Will of Benjamin Sobee/Soby, dated 13 October 1746

In the Name of God Amen The Thirteenth Day of October in the year of our Lord One Thousand Seven Hundred Forty Six I Benjamin Sobee of the Parish of Liskeard in the County of Cornwall yeoman being weak of Body but of Sound and perfect memory Do make and Ordain this my last Will and Testament First I recommend my Soul into the hands of Almighty God and my Body to Decent Christian Burial Whereas Catherine my now Wife is with Child I do give and Bequeath unto my said Wife all my Pewter Brass Beds and Bedding and all other my household Goods untill such my said Child which shall be born or Conceived in the Womb of my said Wife at the time of my Death shall attain the Age of One and Twenty Years or be Marryed then I do Give and Bequeath unto such my said Child one halfe of all my said Pewter Brass Beds and Bedding and one halfe of all my Other my Household Goods and the Other Halfe of my said Pewter Brass Bedds and Bedding and other of my said Household Goods I do Give and Bequeath unto my said Child after the Death of my said Wife and if Samuel Swigg who is a life on my Estate in Hill within the Parish of Minhiniott do happen to Survive my said Wife I Do give and Bequeath unto such my said Child all my said Estate in Hill and to its’ Executors But if my said Child which shall be borne or Conceived in the Womb of my said Wife at the time of my Death happen to Dye before my said Wife then I do give & Bequeath unto my said wife all my Estate in Hill aforesaid and to her Executors Administrators and Assigns All the Rest of my Goods Chattells Credits and Effects I do give and Bequeath unto such my said Child but if such my said Child do happen to be still born or dye Unmarryed before it doth Attain the Age of One & Twenty Years then I do Give and Bequeath unto my Brother Thomas Sobee Ten pounds of Lawfull Money of Great Brittain & I do give and Bequeath unto my Brother John Sobee Ten pounds And I do give and Bequeath unto my Brother Joseph Sobee Twenty pounds And I do give and Bequeath unto my sister Elizabeth Aunger Ten pounds and I do give and Bequeath unto my Nephew John the Son of John Sobee aforesd. Five pounds And I do give and Bequeath unto my Kinsman Thomas Burrows one Pound and One Shilling all the said Sums to be paid at the End of One Year after the death of such my said child Provided the Remainder of my Effects after paymt. of my Just Debts funeral Charges and Maintainence of such my said child do amount to the said sums and I give and Bequeath unto my Nephew Matthew the Son of the sd. Elizabeth Aunger one of my three greatest Brass Pans to be delivered to him at the End of one Year after the Death of such my said Child dying before it doth Attain the Age of One and Twenty Years as aforesaid And I do also give and Bequeath unto my said Nephew John Sobee my clock after the Death of my said wife Provided that such my said child do die unmarryed before it doth Attain the Age of one and Twenty Years and not Otherwise and all the rest residue and remainder of my Goods Chattells Creditts and Effects I do give and Bequeath unto Catherine my said wife whom I do likewise constitute make and Ordain to be my whole Sole Executrix of this my last Will and Testament And I do Appoint my Fatherinlaw John Coad and my Brother Joseph Sobee with my said Wife to be Guardians over my said Child Desiring the said John Coad & Joseph Sobee to Aid and Assist my said Wife in bringing up my said Child

The before written Will was proved in Comon Form the 6th Febry. 1746 Before the Revd. Mr Wm. Waddon Clerk Mr. of Arts Official er. And Admion of the Goods er. Of the Deced & of all things concerning the said Will Granted to the Executrix therein named being first Sworn er./ Saveing er.
