Return to Liskeard Parish Page Will of Joseph Fleming, dated 18 September 1735In the Name of God Amen I Joseph Fleming of the Burrough of Liskeard in the County of Cornwall Chirurgeon Considering the Uncertainty of this life and being of Sound and Disposeing mind and Memory (thanks be to God) do hereby make and Ordain this to be my last Will and Testament in manner and forme following Revokeing all and every Will and Wills by me heretofore made In the first place I commend my Soul into the hands of Almighty God my Creator hopeing through the Alone Merritts of Jesus Christ my Saviour to receive pardon for all my Sins and my Body to the Earth to be Decently Interred in the Night time in the most private manner it possibly can be done I also give devise and Bequeath unto my Grandson John Fleming Scotchburn all those Three Fields with the Appurt(s) lying at or near Veasloo(?) within the parish of Liskeard which I lately Bought of Mr. James Bennick to hold the same to him for and during the Term of his Naturall Life and after his Death to the Use and Behoofe of the Heirs of the Body of the said John Fleming Scotchbourne lawfully to be begotten and for default of such Issue I give and Devise the said Fields with the appurtenances unto my Grandson George Scotchburne for and during the terme of his Natural Life and after his Decease to the use of the Heirs of the Body of the said George Scotchbourn lawfully to be begotten and for Default of such issue to the Use and Behoof of the Heirs Males of the Body of my Daughter Elizabeth Scotchbourne Lawfully to be begotton and for Default of such Issue to the Use and Behoof of the Heirs of the Body of my said Daughter Share and Share alike and for Default of such Issue to the Only Use and Behoof of my Wife Ann Fleming for and during the Forme of her Natural life and after her Death to the Only Use and Behoof of my Son in law George Schotchbourne and my said Daughter Elizabeth Scotchbourne and the Survivor of them his or hers Heirs and Assigns forever, I also give and Bequeath unto my said Grandson John Fleming Scotchbourne Sixtey Pounds in Order to place him out an Apprentice to a Chirurgeon when and as Soon as he shall be thought capable for that purpose and if he shall not be thought Capable for Such Business or Imployment then to such other business Trade or profession as his parents shall think fitt or most Convenient I Also give Bequeath and Devise unto my said Grandson George Scotchbourne two Fields or Meadows of Land lying at or near Trevecco with in the said Parish of Liskeard to hold the same with App.es unto him the said George Scotchbourne for and during the Terms of his Natural life and after his Death unto the Heirs of his Body Lawfully to be begotten and for default of such Issue I Give and Devise the same unto my said Grandson John Fleming Scotchbourne for and during the Terms of his Natural Life and after his Decease unto the Heirs of his Body lawfully to be begotten and for Default of such Issue to the Heirs Males of the Body of my said Daughter Elizabeth Scotchbourne and for Default of such Issue to the Use and Behoof of the Heirs Females of the Body of my said Daughter Elizabeth Lawfully to be begotten share and share alike and for default of such Issue to the use and behoofe of my said Wife for and During the Forme of her Natural life and after her death to the Use and Behoof of my sd. Son in law George Scotchbourne and Elizabeth his wife and the Survivor of them his or her Heirs and Assigns for ever I Also give unto my said Grandson George Scotchbourne One hundred Pounds for his better Education and Maintainance and for placeing him to some Trade or profession such as his parents shall think most proper I also give unto my Granddaughter Elizabeth Scotchbourne the Sume of One Hundred Pounds to be paid when she shall attain the Age of One and Twenty Years but in Case she shall happen to dye before or after that age unmarryed then I Give the said Sume of One Hundred Pounds unto my said Son in law and Daughter or the Survivor of them provided always and it is my Express Will and Direction that the Incomes profits and produce of the premises and Lands and of the Swine(?) and Sumes of Money before given and Devised unto my said Grand Children as aforesaid shall be from time to time and at all times until my said Grand Children and all other my afterborn Grand Children shall Severally and Respectively Attain this Age of One and Twenty Years had taken and received by my said Son in Law George Scotchbourne and Elizabeth his Wife and the Survivor of them for and Toward the Eduation Maintainance and Support of my said Grand Children and after bourne Grandchildren and each and every of them I Also Give unto my said Daughter Elizabeth Scotchbourne the House with the Apps. Wherein I now live for all the Residue of the Ferme(?) I have therein and I Give her Fifty Pounds to be paid within Six Months after my Death and three full parts of all my household Goods whatsoever the Otherpart of my said Household Goods I Give to my Wife Anne Fleming Earnestly desireing that if they make a partition or Allottment of the same that it may be done in the most Friendly and Dutifull manner I also Give unto my Son in Law George Scotchbourne all my Shop Goods whatsever of what kind or Nature soever, books Instruments and Utensills whatsoever belonging to the Use or practise of an Apothocary or Chirurgeon and all Book Debts or money due on books only by means of such my practice, I Also give and Devise unto my said wife Ann Fleming all those Four Fields or Meadows of Land lyeing at or near Vensloo and old park within the parish of Liskeard which I bought of my Brother in law Thomas Woodward to hold to her and her Assigns for and during the Terms of her naturale Life subject Nevertheless to the provisos hearafter mentioned and from and after her Death to the only Use and Behoof of my Son in Law George Scotchbourne for and during the Terms of his Natural Life and from and after his Decease to the Only Use and Behoof of my said Daughter Elizabeth for and during the Terms of her natural Life and and after her Death to the Only Use and Behoofe of the Heirs Males of the Body of my said Daughter lawfully begotten or to be begotten and for Default of such Issue to the Only Use and Behoofs of the Heirs Females of my said daughter Lawfully Begotten or to be begotten and for default of such Issue to the Use and Behoofs of the Survivor of them the said George Scochbourne and Elizabeth his Wife his or her heirs forever I also Give unto my said Wife Five pounds yearly to be paid by Quarterly payments to be Quoted(?) from the time of my Death provided always that if my said Wife shall at anytime Marry or take to Husband and person whatsoever that then and in such case and it is my Express Wile that the aforesaid Bequests and Gift with respect to her as to the said Four Fields and as to those(?) Five pounds a year shall Absolutely be Void null and of none Effect and that then and in such case I do Give her the said Ann Fleming One Annuity or Yearly Rent Charge of Ten pounds to be Issueing out of and Charged and Chargeable upon the aforesaid Four Fields and to be paid by Quarterly payments free of all outgoings to be reckoned (?) from the day of such marriage with full power to Distrain in case of non payment All the rest and Residue of my Goods Chattolls & Creditts not herein before given or Bequeathed I do hereby Give and Bequeath the same unto my said Wife Ann Fleming and unto my said Daughter Elizabeth Scotchbourne and do hereby make Ordain and Constitute the said Ann Fleming and Elizabeth Scotchbourne Executives of this my last will and Testament IN WITNESS whereof I have to this my Will being Written on Two Sheets of paper and to each Sheet set my hand and Seal this Eighteenth day of September in the Ninth Year of the Reign of our Sovereign Lord George the Second King of Great Brittain and Soforth and in the Years of our Lord One thousand Seven Hundred and Thirty Five

Arts Official And Admion of the Goods et. Of Thesd. Joseph Fleming deced
(remaining unadministered by Ann Fleming & Elizabeth Scotchbourne the
Exectrixes named in thesd. Will/ Granted to George Scotchbourne Gent the
Father & Guardian lawfully elected during the minority of John Fleming
Scotchbourne the Grandson and one of the next of Kinn of thosd. Dececd
(being first Sworne et./Saveing et.) John Bennett (signed) | ||||||
