The Will of Elizabeth Huddy, dated 3 December 1741I Elizabeth Huddy of the parish of Ladock in the County of Cornwall do make this my last Will and Testament hereby revoking all other Wills by me heretofore made Imprimis I Give and Devise unto Joseph Hawkey of the parish of St Callomb major in the County of Cornwall Gent and Hugh Mander of the Burrough of Truro in the said County Gentleman and to their Heirs and Assigns all my Lands Tenements and Ho---ditam--? In the said parish of Laddock and County aforesaid upon Trust and Confidence that they and the Survivor of them and his Heirs shall stand Seized thereof for the respective uses hereinafter mentioned and to and for no Other Use Behoofe Intent or purpose whatsoever that is to say as for and Concerning that part of Forgew Called Hoblyns Forgew Scituate Lying and being in the aforesaid Parish of Laddock to and for the Use and Behoofe of my Sister Julian Hoblyn and her Assigns for and during her Natural life but so as her Husband shall have no right to the same or the Produce thereof and from and Imediately after her decease to my said Trustees and the Survivor of them and his Heirs for Raising out of the said Estate called Hoblyns Forgew by Leaseing the same for any Number of Years certain or for any long Term of Years Determinable on the Death of One Two or three life or lives or by Selling or Mortgageing the same or any part thereof as to my said Trustees shall seem most Convenient the Sum of one Hundred Pounds which I hereby give and Bequeath unto the Daughters of my Sister Katherine Buckingam which shall be then liveing share and Share alike and from Immediately after the said Sum of One Hundred Pounds shall be raised as aforesaid Then my will is that my said Trustees and the Survivor of them and his Heirs shall stand Seized of the said promisses Called Hoblyns Forgew or the Residue thereof to and for the use and Behoof of my two Nieces Elizabeth Williams and Ursula Hobbs and the Heirs of their Bodyes forever Share and Share alike and for Default of such Issue to and for the use & Behoof of all the Children of my said Sister Katherine Buckingam share and Share alike and to their Heirs and Assigns forever and to and for no other Use Behoof Intent or purpose whatsoever Item I Give and Bequeath unto my said Nieces Elizabeth Williams and Ursula Hobbs five pounds apiece to buy them Mourning, and as touching and Concerning my Other part of Forgew aforesaid called Arundells Forgew likewise Scituate lyeing and being in the aforesaid parish of Laddock and County of Cornwall my Will is that my said Trustees and the Survivor of them and his Heirs shall stand Seized thereof to and for the Use and behoof of my Sister Katherine Buckingam for and during her Natural life but so as her Husband shall have no right to the same or unto the produce thereof and from and Immediately after her Decease to my said Trustees and the Survivor of them and his Heirs for raiseing out of the said Estate Called Arundles Forgew the sum of One Hundred Pounds (with the same power to my said Trustees for raiseing the same as is beforegiven them for raiseing the Other above mentioned one Hundred Pounds out of Hoblyns Forgew aforesdaid) and which One Hundred Pounds to be raised out of Arundells Forgew as aforesaid I hereby Give and Bequeath unto such of the Daughters of my said Sister Katherine Buckingam as she my said Sister shall by any Writeing under her hand Testifyed by Two or more Credible Witnesses or by any Writeing purporting to be her last Will and Testament duely Executed Direct & Appoint and for want of such Apportion the same is to be divided Equally between all her said Daughters that shall be Living at the time of the said Catherine Buckingams Decease and Immediately from and after the said One Hundred Pounds shall be raised out of Arundells Forgew as aforesaid Then I Give and Devise the said Estate called Arundles Forgew or the Residue thereof unto my Nephew Henry Buckingam Son of my said Sister Katherine Buckingam and to his Heirs and Assigns forever Item I Give and Bequeath unto my Brotherlaws John Hoblyn and Peter Buckingam one Guinea each to buy them Rings in remembrance of me Item I Give unto such poor people of the parish of Laddock aforesaid (as receive no pay from the said Parish) as my Executors hereinafter named shall think proper objects of Charity the Sum of Forty Shillings and my Desire is that I may be Buried in the parish Church of Laddock in a Decent but private Manner All the Rest and residue of my Goods and Chattells Rights and Creditts I Give and Bequeath unto the said Joseph Hawkey and Hugh Mander who I do hereby make and Ordain whole and Sole Executors of this my last Will and Testament In Trust Nevertheless to and for the Use and Behoof of my Sisters Julian Hoblyn and Catherine Buckingam independent of and without the Controul of their Husbands In Witness whereof I have to this my last Will and Testament sett my hand and Seal and published and Declared the same to be my last Will and Testament this Third Day of December in the Year of our Lord One Thousand Seven Hundred and Forty One.
The before written Will was Proved in Common Forme the 9th Feb’ry 1746 Before the Revd Mr Wm Waddon Clk Mr of Arts Official etc and Admion of the Goods etc of the Dec’ed and of all things concerning her said Will was Granted to the Executor in Trust named therein (being first Sworne etc) Saveing etc The before written Will is a True Coppy of the last Will & Testamt of the before named Elizabeth Huddy deced Examined and Compared with the Original this 19th Day of Feb’ry 1746 By us (signed) John Bennett N.B.
