Know, men present and future that We
John Kestell and Jacob Kestell son and heir of the said
John have given, granted, and by this our present
indented charter have confirmed, to Henry Jeffrey all
that toft or our tenement with it's appurtenances
situated in Padstow between the tenement or toft of John
Vyell on the Western side and the tenement of Thomas
Hykks on the Eastern side to have & to hold the
aforesaid toft or tenement with its appurtenances to the
aforesaid Henry Jeffrey his heirs and assigns for ever
to hold of the chief lord of that fee for rent & by the
services thence owed of the same and by right accustomed
Paying thence annually to us the aforesaid John Kestell
& Jacob Kestell & our heirs throughout the first one
hundred and one years four shillings sterling to be paid
at four terms of the year namely at the feasts of the
birth of Our Lord, Easter, the birth of Saint John the
Baptist and at the feast of St Michael the Archangel by
equal portions ending however at the aforesaid one
hundred and one years and the rent thence to be paid to
us the aforesaid John Kestell & Jacob Kestell & our
heirs to be six shillings & eight pence sterling to be
paid at the aforesaid feasts And if it should happen
that the aforesaid rent of four shillings sterling is in
arrears or the aforesaid rent of six shillings & eight
pence sterling after the aforesaid one hundred & one
years is over is in arrears by part or in whole for one
month after any one of the aforesaid feast or feasts
then thereafter we, the aforesaid John Kestell & Jacob
Kestell & our heirs, are lawfully allowed into the
aforesaid toft or tenement with its appurtenances to
seize goods & to keep the distresses so taken
thereafter, taking thence lawfully, to cart away,
impound animals & in part to detain until the aforesaid
rent together with the arrears is fully met & satisfied
& paid in full And if we can not find sufficient to
distrain of & in the aforesaid toft or tenement with its
appurtenances for the aforesaid rent for one whole year
that then we the aforesaid John Kestell & Jacob Kestell
& our heirs are rightfully & lawfully allowed to
re-enter & repossess the title by the present indented
deed and take possession as formerly without obstruction
And Verily we the aforesaid John Kestell & Jacob Kestell
& all our heirs will warrant, acquit and defend against
all people all that toft or tenement with its
appurtenances to the aforesaid Henry Jeffrey, his heirs
& assigns for ever by this present (charter] Know
moreover that we the aforesaid John Kestell & Jacob
Kestell have appointed & in our place set up beloved to
us in Christ Thomas Loure(?) and John Ronald as our true
& legitimate attorneys to enter jointly & separately of
and into the aforesaid toft or tenement with its
appurtenances and thereupon fully and peaceably occupy &
take seisin and after this occupation and seisin thus
thereby take & for delivery as inheritance (?) & in our
name of the aforesaid Henry Jeffrey fully & peaceable
possession & seisin of & in the premises with all their
appurtenances following the terms of the document and
the effect of this our present indented charter ratified
and agreeable to the heir and heirs (?) whatsoever of
our aforesaid attorney or the other of them in our name
as mentioned before In witness whereof we have affixed
in turn our seals to this present indented charter These
being witnesses John Cawbsdle, Jacob Dier, Richard Whyte,
Richard Bawdyn, Thomas Hykke and many others Given at
Padstow aforesaid on the twelve day of the month of
November in the eleventh year of the reign of Henry
Eighth (12 Nov 1519 AP)
