An Abstract of the Marriage Settlement of John Borlase Esq
with Elizabeth his present Wife
13th March 1791

Indentures of Lease and Release of these dates by way of Marriage Settlement the Release being of four parts and made Between Thomas Bolitho of the parish of Madron in the County of Cornwall Gentleman of the 1st. part John Borlase of the Borough of Helston in the said County Gentleman of the 2nd. part Elizabeth Bolitho of the aforesaid parish of Madron Spinster Daughter of the said Thomas Bolitho of the 3rd. part and Richard Johns the Younger of the aforesaid Borough of Helston Gentleman and Thomas Bolitho the Younger of the aforesaid parish of Madron Gentleman of the 4th part. Reciting that the said Thomas Bolitho the Elder was there seized in his demesne as at fee of All That one Tenement or Dwelling House Courtlages and premises situated in the Town of Penzance and that a Marriage was then intended to be had & solemnised between the said John Borlase and the said Elizabeth Bolitho and that the aforesaid Tenement or Dwelling House should constitute a part of the Marriage portion of the said Elizabeth Bolitho.
It was witnessed that the said Thos Bolitho the elder in consideration of 5/- in hand paid by the said Thomas Bolitho the Younger & Richard Johns the Younger
 
Did with the priority & consent of the said John Borlase & Elizabeth Bolitho convey unto the said Thomas Bolitho the Younger & Richard Johns the Younger

All the aforesaid Dwelling House and premises in Penzance

To hold etc

Usual Covenants

and that the said John Borlase had in & by his Bond bearing even date therewith bound himself his heirs Executors & administrators unto the said Richard Johns the Younger & Thomas Bolitho the Younger in the penal sum of £1000 of Lawful Money of Great Britain with a condition that in case the said intended Marriage took effect the said John Borlase should during the joint lives of himself & the said Elizabeth Bolitho convey unto the said Richard Johns the Younger & Thomas Bolitho the Younger certain freehold Lands in the said County of Cornwall of the yearly value of £50 or should assign unto them certain Leasehold Lands of the like yearly Value of £50 determinable on lives whereof the said Elizabeth Bolitho should be one. To and for the use and benefit of the said Elizabeth Bolitho as & for assistance or maintenance for her during her natural life in case she should survive the said John Borlase her intended Husband to be by her accepted & taken in full Bar recompense & satisfaction of all Dower and thirds at Common Law as she should or might at any time thereafter claim or demand out of the Messuages Lands Tenements Estates or Effects of the said John Borlase of which he was then or should thereafter die seized or possessed Or if the heirs executors or administrators of the said John Borlase should within 3 months next after the death of the said John Borlase well & truly pay or cause to be paid unto the said
Elizabeth Bolitho her Executors Administrators or Assigns to & for her proper use benefit &maintenance the said sum of £500 of Lawful Money of Great Britain given by the said Thomas Bolitho the Elder as a marriage portion with the said Elizabeth Bolitho out of such Messuages Lands Tenements Goods Chattles and other Estates both real & personal which he the said John Borlase or any person in trust for him or his use should be seized or possessed of or which should belong to him at the time of his death
Then the said obligation should be void.
It was further witnessed and declared between all the parties thereto & the said Elizabeth Bolitho did thereby consent and agree thereto that the said annuity or yearly Rent charge of £50 to be created & raised as aforesaid or in default thereof the payment of the said sum of £500 by the heirs executors or administrators of the said John Borlase together with the aforesaid Dwelling House there in before released and conveyed should at all times thereafter be deemed accepted and taken in full Bar recompense & satisfaction of all Dower and thirds at common law as she the said Elizabeth Borlase should at any time thereafter claim or demand out of the messuages lands tenements estates and effects of the said John Borlase which he was then or should thereafter die seized or possessed.
