Return to Newlyn East Parish Page Will of Mary Tremain, dated 22 February 1851THIS IS THE WILL AND TESTAMENT OF me MARY TREMAIN of Nancorla in the Parish of Newlyn in the County of Cornwall Spinster. I will and direct that all my just debts funeral references and the costs and charges of proving this my will be fully paid and satisfied. I give and bequeath to my brother William Tremain the sum of £100, I give and bequeath to my brother Richard the sum of £100. I give and bequeath to my brother John the sum of £100. I give and bequeath to my sister Betsey the wife of John Wiliams the sum of £100. I give and bequeath to my sister Catherine the sum of £100. I give and bequeath to my friend Elizabeth Vercoe daughter of John Cole Vercoe the sum of £10 And I hereby will and direct that the said several Legacies by me hereinbefore given and bequeathed shall be paid by my Executor hereinafter named at the end of six months next after my decease And I do hereby further Will and direct that the said Legacy of £100 hereinbefore given to my sister Betsey shall not be subject or liable to the debts controut or engagements of her husband but that the same shall be for her own absolute use and benefit. I give and bequeath to my brother James Tremain the sum of £100 UPON TRUST to layout the same at interest and to pay the interest arising there from to my sister Betsey Williams until her daughter Catherine Mary shall attain the age of 21 years then upon trust to pay the said sum of £100 to the said Catherine Mary Williams for her own use and benefit All the rest residue and remainder of my real and funeral estate and effects monies and securities for money goods and credits of which I may die seized or possessed I give devise and bequeath to my brother James Tremain his heirs executors administrators and assigns for his and their own use and benefit subject nevertheless to the payment of the before mentioned Legacies And I hereby nominate constitute and appoint my brother James Tremain Executor of this my last will and testament IN WITNESS where I the said Mary Tremain have to this my last will and testament set my hand this 22nd day of February 1851 Mary Tremain Signed published and declared by the said Mary Tremain as and for her last will and testament in the presence of us both being present at the same time who in her presence and in the presence of each other have hereto subscribed our names as witnesses Thomas Whitford THIS IS A CODICIL to the last will and testament of one Mary Tremain of Nancorla in the Parish of Newlyn in the County of Cornwall Spinster WHEREAS by the said will I have given and bequeathed to my brother Richard the sum of £100 Now I do hereby revoke and make void this the said Legacy and do give my said brother Richard the sum of one shilling only AND WHEREAS by my said will I have given to my said sister Catherine (now the wife of William Polkinghorn) the sum of £100 now I do hereby declare that the said Legacy of £100 so given to my said sister Catherine shall be for her own absolute use and benefit and shall not be subject or liable to the debts controut or engagements of her said husband and that her receipt alone shall be a good discharge for the same for all other respects I hereby confirm my said WILL IN WITNESS whereof I the said Mary Tremain have hereunto set my hand this 26th day of December 1851 Mary Tremain SIGNED and declared by the said Mary Tremain as for a codicil to her last will and testament in the pursuance of us both being present at the same time who in her presence and in the presence of each other have hereunto subscribed our names as witnesses Edward Dix |
