This Indenture made the twenty second day of June one thousand eight hundred and forty one Between Charles Olliver of the parish of Saint Neot in the County of Cornwall Blacksmith of the first part Robert Coad of the borough of Liskeard in the said county Land Surveyor and George Rundle of Stokes Damerel in the County of Devon Esquire of the second part and William Langsford of Saint Neot aforesaid Mason of the third part. Whereas the said Charles Olliver being subject in fee of a dwelling house smiths shop garden and orchard situate at Ley in the said parish of Saint Neot did by Indenture dated the 13th day of January one thousand eight hundred and thirty Six in consideration of the sum of eighty pounds demised the same unto William Fookes Clerk since deceased his executors Administrators and assigns for one thousand years from the date thereof upon certain Trusts for securing to the said William Fookes his Executors administrators and assigns payment of the said sum of Eighty pounds and interest as therein mentioned and subject thereto in trust for the said Charles Olliver his Executors Administrators and assigns And Whereas the said William Fookes departed this life the 2nd day of April One thousand eight hundred and thirty eight having first duly made and published his last will and testament in writing bearing date the 1st day of the first month of April whereby he demised all his lands and inheritance and residue of his estate and effects unto his friends the said Robert Coad and George Rundle their heirs Executors Administrators and assigns and appointed them Executors in the trust of his said Will which they shortly after duly proved in the Archbishops Court of Canterbury And Whereas the said Charles Olliver hath agreed with the said William Langsford for the sale to him of the piece or parcel of Land hereinafter mentioned being part of the Lands comprised in the said Indenture of Mortgage for the{residue of the said term of one thousand years therein at the sum of Five pounds and the said Robert Coad and George Rundle have at the request of the said Charles Olliver agreed to join in assigning the same being satisfied with the remaining part of the said hereditaments as a security for the principal and interest due on the said Mortgage Now this Indenture Witnesseth that in consideration of Five pounds of lawful Money of Great Britain to the said Charles Olliver now in hand paid by the said William Langsford the receipt whereof the said Charles Olliver doth hereby acknowledge and in consideration the sum of 10 shillings of lawful Money to the said Robert Coad and George Rundle {now?} also paid by the said William Langsford the receipt whereof is hereby duly acknowledged They the said Robert Coad and George Rundle do and each of them doth Bargain sell assign transfer and set over unto the said William Langsford his Executors Administrators and Assigns All that piece and parcel of Land already marked out and bounded being part of the Garden and orchard situate at Ley in the said parish of Saint Neot and next adjoining the new Methodist Chapel and at the south and thereof and containing two yards of Land customary measure and comprised in the said Indenture of Demise or Mortgage aforesaid together with all ways easements and appurtenances to the same belonging And all the Estate and Interest as well legal as Equitable of them the said Robert Coad and George Rundle and Charles Olliver of in and to the same To have and to hold the said piece or parcel of Land hereinafter assigned or intended to be with the appurtenances unto the said William Langsford his Executors Administrators and Assigns henceforth for and during all the remainder now to come and unexpired of the said term of One thousand years therein cease by the hereinbefore in part recited Indenture of Demise of the thirteenth day of January One thousand eight hundred and thirty six And the said Charles Olliver doth hereby {for himself his heirs Executors and Administrators Covenant promise and agree with and the said William Langsford his Executors Administrators and assigns that the said William Langsford his executors administrators or assigns shall and may from time to time hereafter during the said term of One thousand years peaceably and quietly have hold use occupy and enjoy the said piece of ground hereby assigned with the appurtenances and {receive?} and take the rents issues and profits thereof to and for his and their own use and benefit without any interruption whatsoever of or by the said Charles Olliver his heirs Executors Administrators or Assigns the said parties hereto of the second part or of or by any other person or persons whomsoever. And further that he the said Charles Olliver his heirs Executors and administrators and all and every other person or persons whomsoever having or lawfully claiming and Estate Right Title or Interest either at Law or in Equity of in to or out of the said piece of ground hereby assigned or intended so to be or any part thereof shall and will from time to time and at all times hereafter during the remainder of the said term of One thousand years of and in the said premises now to come and unexpired at the request and Expense of the said William Langsford his Executors Administrators and assigns make do and execute or cause and procure the made done and executed all and every such further and other lawful reasonable acts and acts thing and things assignments and assignments and assurances in the Law whatsoever for the further better more perfectly and absolutely assigning and assuring the said piece of ground and premises hereby assigned with the appurtenances unto the said William Langsford his Executors administrators and assigns for all the remainder of the said term of One thousand years which shall be then to come and unexpired as by the said William Langsford his Executors Administrators or Assigns or his or their Counsel in the Law shall be reasonably advised or devised and required In witness whereof the parties aforesaid to these presents (being first duly stamped) the hands and seals set the day and year first above written.
