston in the County of Cornwall Gentleman all the money that is due to him on Mortgage Bonds or notes with his Interest that is as shall be due for the same And that is shall and may be Lawful unto and for my daughter Prudence Yeo to keep in her hands the writings belonging to Hilscott Aforesaid until she be discharged from the obligation she entered into with me unto the said Phillip Welsh
Also I Give unto my said son Richard Burgoyne all my Deeid Goods now att Hilscott at Marham Church aforesaid
Also I Give unto my Grandson William Burgoyne (son of my son Robert Burgoyne) Forty pounds and to his Brothers and Sister George Burgoyne Thomas Burgoyne and Mary Burgoyne Twenty pounds apiece to be paid unto each and either of them at the End of Twelve months next after my death, which said One Hundred pounds was given unto my in and by the last Will and Testament of Charles Manaton of Poundstock aforesaid Carver deceased
Also I Give unto my daughters Prudence Yeo and Grace Spry five pounds apiece to be paid to each and either of them one year next after my Decease.
Also I give unto my daughter Prudence Yeo’s children and to my daughter Grace Spry’s children one guinea of gold apiece to be paid to each and either of them at the end of Twelve months next after my Decease Death
Also I give unto my daughters Prudence Yeo and Grace Spry all my Cloaths and things that I have and shall have at the time of my Decease at Plymswood in the Jacobstow to be equally divided amongst them and that no other person shall be Concerned therein nor look over itt, my Daughter Grace Spry to divide my Cloaths and my Daughter Prudence Yeo to chuse
Also I give unto the Poor of the parish of Marham Church in Cornwall that have no monthly pay One Guinea of Gold to be distributed amongst them six months after my death at the discretion of my Executor hereafter named
Also All the rest of my goods and chattels I do hereby Give and Bequeath unto my son Robert Burgoyne, which said Robert Burgoyne I do hereby make whole and sole Executor of this my last Will and Testament Renouncing all Former Will or Wills by me at any time or times heretofore made and in Testimony that this is my last Will and Testament I have hereunto sett my hand and seale the day and yeare first within written. My will is that my said Executor shall pay all my Debts Legacyes and Funerall Charges

I do bereby acknowledge the Razure on the other side beginning at Also and my will and meaning is and ending at unto the said Philip Welsh, to be my own act and Deed, and it is my Will and devise that my son Robert Burgoyne (whom I have appointed my Executor) do discharge and pay all the money due on Mortgage , Bonds or Notes with the Interest that is or shall be due for the same to Phillip Welsh of the Burrough of Dunhevid Otherwise Launceston in the County of Cornwall Gentleman and that my son Robert Burgoyne do give my Daughter Prudence Yeo a Bond to indemnifye her from Mr Phillip Welsh aforesaid. I do also hereby Give and Bequeath unto my Grandaughter Mary Burgoyne the daughter of my son Robert Burgoyne the Chest of Drawers that now stands in the Parlour Chamber in Trebarfoot after the things that are in it are taken out. I do also Give and Bequeath unto my son Richard Burgoyne the Spruise Chestyt Stands in the said Parlour Chamber at Trebarfoot. Lastly it is my will and devise that the writings belong to Hilscott be lodged in my son in law John Spry’s Hands till my son Richard Burgoyne has fully discharged the said John Spry & paid him his Bonds debt and Seventeen Pounds lent him since
