Will of William Higgs - 5 August 1869

This is the last will and testament of me William Higgs of Whistow in the parish of Lanlivery in the county of Cornwall, Yeoman. First I give and devise to my son William Higgs all my freehold farm and dwelling house with the rights members and appurtenances belonging thereto situate at Fenton in the parish of Lanivet. Also all my freehold house with the garden and appurtenances belonging thereto situate at Trevell Lane in the said parish of Lanivet now in the occupation of my son Nicholas Higgs as yearly tenant thereof. Also all the two freehold dwelling houses and gardens belonging thereto with the yearly high rent of three shillings and one penny arising there from situate at Trebell Green in the said parish of Lanivet, the said high rent being due from Thomas Luke and Anthony Hendy the lessees thereof. Also all the freehold dwelling house smiths shop and appurtenances belonging thereto situate at Fenton Pits in the said parish of Lanivet with the yearly high rent of three shillings, the said high rent being due from John Locke as lessee thereof. Also the high rent of a house (formerly occupied by the late Thomas Tinney) situate in Fenton Pits in the parish of Lanivet the said high rent being nine shillings a year and due from the aforesaid John Locke. And I also give and bequeath to my said son William Higgs six silver tea spoons and one silver sugar tongs each marked with the initials W.N.H., and also my best mahogany bedstead now in the care of my son Nicholas Higgs. Second I give and bequeath to my son Nicholas Higgs all my household furniture with the exception of my best mahogany bedstead hereinbefore bequeathed to my son William Higgs. Third I give and bequeath to my son John Higgs the sum of one pound the same to be paid to him at the end of twelve calendar months after my decease. Fourth I hereby constitute and appoint my son William Higgs the sole executor of this my will who shall collect and receive all debts due to me and pay the herein bequeathed legacy with all my just debts funeral and testamentary expenses and the expense and proving and registering this my will. And lastly I hereby revoke and make void all former or other wills by me at any other time heretofore made and do declare this only to be my last will and testament. In witness whereof I the said William Higgs have to this my last will and testament set my hand this fifth day of August in the year of our Lord one thousand eight hundred and sixty nine ________________ William Higgs _________________ signed by the said William Higgs as for his last will and testament (the same having first been read over to him) in our presence who in his presence and in the presence of each other have attested and subscribed our names hereto on the day and date above written _________________ John Hobbah, schoolmaster of Luxulyan ______________ Edmund Church, farmer of Lanlivery.

BE IT KNOWN, that on the 29th day of April 1872, the last will and testament ________ hereunto annexed of William Higgs, late of Whistow in the parish of Lanlivery in the county of Cornwall yeoman, deceased, who died on the 17th day of February 1872 at Whistow aforesaid _____________ and who at the time of his death had a fixed place of abode at Whistow aforesaid within the district of the county of Cornwall was proved and registered in the District Registry attached to the Probate Division of Her Majesty’s High Court of Justice at Bodmin and that Administration of all and singular the personal estate and effects of the said deceased was granted by the aforesaid court to William Higgs, the sonof the said deceased, the sole Executor named in the said will, he having first sworn well and faithfully to administer the same, by paying the just debts of the deceased and the legacies contained in his will _______, and to exhibit a true and perfect inventory of all and singular the said estate and effects, and to render a just and true account thereof whenever required by law to do so.
