Pre-Nuptial Settlement 1705
(Marriage between Richard Sladd, Gent, of Philleigh
Parish, Cornwall, to Johan Haweis of Kea in Cornwall took place in 1706
at Kea).
This Indenture quadripartite made the seventeenth day of July in the
fourth year of our Sovereign Lady Anne by the Grace of God of England
and Scotland, France and Ireland; Queen Defender of the Faith. Between
Bennet Sladd of the parish of Filly in the County of Cornwall, Gent, of
the first part. John Haweis of Killiowe in the said County; Reginald
Haweis , Gent, son and heir apparent of the said John Haweis the second
part. Richard Sladd of the parish of Filly , Gent, heir apparent of the
said Bennett Sladd of the third part; and Johan Haweis, one of the
daughters of the said John Haweis of the fourth part.
WHEREAS Bennet Sladd and Richard Sladd are owners of them at the time of
sealing and delivery of the perquisites (?) seized in fee simple and in
all messuages, lands and tenements hereinafter mentioned and that is to
say one house and garden now of late in the tender and possession of
Elizabeth Wilton, her Assignee or Assignor. One other house and garden
now or late in the tenure and possession of Hannibal Luke, his Assignee
or Assignor. One other house and garden in the tenure and possession of
William Sweet, his Assignee or Assignor. One of the barn or pair of old
walls in the tenure and possession of William Collins and Fannie Beston
together with one called higher chapel house and one called the lower
chapel house. One house called ‘Parkenframe’ (?) ; one other called the
great ‘ Mentrooweal Mentraven’ (?). One other called Mentraven Hill’(or
Montraven) (?) adjoining the great ‘Mentraven of and part of Trethewell
within the parish of St Just in Roseland now or late in the possession
of Bennet Sladd, his Assignee or Assignor, tenant or tenants all which
pieces were lately from John Penhallow of St Just, Gent, since deceased.
WHEREAS Bennet Sladd under a certain indenture of release heretofore
granted by the Right Hon. Lord Robarts then Baron of Truro and late Earl
Radnor, to Richard Sladd, Gent, since deceased, father of Bennet Sladd
party to those perquisites bearing to 3rd March 1667 is now lawfully
possessed of the estates in all that messuage and tenement called
Eglosrose situat /stituent lying within the parish of Filly for the
remainder of the time of ninety - nine years therein yet to tenure and
possess if Bennet Sladd shall so long happen to live, under the yearly
rent 640 shillings and eight pence payable quarterly .
WHEREAS Bennett Sladd under a certain indenture of lease granted by Hon
Francis Robarts of Lanhrydrock to Bennet Sladd to 6th June in eleventh
year of the Reign of late Majesty King William third at the time of
sealing and delivery estates of messuages and tenants of Eglosrose with
appurtenances for term of ninety-nine years. If either shall so happen
to live. The term to commence immediately after the death of Bennet
Sladd or his forfeiture of estate under the yearly rent of 640/8 payable
quarterly.
WHEREAS Bennet Sladd took a certain indenture of lease heretofor made a
grant of by Francis Robarts to Bennet Sladd 14th October in first year
of the reign of the late King James second, is now lawfully possessed of
estates in all capital, messuages and tenements lying within parish of
Filly and during the full time of 99 years then ended; if Thomasin Sladd
, deceased, then wife of Bennet Sladd, and Richard Sladd and John Sladd
or either, shall happen to live under rent of forty-two shillings and
two pence payable quarterly and WHEREAS Bennet Sladd is now lawfully
possessed of land called Gilly of four acres of land with pastures and
feeding in Eglosrose in Filly for remainder of 99 years fully to be
completed.
…Lease dated 3rd March 1667 granted by Hon John Lord Robarts then Baron
of Truro late Earl Radnor, to Richard Sladd father of Bennet Sladd,
under yearly rent of nine shillings payable quarterly. WHEREAS Bennet
Sladd under a lease dated 6 June in year of King William third, and
granted by Robarts to Bennet Slade the field or close of land to allow
Gilly with pasture and feeding in Eglosrose Wood during 99 years to be
completed. If Richard Sladd or John Sladd shall so happen to live tenure
to commence immediately after death of Bennet Sladd or forfeiture of
estate of Bennet Sladd under indenture of release dated 19th Sept in
seventh year reign of King William third granted by Sir John Aubin in
the county, Baronet, to Bennet Sladd at time of sealing and deliverance
of lawfully possessed estates which are the land of inheritance of Sir
John Aubin called Trethewell ; 3rd part of the moiety of messuages and
tenements and three parts of a sixth part of moiety in six parts to be
divided within parish of St Just in Roseland. All residue nominated out
of the term of 99 years. Rent of 4/6 payable quarterly.
And all of which messuages, lands and tenures and payees granted in and
by several inherited indentures of lease now in tenure, possession and
occupation of Bennet Sladd his Assignee, tenant or tenants or of some
other of son or sons now these present do witness that Bennet Sladd and
Richard Sladd as well for in consideration of a marriage agreed upon and
intended shortly hereafter by God’s permission to be solemnized between
Richard Sladd, party to these present, Johan Haweis and sum of 400
pounds to Bennet Sladd at or before solemnization of intended marriage.
And at or before the sealing of these present by the portion with John
Haweis whereof Bennet Sladd contented and paid so in these perquisites
release acquit and exonerate and forever discharge John Haweis, his
heirs from every one of them and for the settlement of all the messuages,
lands, tenures and habitations whereof Bennet Sladd, Richard Sladd have
paid before the sealing of these by John Haweis and Reginald Haweis…
