The Will of John Peters, dated 8 October 1746

(page one) In the Name of God Amen I John Peters of of the parish of Landulph in the County of Cornwall Yeoman being (blessed be God) of a Sound perfect and understanding mind and memory But Considering the uncertainty of this Life and that all Flesh must Dye and hereby Revokeing and Annulling all former and Other Wills and Testaments by me at any time heretofore made Do make Ordain publish and Declare this and none but this as and to be my last Will and Testament.
 
First I Give Devise and Bequeath unto my Eldest Son John Peters all that my Tenent with the Appurtenances as mentioned in One Indenture of Lease bearing date the Second Day of May in the twelfth year of the Reign of King George the first and determinable as therein or prossed (?)which said Tenement was heretofore in the possession of one Thomas Lorser (?) otherwise Congdon, So the Said John Peters giving unto his Brother James one half of the Apple Trees now growing in the Nursery belonging to the said Premisses to be taken from the same any Time in three Years at the Election of the Said James.
 
Also I give and bequeath unto my second son William Peters the sum of three pounds to be paid by my Executor hereinafter named at the End of three months next after my Decease. Also I give and bequeath, unto my Grand Daughter Mary Rickcard the sum of five pounds to be paid her as soon as she shall attain the full age of twenty-one years, Also I give and bequeath, unto my Daughter Mary the Wife of Henry Rickeard, the sum of five pounds, to be paid her at the End of one year after my Decease. Also I further order that my quirk and dead (?) goods shall be sold by my Executor hereinafter named for the payment of my just Debts and in Case that shall not be Sufficient for

Dischargeing thereof Then to Sell and Dispose of the House and premises called prideaux’s and in case that a Deficiency Shall happen the Bicton parke to go to and for the Discharging of the same and that my said Executor shall also pay unto my said Son John Peters and Daughter Mary Rickard Fifty Shillings each Six Months after the Discharge of my said Debts in case any Ballance shall remain after Dischargeing the said Debt and that my said Son John Shall have all the Trees in wole meadow nursory having three years time for Carrying away the same. All the Rest Residue and Remainder of my Goods and Chattells Lands and Tenement of what kind and Quality soever I Give Devise and Bequeath unto my Son James Peters whom I hereby make and appoint whole and Sole Executor of this my last Will and Testament. In Witness whereof I have hereunto sett my hand and Seal this Eighth Day of October in the Twentyeth Year of the Reigne of our Sovereign Lord George the Second now King of Great Brittain and So forth and in the Year of our Lord 1746.

The before written will was proved in Common forms the 4th Day of November 1746. Before the Rev.’d Mr. Stephen Hicks Clerk M. of Arts Surrogater. And Admion of all and Singular the Goods etc. Of Thos. Dowd and of all things howsoever concerning his said will was Granted to the Executor therein named (being first sworne etc.) Saveing etc.

The before written will is a Tru Coppy of the last Will and Testament of the above named John Peters Examined and Compared with the Original this 13th Day of November 1746. By us.
