The Will of Mary Glaister, dated 19 September 1873

The Principal Registry.
In Her Majesty’s Court of Probate.
BE IT KNOWN, that on the twenty eighth day of November 1874, the last Will and Testament, hereunto annexed, of Mary Glaister late of Tregenna Michaelstow Camelford in the County of Cornwall Widow deceased, who died on the fourteenth day of November 1874, at Warltersville House Hornsey Rise in the County of Middlesex was proved, and registered in the Principal Registry of Her Majesty’s Court of Probate, and that administration of all and singular the personal estate and effects of the said deceased was granted by the aforesaid Court to Elizabeth Harriet Glaister Spinster the Daughter of the said deceased the sole Executrix named in the said Will she having been first sworn well and faithfully to administer the same, by paying the just debts of the deceased and the legacies contained in her Will and to exhibit a true and perfect inventory of all and singular the said estate and effects, and to render a just and true account thereof whenever required by law so to do.

I Mary Glaister
Of Tregenna Michaelstow Camelford in the County of Cornwall Widow hereby revoke all former Wills Codicils and other testamentary documents heretofore by me made and declare this to be my last Will I hereby devise bequeath and appoint all my real and personal property whatsoever and wheresoever and whether in possession reversion remainder or expectancy to which I shall be entitled or of which I shall be possessed at the time of my bereave or over which (by virtue of all powers and authorities vested in me by or in any Settlement or Settlements Deed or Deeds Will or Wills and of every or any other power or authority in anywise enabling me in this behalf I shall at the time of my bereave have any testamentary power of appointment unto and to the use of my Daughter Elizabeth Harriet Glaister Spinster her heirs executors and administrators absolutely according to the nature and quality thereof respectively for her sole and separate use free from the debts control and engagements of any husband with whom she may be married at the time of my bereave upon this condition nevertheless that if my Daughter Ada Fulcher the Wife of Thomas Blomfield Fulcher shall be living at my death the said Elizabeth Harriet Glaister shall within 4 months after my death duly enter into and execute and deliver to the said Ada Fulcher a Bond in the penal sum of One thousand five hundred pounds to secure the payment by the said Elizabeth Harriet Glaister her executors and administrators to the said Ada Fulcher during her life for her separate use free from the control of her husband for the time being and so that while covert she shall not have power to anticipate the same of an annuity or yearly sum of Seventy five pounds payable by half yearly instalments the first of such instalments to be paid at the end of six calendar months after my bereave such Bond to be so drawn that if the said Elizabeth Harriet Glaister shall be married at the time it is executed the obligation thereby entered into by the said Elizabeth Harriet Glaister shall be binding on her separate estate and her executors and administrators And if such last mentioned condition shall not be fulfilled then I devise bequeath and appoint all my said real and personal estate unto and to the use of my said Daughters Elizabeth Harriet Glaister and Ada Fulcher their heirs executors and administrators absolutely according to the nature and quality thereof respectively as tenants in common in equal shares and for their respective sole and separate uses free from the debts control and engagements of their respective husbands for the time being Provided always and I hereby declare that if the aforesaid testamentary condition be in excess of any power of appointment which may be vested in me at the time of my bereave then I give and appoint the real and personal estate which may be subject to any such last mentioned power unto and to the use of the said Elizabeth Harriet Glaister her heirs executors and administrators absolutely according to the natures and qualities thereof respectively for her sole and separate use free from the debts control or engagements of any husband but in such case I hereby express a strong hope and wish (but without creating any trust or obligation) that she the said Elizabeth Harriet Glaister may even then give the aforesaid Bond in favour of the said Ada Fulcher And I devise and bequeath all estates vested in me as Trustee or Mortgagee unto the said Elizabeth Harriet Glaister and appoint her Sole Executrix of this my Will In witness whereof I the said Mary Glaister the Testatrix have to this my last Will set my hand this nineteenth day of September in the year of our Lord One thousand eight hundred and seventy three Mary Glaister _____ Signed Published and Declared by the above named Mary Glaister the Testatrix as and for her last Will in the presence of us who in her presence at her request and in the presence of each other all being present together at the same time have hereunto subscribed our names as witnesses ____ Sophia Ann Shackle Spinster Hayes Middlesex ____ Harry Hocken Michaelstow Camelford Cornwall
