28 February 1871, Property in Lostwithiel
This Indenture made the Twenty
eighth
day of February One
thousand eight hundred and seventy one Between William
Scantlebury Rundle
of the parish of Saint Veep in the County of Cornwall Gentleman and
Thomas Commins of the
Borough of Bodmin in the said County Gentleman of the one part and
Hugh Santo of Lostwithiel in the
said County Yeoman John Olford of the same place
Merchant John Santo of the same place Butcher
Joseph Jeffery of the same place Cordwainer
Jonothan Geach of the same place Mason
James Morrish of the same place Yeoman and
Philip Liddicoat of the parish of Saint Winnow
in the said County Butcher of the other part Whereas
James Parkin late of Lostwithiel aforesaid
Merchant deceased was at the time of his death lawfully possessed of the
messuages or dwelling houses hereditaments
and premises hereinafter described and intended to be hereby demised
with the appurtenances for the residue of a
certain term of ninety nine years granted therein by a certain Indenture
of Lease dated the Thirtieth day of September
One thousand eight hundred and thirteen by Dame Elizabeth Morshead to
Joseph Pascoe therein described and
which said term is now determinable on the death of Stephen Pascoe the
son of said Joseph Pascoe And
whereas the said James Parkin duly made and published
his last Will and Testament in writing
dated the tenth day of September One thousand eight hundred and fifty
nine whereby after making certain devises
and bequests as therein mentioned gave devised and bequeathed all the
rest residue and remainder of his goods chattels
money and all other his Leasehold and personal Estate and all his
Freehold Copyhold messuages lands and
hereditaments including the messuages or dwelling houses hereditaments
and premises hereinafter described and
intended to be hereby demised with the appurtenances unto the said
William Scantlebury Rundle and Thomas
Commins To hold to them their heirs Executors administrators or assigns
respectively upon certain trusts therein
mentioned And whereas the said James Parken died on the
eighteenth day of January One thousand
eight hundred and sixty four without having altered or revoked his said
Will and the same was duly proved in the
District Registry of Her Majesty’s Court of Probate at Bodmin on the
second day of March One thousand eight
hundred and sixty four by the said William Scantlebury Rundle and Thomas
Commins the Executors named
in the said Will Now this Indenture witnesseth that for
and in consideration of the yearly rent
covenants and conditions hereinafter contained on the part of the said
Hugh Santo John Olford John Santo
Joseph Jeffery Jonothan Geach James Morrish and Philip Liddicoat theirs
Executors administrators and assigns
respectively to be paid kept done and performed They
the said William Scantlebury Rundle and Thomas
Commins Do demise and lease unto the said Hugh Santo John Olford John
Santo Joseph Jeffery Jonothan Geach
James Morrish and Philip Liddicoat their Executors administrators and
assigns respectively All those
two messuages or dwelling houses situate in the Borough of Lostwithiel
aforesaid together with the Courtlage and
Outhouses thereto belonging (being the same hereditaments and premises
as were comprised in the said Indenture
of Lease of the Thirtieth day of September One thousand eight hundred
and thirteen hereinbefore referred to) and which
said messuages or dwelling houses hereditaments and premises are now in
the respective occupations of Thomas
Langdon and Betsy Matthews Excepting and always
reserving out of this present grant
and demise All things excepted and reserved on the Original Lease
thereof To have and to hold
the said messuages or dwelling houses hereditaments and premises hereby
demised unto the said Hugh Santo John
Olford John Santo Joseph Jeffery Jonothan Geach James Morrish and Philip
Liddicoat their Executors
administrators and assigns respectively from the Twenty fifth day of
March next for and during the term of
Twenty one years fully to be complete and ended if the said Stephen
Pascoe should so long live They the said Hugh
Santo John Olford John Santo Joseph Jeffery Jonothan Geach James Morrish
and Philip Liddicoat their
Executors administrators and assigns Yielding and
Laying therefore yearly and every year
from the commencement and during the said term unto the said William
Scantlebury Rundle and Thomas
Commins their Executors administrators or assigns the clear yearly or
sum of Four pounds fifteen shillings of good and lawful
money of Great Britain by even and equal quarterly payments at the four
most usual feasts or days of
payment of rent in the year that is to say at Midsummer day Michalmas
day Christmas day and Lady day in
every year the first payment thereof to begin and be made at Midsummer
next And the said Hugh
Santo John Olford John Santo Joseph Jeffery Jonothan Geach James Morrish
and Philip Liddicoat do
hereby for themselves their heirs Executors administrators and assigns
respectively covenant promise and
agree to and with the said William Scantlebury Rundle and Thomas Commins
their Executors
administrators and assigns respectively in manner following that is to
say that they the said Hugh
Santo John Olford John Santo Joseph Jeffery Jonothan Geach James Morrish
and Philip Liddicoat
their Executors administrators and assigns respectively shall and will
well and truly pay or cause
to be paid unto the William Scantlebury Rundle and Thomas Commins their
Executors
administrators or assigns the said yearly rent of Four pounds fifteen
shillings on the days and times
hereinbefore limited or mentioned for payment of the same And
also shall and will pay or
cause to be paid all rates taxes rent charges in lieu of tithes and
outgoings (except the property or
Income tax) during the said term Provided always that
if the said yearly rent
shall be behind and unpaid in part or in all by the space of Twenty days
next after any or either
of the days or times whereon the same ought and is hereby limited to be
paid as aforesaid being lawfully
demanded and then not paid and no sufficient distress on or upon the
said demised premises in the
meantime can or may be had for recovering the same together with the
arrears thereof if any Or
if the said Hugh Santo John Olford John Santo Joseph Jeffery Jonothan
Geach James
Morrish and Philip Liddicoat their Executors administrators and assigns
respectively do not in
all things well and truly observe perform fulfil and keep all and every
of the covenants conditions
and agreements herein on their part contained That then and from
thenceforth for all any or either
of the Causes aforesaid it shall and may be lawful to and for the said
William Scantlebury Rundle
and Thomas Commins their Executors administrators and assigns into and
upon the said demised
premises in the name of the whole to reenter and the same to have again
repossess and enjoy as in
their first and former Estate anything herein Contained to the contrary
thereof in anywise
notwithstanding And the said Hugh Santo John Olford
John Santo Joseph Jeffery
Jonothan Geach James Morrish and Philip Liddicoat do hereby for
themselves their heirs
Executors administrators and assigns respectively covenant with the said
William Scantlebury
Rundle and Thomas Commins that they the said Hugh Santo John Olford John
Santo Joseph
Jeffery Jonothan Geach James Morrish and Philip Liddicoat will at all
times hereafter during
the said term observe and perform all the covenants and conditions
contained in the said Indenture
of Lease and henceforth on the part of the said lessees their Executors
administrators or assigns
to be observed and performed and will at all times hereafter keep
indemnified the said
William Scantlebury Rundle and Thomas Commins their heirs Executors and
administrators and their Estates and Effects from and against the
observance and performance
of the said covenants and conditions (and particularly the covenant to
repair the said premises
or to have the same in repair it being the true intent and meaning of
these presents that the said
William Scantlebury Rundle and Thomas Commins their heirs Executors and
administrators or
assigns shall not be called upon to keep up or in anywise repair the
said premises or leave the same
in repair at the expiration of the said term) and all actions suits
claims and demands whatsoever
for or on account of the same or in anywise relating thereto In
witness whereof the
parties aforesaid their hands and Seals interchangeably have set the day
and year first before written
