Apprenticeship Indenture, John Waters to Sampson Tallack, dated 6 July 1830

Document 1

This Indenture, made the Sixth day of July in the First Year of the Reign of our Sovereign Lord William the 4th by the Grace of God, of the United Kingdom of Great Britain and Ireland, King defender of the Faith, and in the Year of our Lord, One Thousand Eight Hundred and thirty Witnesseth that in Pursuance and Execution of an Order under the hands of Humphrey Williams and Richard Gully Bennet Esquire Two of his Majesty’s Justices of the Peace, acting in and for the Hundred of Pydar within the County of Cornwall bearing date the same Sixth Day of July instant (testified by their allowance hereof.) Matthew Courtnay and John Pearce Church Wardens of the parish of Padstow in the County of Cornwall And John Kendall and Thomas Hawkey Overseers of the Poor of the said parish have put and placed, and by these Presents do put and place John Waters aged Nine Years, and upwards, a poor Child of the said parish Apprentice to Sampson Tallack of the said parish with him to dwell and serve from the day of the date of these Presents, until the said Apprentice shall accomplish his full age of Twenty one years according to the Statute in that case made and provided. During all which Term, the said Apprentice his said Master faithfully shall serve in all lawful Business, according to his power, wit, and ability, and honestly, orderly, and obediently in all things demean and behave himself towards his said Master and all his during the said Term. And the said Sampson Tallack for himself, his Executors and Administrators, doth Covenant and Grant to and with the said Churchwardens and Overseers, and every of them, their and every of their Executors and Administrators, and their and every of their Successors for the time being, by these Presents, that he the said Sampson Tallack the said Apprentice in the art of husbandry shall teach and instruct, or cause to be taught or instructed in the best way and manner that he can during the said Term. And shall and will, during all the Term aforesaid, find, provide, and allow unto the said Apprentice, meet, competent, and sufficient, Meat, Drink, and Apparel, Lodging, Washing, and all other things necessary for an Apprentice: Provided always that the last mentioned Covenant on the Part and Behalf of the said Sampson Tallack his Executors and Administrators to be done and performed, shall continue and be in Force for no longer time than three Calandar Months next after the Death of the said Sampson Tallack in case the said Sampson Tallack shall happen to die during the continuance of such Apprenticeship, according to the Provision of an Act passed in the Thirty Second Year of the Reign of King George the Third, intituled "An Act for the further regulation of Parish Apprentices." And also shall and will so provide for the said Apprentice, that he be not in any way a Charge for the said Parish or Parishioners of the same; but of and from all Charge, shall and will save the said parish or parishioners harmless and indemnified during the Term: In Witness whereof the Parties abovesaid, to the present Indentures, interchangeably set their Hands and Seals , the Day and Year above written.

To John Kendall and Thomas Hawkey Overseers of the Poor of the Parish of Padstow in the said County of Cornwall. Whereas you the said Overseers having proposed unto us Humphrey Williams and Richard Gully Bennet Esquire Two of his Majesty’s Justices of the Peace, acting in and for the Hundred of Pydar within the said County of Cornwall, under and by virtue of an Act of Parliament, passed in the Fifty Sixth Year of the Reign of his late Majesty George the Third, intituled "An Act to regulate the Binding of Parish Apprentices," to bind John Waters a poor Child aged Nine Years belonging to your said Parish of Padstow Apprentice to Sampson Tallack of the same parish And whereas we the said Justices having this Day enquired into the propriety of binding the said Child an Apprentice to the said Sampson Tallack and having particularly examined and considered the several Directions contained in the said recited Act, and also the circumstances and character of the said Sampson Tallack do hereby declare that the said Sampson Tallack is a fit person to take the said John Waters Apprentice as aforesaid; and do order that you the Overseers shall be at Liberty to Bind such Child Apprentice accordingly.- Given under our hands this Sixth day of July in the Year of our Lord, One Thousand Eight Hundred and Thirty
