Settlement Papers for Gilbert Stephens & Family, dated
30 March 1758
Cornwall to wit. To the Church-Wardens and Overseers of the
Poor of the Parish of Luxillion in the said County and to each and every of you
to Remove and to convey
As also to the Church-Wardens and Overseers of the Poor of the Parish of St
Austell in the County of Cornwall aforesaid These to Receive and Obey
WHEREAS Complaint has been made by you the Church-Wardens and Overseers of the
Poor of the Parish of Luxillion aforesaid, unto Us whose Hands and Seals are
hereunto set, Two of His Majesty’s Justices of the Peace (One being of the
Quorum) for the said County of Cornwall, That Gilbert Stephens and Effy his Wife
Elizabeth their Daughter aged about one year and a half and one other Daughter a
Nurse Child have lately intruded themselves into your said Parish of
Luxillion
there to inhabit as Parishioners contrary to the Laws relating to the Settlement
of the Poor, and are likely to become chargeable there: And whereas upon due
Examination and Enquiry made into the premises by Us the said Justices, and on
the Oath of the said Gilbert Stephens as otherwise it appears unto us, and we
accordingly adjudge, that the said said (sic) Gilbert Stephens Effy his Wife
Elizabeth and the said Nurse Child their Daughters are there likely to become
Chargeable and that their last legal place of Settlement was in the said Parish
of St Austell where they ought to be Removed, as the Law in that Case directs.
THESE are therefore, in His Majesty’s Name, to Order and Require you the
Church-Wardens and Overseers of the Poor of Luxillion aforesaid, That you, or
some of you, do Forthwith Remove and Convey the said Gilbert Stephens Effy his
Wife Elizabeth and the said Nurse Child their Daughters from your said Parish of
Luxillion to the Parish of St Austell aforesaid, and them deliver to the
Church-Wardens and Overseers of the Poor there, or some one of them together
with this our Order or a true Copy hereof; whereby they are likewise Required,
in His Majesty’s Name, and by Virtue of the Statutes in such Case made,
Forthwith to Receive the said Gilbert Stephens and Effy his Wife Elizabeth and
the said Nurse Child their Daughters into your said Parish of St Austell and
provide for them as their own Parishioners according to Law. Given under our
Hands and Seals, the Thirtieth Day of March in the Thirty first Year of the
Reign of our Sovereign Lord GEORGE the Second, by the Grace of God of
Great-Britain, France, and Ireland, King, and so forth, and in the Year of our
Lord, One thousand, Seven Hundred and Fifty eight
