THIS INDENTURE made the Seventeenth day of august in the Eighth Year of the Reign of our Sovereign Lord George the third by the Grace of God of Great Brittain France and Ireland King Defender of the faith and so forth Between JAMES LAROCHE the younger of the City of Bristol the one part and NICHOLAS UGLOE in the parish of Minster in the County of Cornwall Yeoman of the other part Witnesseth that whereas the Right Honble JOHN EARL of Radnor by his Last will and Settlement among other things did Give Devised bequeath unto JAMES LAROCHE the Younger of the City of Bristol to ELIZABETH & CATHERINE LAROCHE his Sisters all his manors Messuages Hereditaments Lordships & Royalties Situate & being in the County of Cornwall to them the said JAMES ELIZABETH CATHERINE share & share alike Relation thereunto being had it may more large appear and whereas the said ELIZABETH LAROCHE since the said Demise is engrossed to JOHN FULFORD of Great FULFORD Esq in the County of Devon and Likewise the Sd CATHERINE LAROCHE Since the Sd demise to CHARLES BERNER of St JAMES’S Westminster in the County of Middlesex Esq they the Sd JOHN FULFORD & CHARLES BERNER by the Letter of attorney Duly Executed bearing date the Eleventh day of August 1762 did thereunto make Constitute and appoint the Sd JAMES LAROCHE Esq their Brother their Lawfull attorney for them and Each of them & in their names to Set and Demise all or any of the Said premises by Granting Leases Reversions deeds forack holding & other acts as may be need full upon the Said premises Relation being thereunto being had it may at Large appear Vote this Indenture Witnesseth that the Sd JAMES LAROCHE for and In Consideration of the Yearly rent or Covenant Reservations & Agreemts herein after mentioned which on the part & Behalf of the Said NICHOLAS UGLOE his Heirs Admtr & Assigns are to be paid performed and kept Have Granted Demised Set Let Confirmed & in & by these presents Doth Grant demise Set Lot & Confirm unto the Said NICHOLAS UGLOE his Executr Admtr & Assigns All that one Messuage & Tenemt Called Vendown in the parish of Minster aforesaid and now in the Possession of the Sd NICHOLAS UGLOE Together with all houses Edefices Buildings Gardens orchards Lands Meadows feedings Pasture of Common Ways Extents Profits Commodities and appurtences whatsoever to the Sd Messuage belonging or in any wise appertaining / Excepting & always reserving out of this prevent Demise & Grant unto the Sd JAMES LAROCHE his heirs and assigns all Timber Trees of oak ash Elm & witchals in & upon the Sd premises now Growing or hereafter to cross with Liberty to fell Cut down & Carry away the Same & also Excepting & reserving all Tin Toll Tin? & Tin works & all other Mines of metals in & upon the Sd premises now found or hereafter to be found with Liberty Likewise to Dig Delve and search Tin & other metals & the Same there found to work up & Carry away And Also Excepting & reserving unto the Sd JAMES LAROCHE his Heirs & assigns Tree Warren of & for all Hawking Hunting Fishing & Fowling & upon the Sd premises with Liberty to & for the Sd JAMES LAROCHE & his heirs with his & their retinue to Hawk Hunt Fish & Fowl in & upon the Sd premises At his & their will & pleasure To Have and To Hold the Said premises with all & Singular its appurtences & Every part & parcel thereof / Except fore Excepted / unto the Sd NICHOLAS UGLOE his Executr admtr and assigns for & during the Term of Fourteen Years from Michaelmas Last past & fully to be Compleat & Ended (to pasture) Herbage & Tillage the Sd NICHOLAS UGLOE his Executr admintr & assigns (few words crossed through) yielding & paying therefore yearly & Every year during the said Term unto the Said JAMES LAROCHE his heirs and assigns the Annual rent of nine pounds Lawfull money of Great Brittain at the four most usual feasts in the Year for payment of Rent viz the Twenty fifth day of December the Twenty fifth day of March the Twenty fourth day of June & the Twenty ninth day of September Even & Equal Portions during the Sd Term and the Sd NICHOLAS UGLOE his recent admintr & assigns & for Every of them doth Covenant & promise unto & with the Sd JAMES LAROCHE his heirs & assigns & to & with Every of the by these presents that he the said NICHOLAS UGLOE his Executr admintr or assigns or Some or one of them Shall & will well & truly pay or Cause to be paid unto the said JAMES LAROCHE his heirs or assigns & to & with Every of them The annual rent of Nine pounds Lawfull money of Great Brittain by Equal Quartily Paymts in manner aforesd & during the Term aforesd And also Shall & will pay Satisfy & Discharge the Great & Small Tithes the Church & poor rates & all other rates & Taxes whatsoever which shall be Charged or Chosd premises Except the n excepted And Also Shall & will repair maintain and keep all the premises in houses Hedges Gates & Fences when and So often as need Shall require & in the End of the Sd Term so well & sufficiently repaired Shall Leave & Yield up And Also Shall Carry out & Spread over on the Sd premises all the Dung & Soil as Shall arise & be made on the Said premises during the Sd Term and Shall not ? of or Sell or Dispose of any Dung or Soil that Shall remain on the Sd premise at the End of the Sd Term but the Same Shall be Left for the use and Benefit of the Sd JAMES LAROCHE his Heirs & assigns And the Sd JAMES LAROCHE for himself his heirs & assigns & for Every of them doth Covenant & promise unto & with the Sd NICHOLAS UGLOE his Executr admintr or assigns & with Every of them by these presents that he the Sd JAMES LAROCHE his Heirs & assigns Shall & will pay & discharge the Land to which Shall be Charged on the Sd premises during the Sd Term And if it Happen the Sd yearly rent of Nine pounds to be behind & unpaid in part or shall by the space of one month next after any of the days of payment aforesd on which the Same ought to be paid being Lawfully demanded & not paid. Then it Shall & may be Lawfull unto & for the Sd JAMES LAROCHE his Heirs & assigns into the Sd premises or any part there of to Enter & Distrain & the Distress there found to take Lead Drive Impound Carry & Dispose of as the Law Directs & in Case no Sufficient Distress in or upon the premises or any part thereof can or may be found whereby the Sd rent to behind with the arrears thereof / if any be / can or may be levied and paid Or if the Said NICHOLAS UGLOE his Executr admintr or assigns or any of them Shall do as Commit or Willingly Suffer to be & one or Commited any Act or Acts thing or things Whatsoever which Shall or may be prejudicial or hurtfull to the Estate of Inheritance of the Sd JAMES LAROCHE his Heirs and assigns in the premises shall then & from thenceforth for Either of the Causes aforesd it Shall and may be Lawfull unto & for the Sd JAMES LAROCHE his Heirs & assigns in to all & Singular the said premises with the Appurtences & Every part & parcel thereof to reenter & the Same to have again Repossess & Enjoy as in his or their former Estate these presents or any thing herein Contained to the Contrary in any wise not withstanding And the Sd JAMES LAROCHE his Heirs & assigns all & Singular the Sd demised premises with the appurtences & Every part & parcel thereof / Except before Excepted / unto the Sd NICHOLAS UGLOE his Executr admintr & assigns in manner and form aforesd & during the Term afore Sd & by & under the yearly rent Covenants & Conditions aforesd as well against himself his Heirs & assigns as against all other people or persons whatsoever Lawfully Claiming the Same Shall & will Warrant acquit & by these presents Defend IN WITNESS whereof the parties above Sd to these present Indentures there Lands and Seals Interchangeably have Set the day & year first above written In the Year of our Lord one thousand seven Hundred & sixty eight _________
