This Indenture Tripartite made the first day of February in the Seventeenth year of the Reign of our Sovereign Lord George the Second by The Grace of God of Great Britain and France King Defender of the faith and So forth and in the year of our Lord one thousand seven Hundred forty and three Between Mary Pomery in the Borough of Camelford in the County of Cornwall widow of the first part John Johnson of the parish of Lanteglos by Camelford in the said County yeoman of the second part and Edward Cock of the said parish of Lanteglos yeoman of the third part Whereas Said John Johnson by his deeds of Lease and Release bearing dates the eighteenth and nineteenth days of August 1739 and in Consideration of the Sum of ? Pounds unto the said John Johnson in hand paid by the Said Edward Cock in part and Convey unto the said Mary Pomery All and Singular these three Land Meadow and Pasture Commonly called or known by name of Matthews parks Situate lying and being within the Village of Trefrow in the Said Parish of Lanteglos Containing by Estimation Seven Acres of Land be the same more or less and all houses buildings orchards Gardens ? Meadows pastures feedings Commons Common of Pasture Ways of paths waterings Profits Commodities and hereditaments whatsoever to the said Land and premises belonging and the Revertion and Revertions the Remainders and Remainders Rents Duties Suites And Services thereof To Have And To Hold all and Singular the Said thereby Granted and Conveyed premises called Matthews
with the appurtenances unto her the Said Mary Pomery her heirs and assigns forever to the use and behoofe of the Said Mary Pomery her heirs and assigns forever more in which Said Deed there is a proviso that by a payment of the Said Sixty Pounds and Interest? (at a day long Since passed to be void And Whereas the Said Mary Pomery hath at several times Since advanced and Lent to the said John Johnson Severall other sums Which the Said John Johnson hath Charged the Said premises with Repayment thereof with Interest AND on An amount now Stated and made up by and between the Said John Johnson and Mary Pomery there appears to be due from the Said John Johnson to the Said Mary Pomery for which the said premises Stand charged as aforesaid the Sum of one hundred pounds Now This Indenture Witnesseth that the Said Mary Pomery for and in Consideration of the Said Sum Of one hundred pounds of good and Lawfull money of great Britain unto him the said Edward Cock (by and with the Consent approbation and direction of the Said John Johnson Testified by his being a party here unto and Signing and Sealing hereof the receipt whereof is hereby acknowledged and thereof and of every part and parcel thereof She the Said Mary Pomery doth hereby Remise Release and discharge the Said Edward Cock his heirs and assigns and the said John Johnson for and in Consideration of the Sum of thirty pounds Like lawful money of great Britain And him the Said John Johnson in hand paid the receipt also of which is acknowledged in all making the Sum of one hundred and thirty pounds Have and each of them granted bargained Sold aliened Enfeoffed Released conveyed and Confirmed and in and by these presents Doe and Each of the Doth Grant Bargain Sell alien Enfeoff release and Confirm unto him the Said Edward Cock now in his actual Possession now bought by virtue of an Indenture of Bargain and Sale for one whole year to him thereof Made by the Said Mary Pomery and John Johnson bearing date the day next before the day of the date hereof and by force of the statute for transferring uses into possessions and to his heirs and assigns forever All and Singular the aforesaid premises Called Matthews Parks and the houses and Buildings thereon together with all gardens and all other the appurtenances thereunto belonging And also all the Estate Right Title Interest Claims and demand whatsoever both in law and Equity of the Said Mary Pomery and John Johnson or either of them of in or to the same and the         ibertious Remainder and Remainders Rents duties Suites and Services thereof together With all deeds evidences papers writings for the same TO HAVE AND TO HOLD all and singular the said premises together with the appurtenances and every part and parcel thereof and parcel thereof unto           Only use and behoofe of the Said Edward Cock his heirs and assigns forever           By and under the ancient suits and services thereof heretofore due and of right accustomed AND the said Mary Pomery doth demand by these presents         her heirs executors and assigns doth covenant promise and agree unto and with the said Edward Cock his heirs and assigns that she the said Mary Pomery hath not done Committed or Suffered all        matter and thing whatsoever whereby or wherewith the said        is or are Xxaged Charged or in Tithe Charge or otherwise howsoever shall and May be lawfull to and for the Said Edward Cock        Peaceably and Quietly to have now and Enjoy the Said premises without the ? and suit        Charge or denyal of her the Said Mary Pomery or any person or persons whatsoever lawfully Claiming the Said by and from or under her And the Said John Johnson doth for himself his heirs Executors and administrators covenant promise and agree to and with the Said Edward Cock his heirs and assigns that they the Said Mary Pomery John Johnson or one of them Now at the time of the Sealing and delivering these presents Have or one of them hath good Right and power and lawfull Authority to Grant Bargain sell transfer and confirm all and Singular the Said premises hereby granted and        with the appurtenances unto the Said Edward Cock his heirs and assigns forever in manner and form aforesaid And that the Said AND That he the said Edward Cock his heirs and assigns shall and may from time to time And at all times forever hereafter peaceably and quietly have hold use occupy posses and enjoy all And singular the said premises hereby granted and conveyed with the appurtenances without the Lawfull let Suit trouble        Molestation or denyal of him the Said John Johnson his heirs and assigns or of any other person or persons whatsoever lawfully claiming the same ALL        discharged and at all times forever hereafter well and sufficiently be kept harmless and indemnified by him the Said John Johnson his heirs and assigns by and from all and all manner of former and other Gifts grants Sales Jointures Dowers Mortgages Judgements Executions Rents and Incumberances whatsoever heretofore had made Suffered or Done by him the Said John Johnson or any other person or persons whatsoever lawfully Claiming the Same one Lease of the houses and       and Little plot adjoining for the life of Elizabeth Tresthick and        of Samuel Staddon and the high and Chiefs Rents from henceforth to grow due and owing to the high and Chief Lord and Lords of the fee and fees the said premises only Excepted and fore prized And further know that he the Said John Johnson and his heirs shall and will at the request and only use and behoof of him the said Edward Cock his heirs and assigns make doe acknowledge Execute and Suffer or Cause to be made done acknowledged suffer all and every further and other act and acts thing and things whatsoever the more perfect Granting and conveying the said premises with their appurtenances unto him the Said Edward Cock his heirs and assigns        to the true Intent and Meaning these presents be it by        Recovery or Recoveryes or otherwise whatsoever as by the said Edward Cock or his counsel learned in the law Shall be reasonably devised or advised as the parties who are obliged to doe the Same be not Compelled        above the Space of Sixteen miles from the place of habitation said John Johnson and his Heirs All and Singular the Said hereby conveyed premises with the appurtenances        him the Said John Johnson and his heirs against all and every        Whatsoever lawfully claiming        quit and forever by those presents Defend In Witness whereof the parties first above named to these present Indentures their hands and seals interchangeably have set the day and year first above written
