THIS INDENTURE made the 29th day of September in the year of Our Lord 1836 BETWEEN William Bassett John Bassett and Joseph Bassett of the Parish of Ladock in the County of Cornwall Yeomen of the first part and John Vigus Joseph Grant Thomas Flight John Brown Treven James and William Brunton Esquires Iron Masters and Copper Smelters from Avon Glamorganshire of the second part WHEREAS by Indenture of Lease bearing date the 22nd day of June 1813 made and granted by the Right Honorable Edmund Earl of Cork and Orrery and William Stephen Poyntz esquire to Thomas Bassett the late Father of the said William Bassett John Bassett and Joseph Bassett they the said earl of Cork and Orrery and William Stephen Poyntz DID demise and lease unto the said Thomas Bassett ALL that piece and parcel of land late part of but then enclosed and separated from the Trethurfe Down or Common within the Mannor of Trethurfe in the Parish of Ladock aforesaid then in the occupation of the said Thomas Bassett and called BASSETTS TENAMENT containing by admeasurement 30 Acres 2 Roods and 35 Perches or thereabouts bounded on the North by the lands of Edward Coode esquire on the East partly by Latchers Tenament inclosed from the said Common and partly by the unenclosed part of the said Common on the South partly by the Lands of Lord Viscount Falmouth and partly by the unenclosed part of the said Common and in the West by Pollards and Keasts Tenaments also lately part and inclosed from Trethurfe Common aforesaid Together with all ways paths passages waters watercourses and appurtenances to the said piece or parcel of ground belonging or in any wise appertaining Except as in the said Lease is excepted TO HOLD unto the said Thomas Bassett from the 29th day of September then last past for the term of 99 years If the said William Bassett John Bassett and Joseph Bassett or either of them should so long happen to live subject to the yearly rent of £3 16/- 9d and 5/- for a Heriot on the death of each life and also subject to the several Excepting Covenants Provisoes and Agreements therein contained AND WHEREAS the said William Bassett John Bassett and Joseph Bassett being under the Will of their late Father deceased lawfully entitled to the said premises for the residue of the said term have contracted and agreed with the said parties of the second part for the absolute sale to them of the said premises for the sum of £40 NOW THIS INDENTURE FURTHER WITNESSETH that in pursuance of the said Covenant and Agreement and for and in consideration of the sum of £40 of lawful money current in Great Britain to them the said William Bassett John Bassett and Joseph Bassett in hand paid by the said parties of the second part the Receipt is hereby acknowledged THEY the said William Bassett John Bassett and Joseph Bassett DO by these presents grant bargain sell assign and transfer unto the said parties of the second part their Executors Administrators and Assigns ALL these premises hereinbefore described and granted by the said Lease with all buildings and erections thereon now in the occupation of Stephen Miners as tenant thereof together with all Rights Members and Appurtenances thereunto belonging TO HAVE AND TO HOLD all and singular the said premises hereby assigned with the appurtenances unto the said parties of the second part their Executors Administrators and Assigns for and during all the rest residue and remainder of the said term of 99 years now to come and unexpired therein determinable as aforesaid and for and during all the Estate Right title and interest which they the said William Bassett John Bassett and Joseph Bassett now have of in or to the same or any part thereof under and subject nevertheless to the payment of rent and Heriots and to the observance and performance of the Covenants and Conditions Exceptions Provisos and Agreements in the said Indenture of Lease contained and on the Lessees part to be paid observed and performed AND the said William Bassett John Bassett and Joseph Bassett do hereby for themselves their executors and Administrators covenant and agree with the said parties of the second part their Executors Administrators and Assigns that they the said William Bassett John Bassett and Joseph Bassett now have good right and full power and lawful and absolute authority to assign and transfer all and singular the said premises hereby assigned with the appurtenances unto the said parties of the second part their Executors Administrators and Assigns in manner aforesaid and according to the true intent and meaning of these presents AND that it shall and may be lawful to and for the said parties of the second part their Executors Administrators and Assigns from time to time and at all times hereafter into and upon the said premises hereby assigned peaceably and quietly to enter and to the same to have hold occupy and possess and enjoy or to receive and take the rents issues and profits thereof to and for their own use and benefit without the lawful let suit indemnification claim or denial of them the said William Bassett John Bassett and Joseph Bassett their Executors and Administrators or any person or persons claiming or to claim by from or under him or any or either of them AND FURTHER that they the said William Bassett John Bassett and Joseph Bassett their Executors and Administrators and all and every other person or persons having or lawfully claiming or shall or may hereafter have or lawfully claim any Estate Right title or interest of in to or out of the said premises hereby assigned by him hereafter upon every reasonable request and at the costs and charges of the said parties of the second part their Executors Administrators and Assigns make do acknowledge and execute all such further and other lawful and reasonable act and acts assignments and assurances in the law whatsoever for the further better more perfect and absolute assigning and assuring of the said premises for the residue of the said term then to come and expire to the said parties of the second part their Executors Administrators and Assigns as by the said parties of the second part their Executors Administrators or Assigns or his or their Counsel Learned in the Law shall be reasonably advised devised and required IN WITNESS whereof the parties aforesaid to these presents (being first duly stamped) their hands and seals have hereunto set the day and year first above written
