The Will of Thomas Hill, dated 22
February 1843
The last Will and Testament of
Thomas Hill.
I Thomas Hill of the Parish of Lanlivery in the County
of Cornwall Yeoman being very sick and weal in body but
of a perfect sound mind and memory do hereby make this
my last Will and Testament as touching my worldly
Estate, and do hereby give, devise and dispose of the
same in manner following; that is to say
First
I hereby appoint my son Peter Hill my sole Executor in
trust after my decease to receive all Rents Shares? and
Profits arising from my personal Estate and to dispose
of the same as I shall hereafter require.
Secondly
I give and bequeath to my Grandson Thomas Hill the son
of my son Thomas Hill and Rebecca his wife the sum of
Ten Pounds, to be paid in two years after my decease out
of the amount of Rents Shares? And Profits arising from
my said Estate.
Thirdly
I also give and bequeath to Thomas Saundercock my
son-in-law( the husband of my daughter Frances deceased)
the like sum of Ten Pounds, also to be paid in two years
after my decease out of the amount of the said Rents
Shares? And Profits also arising from my said Estate.
Fourthly
After the said legacies are paid with any other regular
demand on me, I then give and bequeath all my Leasehold
Property to my children equally alike, them having my
said Executor in trust my son Peter Hill to receive and
equally to divide the said amount of Rents Shares? And
Profits between them as long as the said Lease shall
exist.
Fifthly
Should any or either of my dear children die without
share after my decease then whatever share of my
property his heirs of theirs may be, shall immediately
become the property of my surviving children, but should
any or either of them die and leave children, then their
children shall receive the same portion as if their
parents had been living during the said Lease given
under my hand this 22nd day of February 1843.

Will & Testament in the presence of us

The Sign X of Thomas Hill
In the Archdeaconry Court of Cornwall.
In the Goods, &c. of Thomas Hill, late of the Parish of
Lanlivery Yeoman deceased.
Appeared personally Thomas Hodge of the Borough of
Lostwithiel in the County of Cornwall, Accountant, and
made oath that he is one of the subscribed witnesses to
the last Will and Testament of Thomas Hill late of the
Parish of Lanlivery aforesaid yeoman deceased, now
hereunto annexed, beginning thus "The last Will and
Testament of Thomas Hill" ending thus,-"Given under my
hand this 22nd day of February 1843" and thus
subscribed, in sign X of Thomas Hill. And that this
Deponent and Thomas Hender the other subscribed Witness
to the same Will, were present at the same time when the
said deceased on the twenty second day of February 1843
wrote and subscribed his mark to the said Will, and this
Deponent and the said Thomas Hender subscribed their
names thereto, in the presence of the said Testator, and
of each the other, as Witnesses thereof.
On the twenty second day of July 1843, the said Thomas
Hodge was duly sworn to the truth of this Affidavit,
before me F.J.H.Kendall Surrogate.

Will of
Thomas Hill Yeoman deceased proved
in common form before Francis John Hext Kendall Clerk A.? N.? Surrogate
fe?
And Admion of all and singular the Goods of the said deceased and any
way concerning the said will was granted to Peter Hill son of the said
deceased and sole Executor names in the said will being first sworn
saving.
Effects sworn under £200.
Died 28th March 1843.
