Indenture regarding Fair Moor, Bedock, Ladock, dated 6 March 1748

This Indenture made the Sixth day of March in the twenty second year of the Reign of our Sovereign Lord George the second by the Grace of God of great Britain France and Ireland King Defender of the Faith and so forth and in the year of our Lord one thousand Seven Hundred and Forty eight Between the Honourable Richard ARUNDELL of Allerton Mauleverer in the County of York Esquire of the one part and William MINORS of the Parish of Ladock in the County of Cornwall Clothier of the other part Witnesseth that the said Richard Arundell for and in Consideration of the Sum of Fourteen Pounds of lawfull money of Great Britain to him in Hand paid by the said William MINORS at and before the Sealing and delivery of those presents the Receipts thereof he doth hereby Acknowldege Hath granted demised Leased Sett and to Farm Letton and by those presents Doth grant demise Lease Sett and to Farm Lett unto the said William MINORS his Executors Administrators and Assigns All that piece or parcel of ground containing about six Acres be it more or Less part of the Higher or North most part of the Moor called Fair Moor Scituate lying and being in the Parish of Laddock in the said County of Cornwall and parcell of the Mannor of Bedock late in the possession of Francis SYMONS and now of him the said William MINORS with the Appurtenances to the same belonging or appertaining with Liberty and for the said William MINORS his Exectutors Administrators and Assignes to keep and pasture one Colt in the Woods called Bedock Woods during the Term herein after mentioned at such time and times only as no hurt or prejudice may be done to the said Woods or growth thereof by eating or Spoiling the Copps then growing [ ] also Liberty to lead drive carry and recarry into and from the said premises hereby granted through that other part of the said Moor granted to Sarah HAM Widow And also through the said Woods from the [ [ Accustomed Gate in the high way lane leading to Trelassack the said William MINORS his Executors Admrs. and Assigns still closeing and making fast the Gates after them for the safety of the said Woods excepting and reserving unto the said Richard Arundell and to such person and persons to whom the immediate reversion or remainder of the said Premisses shall belong their heirs and Assignes Timber Trees of Oak Ash and Elm now growing or hereafter to grow in and upon the said premisses with Liberty to fell cut down and carry away the same at his and their Wills and pleasure To have and to hold all and Singular the said premises hereby demised with the Appurtenances (except before excepted) unto the said William MINORS his Executors Administrators and Assigns for [ ] during and unto the full end and Term of Fourscore and nineteen years from thence next ensuing fully to be compleat and ended If the said William MINORS Aged about thirty seven years and Samuel Ch[ ] Aged about three years or either of them so long happen to live The Term and Estate to Commence and begin from and immediately after the death of the said Frances SYMONS the said William MINORS his Executors Administrators and Assigns yielding and paying therefore yearly and every year during the said Term unto the said Richard ARUNDELL his Heirs and Assigns the rent or sum of three Shillings and ten pence of lawfull money of great Britian at the four most usual Feasts or days of Payment of Rent in the year that is to say The Feast of the Annunciation of the Blessed Virgin Mary the Nativity of Saint John the Baptist Saint Michaell the Arch-Angell and the Birth of our Lord God by even and equal portions The Payment thereof to be made upon the Feast [ ] that shall first happen next after the Commencement hereof Also yielding and paying upon and after the death of every and either of them the said William MINORS and Samuel his son the lives named the Sum of five Shillings for and in the name of a Herriott or Farlioff Repairing also sustaining and maintaining the hedges and Fences of the said Premises in and with full and necessary repairations and Amendments whatsoever when and as often as the same shall need or require during the said Term and the same so well and sufficiently repaired in the [ ] of the said Term or other sooner Determination of the said Premisses shall and will leave and yeild up doing also and performing all such suites customs and services to all the Courts of the[ ] of Bedock as other the Tenants of the said Mannor are and have been accustomed to do and perform but if it shall happen the said yearly Rent of three Shillings and ten pence or any part thereof shall be behind and unpaid in part or in all by the Space of three Months next after any of the said days or Times of Payment on which the same ought to be paid as aforesaid being lawfully demanded and not paid and no sufficient distress can or may be had or found in or upon the said premises whereby the said rent with the Arrears thereof if any be may be levied and paid that then and [ ] thenceforth it shall and may be lawfull to and for the said Richard ARUNDELL and to and for such person and persons to whome the immediate reversion or remainder of the said promises shall belong their Heirs and Assigns into the said premises hereby demised with the Appurtenances to reenter and the same to have again retain repossess and enjoy as his and their first and former Estate those presents or any thing herein contained to the contrary thereof in any wise notwithstanding and the said Richard ARUNDELL his Heirs and Assigns all and Singular the said promises hereby [ ] with the Appurtenances unto the said Williams MINERS his Executors Administrators and Assigns in manner and form aforesaid during the Term aforesaid and Under the Rents Covenants Exceptions and Agreements aforesaid as well against the High and Cheif Lord and Lords of the Fee and Fees of the said promises for all High Rents reliefs suits and services issuing and payable out of the said premises as against all other person and persons whatsoever lawfully claiming or th claim the same or any part thereof shall and will Warrant acquit and for ever defend by those presents In Witness whereof the Parties first above named to those presents Interchangeably have set their hands and Seals the day and year first above written:
