Settlement Papers for Joseph Nicholls & Family, dated 17 July & 7 August 1755

Cornwall to wit. To the Church-Wardens and Overseers of the Poor of the Parish of Luxillion in the said County and to each and every of you to Remove and to convey
As also to the Church-Wardens and Overseers of the Poor of the Parish of Landlivery in the County of Cornwall aforesaid These to Receive and Obey
WHEREAS Complaint has been made by you the Church-Wardens and Overseers of the Poor of the Parish of Luxillion aforesaid, unto Us whose Hands and Seals are hereunto set, Two of His Majesty’s Justices of the Peace (One being of the Quorum) for the said County of Cornwall, That Joseph Nicholls Elizabeth his Wife Joan their Daughter aged about Eight years Joseph their Son aged about Six years William their Son aged about three years and John their Son about a half year have lately intruded themselves into your said Parish of Luxillion there to inhabit as Parishioners contrary to the Laws relating to the Settlement of the Poor, and are likely to become chargeable there: And whereas upon due Examination and Enquiry made into the premises by Us the said Justices, and on the Oath of the said Joseph Nicholls as otherwise it appears unto us, and we accordingly adjudge, that the said Joseph Nicholls and Elizabeth his Wife Joan their Daughter Joseph, William and John their Sons are there likely to become Chargeable and that their last legal place of Settlement was in the said Parish of Landlivery where they ought to be Removed, as the Law in that Case directs.
THESE are therefore, in His Majesty’s Name, to Order and Require you the Church-Wardens and Overseers of the Poor of Luxillion aforesaid, That you, or some of you, do Forthwith Remove and Convey the said Joseph Nicholls and Elizabeth his Wife Joan their Daughter Joseph William and John their Sons from your said Parish of Luxillion to the Parish of Landlivery aforesaid, and them deliver to the Church-Wardens and Overseers of the Poor there, or some or one of them, together with this our Order, or a true Copy hereof; whereby they are likewise Required, in His Majesty’s Name, and by Virtue of the Statutes in such Casemabe (sic), Forthwith to Receive the said Joseph Nicholls and Elizabeth his Wife Joan their Daughter, Joseph, William and John their Sons into their said Parish of Landlivery and provide for them as their own Parishioners according to Law. Given under our Hands and Seals, the Seventeenth Day of July in the Twenty ninth Year of the Reign of our Sovereign Lord GEORGE the Second, by the Grace of God of Great-Britain, France, and Ireland, King, and so forth, and in the Year of our Lord, One-Thousand, seven Hundred and Fifty five

Cornwall (To wit). We the Churchwardens and Overseers of the Poor of the parish of Landlivery in the said County of Cornwall, do hereby own and acknowledge Joseph Nicholls and Elizabeth his Wife Joan their Daughter Joseph William and John their Sons to be Inhabitants Legally Settled in our said Parish of Landlivery and do hereby promise for ourselves and Successors Churchwardens and Overseers of the Poor of our said Parish of Landlivery to Receive the said Joseph Nicholls and Elizabeth his Wife Joan their Daughter Joseph William and John their Sons into our said Parish of Landlivery whenever they or either of them shall become Chargeable to your said Parish of Luxillion and provide for them as our own Parishioners. In Witness whereof we have hereunto set our Hands and Seals this Seventh Day of August in the twenty ninth year of the Reign of our Sovereign Lord George the Second now King of Great Britain and so forth And in the year of our Lord One Thousand Seven Hundred and five (sic)

Cornwall to wit. We whose Names are hereunto Subscribed, two of his Majesty’s Justices of the Peace of and for the said County do allow of the above written Certificate and do also certify that Joseph Yonge one of the Witnesses who attested the Execution of the said Certificate hath made Oath before us that he did See the Churchwardens and Overseers whose Names and Seals are to the said Certificate Subscribed and Set Severally Sign and Seal the said Certificate and that the witnesses Lewis Blighe and Joseph Yonge whose names are above Subscribed as Witnesses to the Execution of the Said Certificate are of their own proper Hand writing. Dated the Seventh day of August 1755
