The Will of Ambrose Matthews, dated 27 March 1876

This is the last Will and Testament of me Ambrose Matthews of Trevenning in the parish of Michaelstow in the County of Cornwall Yeoman that is to say First I direct that all my just debts funeral and Testamentary expenses be paid out of my effects as soon after my decease as conveniently may be by my Executrix hereinafter mentioned And I give devise and bequeath unto my daughter Mary Ann Tom all and singular my Messuages lands hereditaments and premises commonly called and known by the names of Trevenning and Stocks situate lying and being in the said parish of Michaelstow together with All other my effects whether the same shall consist of money or monies worth and whether the same may be in my own possession at the time of my decease or in the possession of any other person or persons whomsoever with full power to claim and to take possession of the same immediately after my decease Subject nevertheless to the proviso hereinafter mentioned (that is to say) First I give and bequeath unto Ambrose Warne the sum of Fifty pounds sterling Also I give and bequeath unto Grace Matthews Jeffery the daughter of Richard Jeffery of Lanlivery the sum of Two pounds Also I give and bequeath unto the aforesaid Ambrose Warne an Annuity of Two pounds and ten shillings per year for and during the natural life of my daughter aforesaid and I do hereby direct that the said Legacies be paid respectively at the end of Twelve months next after my decease and the said Annuity to commence immediately at my decease and the whole to be paid by my daughter aforesaid and I do hereby charge and make chargeable my lands aforesaid with the payment thereof And in case my daughter dies and leaves no Issue Then and in that case from and immediately after her decease I hereby give devise and bequeath unto Ambrose Warne aforesaid All and singular my new built Dwelling house in Trevenning aforesaid together with my Two Fields or Closes of land called Stocks aforesaid also the higher meadow the lower meadow Five acres and the Garden in Trevenning and all rights members and appurtenances Thereunto belonging To have hold use claim occupy and enjoy the same from and immediately after the decease of my daughter as and for his whole and sole use and benefit absolutely Also I give devise and bequeath unto my Nephew John Matthews the son of my brother Henry Matthews all and singular my Old farm house in Trevenning aforesaid together with my lower meadow and my other meadow called Rorbus Also the Mowhay orchard and garden and all rights and appurtenances thereto belonging To have hold claim use and enjoy the same from and immediately after the decease of my daughter for and during his natural life And from and immediately after his decease I give devise and bequeath the said premises to Ambrose Matthews son of the said John Matthews to him his heirs and assigns for ever Also I give devise and bequeath unto my Nephew Ambrose Matthews the son of my brother William Matthews All and singular my two meadows in Trevenning aforesaid called and known by the names of Shippen Parks together with all rights members and appurtenances thereto belonging to him his heirs and assigns for ever and to take possession of the same immediately after the decease of my daughter Also I give devise and bequeath unto John Matthews the son of my Nephew John Matthews All those my two meadows in Trevenning aforesaid called and known by the names of the Well Fields together with all rights members and appurtenances thereto belonging to him his heirs and assigns for ever and to take possession of the same immediately after the decease of my daughter And I give and bequeath unto each of my two Nephews viz Ambrose Matthews the son of my late brother John Matthews and to William Matthews the son of my brother William Matthews an annuity of Three pounds per year for and during their natural lifes (that is to say) One pound each per year out of my lands which I have bequeathed to my aforesaid Nephew John Matthews also One pound per year each out of my lands which I have bequeathed to my aforesaid Nephew Ambrose Matthews the son of my late brother William Matthews and one pound each per year out of my lands which I have bequeathed to John Matthews the son of my Nephew John Matthews aforesaid making an annuity of Three pounds each per year and I hereby charge and make chargeable my lands aforesaid with the payment thereof respectively And I do hereby declare and direct that no husband of my daughter aforesaid shall have any power over or be entitled to receive any or either of the rents of the said premises or any part thereof nor shall the same be subject to the debts defaults or engagements of such husband and that the receipt or receipts of my said daughter only shall be a proper and sufficient discharge for the same And Lastly I do hereby constitute ordain and appoint my said daughter Mary Ann Tom sole Executrix of this my last will and Testament hereby revoking and making void all other Wills and Testaments by me at any time heretofore made In witness whereof I have hereunto set my hand or mark this Twenty 7th day of March One thousand eight hundred and seventy-six The mark or sign X of Ambrose Matthews Signed published and declared by the within named Ambrose Matthews the Testator (the same being first read to him and he appeared fully to understand it) as and for his last will and Testament in the presence of us who at his request in his presence and in the presence of each other have signed our names as witnesses thereto. In Her Majesty’s High Court of Justice

BE IT KNOWN, that at the date hereunder written, the last Will and Testament (a Copy whereof is hereunto annexed) of Ambrose Matthews late of Trevenning in the parish of Michaelstow in the County of Cornwall Yeoman deceased, who died on the 7th day of April 1877, at Michaelstow aforesaid, and who at the time of his death had a fixed place of abode at Michaelstow aforesaid within the District of the County of Cornwall was proved and registered in the District Registry attached to the Probate Division of Her Majesty’s High Court of Justice at Bodmin and that Administration of the personal estate of the said deceased was granted by the aforesaid Court to Mary Ann Tom, Widow the daughter the sole Executrix named in the said Will she having been first sworn well and faithfully to administer the same.
