In the Name of God Amen, The Seventh day of January in the Year of our Lord
one Thousand Seven Hundred and Sixty three. I Edward Body of the Parish of St Mewan
in the County of Cornwall Yeoman being week and Infirm in Body, but of Sound Mind,
Memory, and understanding, thanks be to Almighty God, and Calling to Rememberance the uncertain estate
of this transitory life, and that all flesh must Yield unto Death when it Shall please God to Call,
I do make, Constitute, ordain and Declare, this my Last will and Testament in Manner and form
following, revoking and annulling by these presents all and every Testament and Testaments,
Will, and wills, heretofore by me Made and Declared Either by word or Writing and this to be taken
only for my Last Will and Testament, and None other, that is to Say,
first and principally I Recommend my Soule to almighty God my Creator, that Gave it to me, and my
Body to the Earth from whence it was taken, to be Buried in such decent and Christian Manner of
to My Executor hereafter Named Shall be thought Meet and Convenient. and as touching Such worldly
Estate as the Lord in mercy hath Lent me, my will and Meaning is that the Same Shall be imployed
and bestowed as hereafter by this my will is Expressed
Item I give devise and bequeath unto my Son Edward Body, So Much of the Messuage & Tenement
and no More, as is now herein imediately and particularly mentioned (to wit) the Dwelling
House where I Lately used to Live, and one field Lying North of the Sd Dwelling House, and
one other field adjoining to the Mowhay, and other field before the Door of the Sd House,
with a Little Orchard to the head of the first field, with a Moyaty of half part of my Right
in Trelowa little wood. Living in the parish of St Mewan and my will is that my Son,
Edward Body Shall have no Right or Title to any of the hedges or the Wood thereon that
parts His fields or plots of Grown, that parts or Divids the Same from My Son Petter Bodys
Grown on the Sd premises and my son Edward Body Shall from Time to Time and at all Times
hereafter Yield, pay, do, and preform one half of all the out going or whatsoever is to be
Yielded paid and performed for and in Respect of the Said premises that he the Sd Edward
Body
and Petter Body hath between them and one half of my household Good I Give to my Son
Edward Body to be Divided and Delivered to him by Two honest and indifferent men whom
my Executor hereafter Mentioned Shall think proper Soon after my death
and I Edward Body the Said Testator doth Give the above Sd Effects unto my Son Edward
Body
on this condition and no other, Whereas I apperhand that Some part of the Tenements
in Loos (to wit) the Dwelling house wherein my son William Body do now dwell and a
Meadow with its appurtinances the Deed thereof did by accident happen to be Drawn in my
Son Edwards Name but I bought and paid for the Same. Now my will is and I do hereby
declare it to be my full intent and Meaning, that in case my Son Edward Body his Executors
admr or assigns do or Shall at any Time hereafter Molest or any wise disturb my Son
William Body in the Quiett enjoyment of all or any part of the Tenements in Loose which
my son William Body doth now Occupie and possess, or refuse or neglect to Execute any
reasonable Deed or deeds thereby quitting unto my son William Body all Claim to all or any
part of the Said Tenements of Loos on being tendered the Same, that then he the Said
Edward Body my Son Shall thereby forfeit and Loose all Benefitt and Advantage that can arise
unto him by Virtue of this my will and I do hereby declare that the Devisees herein
before Made Shall be null and void as if never Made, and that what is herein before
bequeathed unto my Son Edward Body, Shall be held and enjoyed by my Son William Body
an paying unto my Son Edward Body one shilling and paying and performing what was
to be paid done and performed by my Son Edward Body.
Item I give devise and bequeath unto My Son William Body one Shilling, to be paid him within one
Year after my Decease
Item I give devise and bequeath unto Mary Body Daughter of My Son Petter Body Ten pounds
of Lawfull money of Great Brittain
Item All the Rest of my Goods and Chattles Rights and Creditts I do hereby Give and bequeath unto
my Son Petter body, making my Son Petter Body my whole and Sole Executor of this my
Last will and Testament In Witness whereof I have hereunto Set my hand and Seale
