IN THE MATTER OF WE the undersigned Inclosure
Commissioners for England and Wales by virtue of the
acts for the Inclosure Exchange and Improvement of Land
in the consideration of the sum of £72 paid into our
hand by William Marshall of the Parish of Lanivet in the
County of Cornwall Yeoman being the purchase money of
the hereditaments hereinafter described DO by these
presents convey unto the said William Marshall of the
Parish of Lanivet his heirs and assigns ALL that piece
or parcel of land part of Referry Common in the Parish
of Lanivet in the County of Cornwall being Allotment
numbered 5 on the map annexed to the award of the Valuer
acting in the matter of the above mentioned Inclosure
containing by admeasurement 5 acres 1 Rood 30 Poles
Excepting and Reserving unto the Lord of the Mannor of
Referry for the time being all mines minerals stone and
other substances under the land intended to be hereby
conveyed with full power and authority for him his heirs
lesees and assigns and his and their Agents Miners and
Servants at all times hereafter to enter upon all or any
part of the said Lands and to do all necessary or
reasonable acts for the convenient exercise of this
power and authority, he and they paying reasonable and
adequate compensation to the persons entitled to the
surface of such Land for damage done to such surface in
the exercise of the rights aforesaid unto and to the use
of the said William Marshall his heirs and assigns or
other the owners for the time being of the said piece of
Land hereby assured shall make and all times hereafter
maintain and keep in good order and repair the fence of
the said Allotment adjoining the Public Road abutting
the South end thereof and also all that part of the
Western Fence dividing the said allotment from other
parts of the said Common lying in length 510 linkes from
the Public Highway abutting on the North of the said
Allotment hereby conveyed
