Whereas Complaint has been made by you the Church-Wardens and Overseers of the

Hands and Seals are hereunto set, Two of his Majesty’s Justices of the Peace
(One being of the Quorum) for the said County of Cornwall That

lately intruded herself into your said Parish of

relating to the Settlement of the Poor, and is likely to become
Chargeable there: And whereas upon due Examination and Enquiry made into the
Premises by Us the said Justices, and on the Oath of her the said

Grace Lugg
(Handwritten note)
CASE
Grace LUGG now an Inmate in the Parish of St Kevern in the
County of Cornwall , at the age of twenty Intermarried with George LUGG of that
Parish, who lived with her about Ten years and then left her and went to Sea,
and after some years returned again and lived with her some time, after which he
again left her and went to Sea, and being wanting and not heard of by her for
Fifteen years she Intermarried with one Francis BENNY of the Parish of Mawgan,
but some time after her Second Marriage hearing her first Husband was at
Falmouth she went there in quest of him, but he had set sail before her Arrival
there and she never saw him; soon after which time she left her Second Husband
BENNY and removed to the Parish of Perranarworthal in the same County and there
bought a Leasehold Tenement of four pounds a year for Thirty Seven Pounds, which
after few years, and the Loss of two Lives, she sold again for Twenty One
Pounds, and falling poor she came back to St.Kevern where she now is.
It is admitted that the first Husband was alive at Falmouth after the Second
Marriage – he died in One Thousand Seven Hundred and forty four – the Estate in
Perranarworthal was bought after his death in One Thousand Seven Hundred and
Forty nine – Her Second Husband is still living – and she has had only one Child
by her first Husband, which is dead long since and no Child by her second
Husband – And neither of her Husbands was ever possessed of a Sufficient Estate
in any Parish to gain a Settlement. If the Second Marriage was good, would the
Purchase of the Estate in Perranarworthal by her gain both him and her a
Settlement in that Parish or not?
But as the first Husband was living after the Second Marriage, is not such
Second Marriage void? And will she not be considered as a Widow, and to have
bought the Estate in Perranarworthal in her own Right, and Consequently to have
gained a Settlement there, or to what Parish does she belong?
ANSWER
The Second Marriage was clearly void, and her Purchase in
Perran after the Death of her first Husband has gained her a Settlement in that
Parish.
