THIS INDENTURE made the 21st day of
July in the 17th year of the Reign of our Sovereign Lord
George the Third by the Grace of God of Great Britain
France and Ireland King Defender of the Faith and so
forth and in the year of Our Lord 1777 BETWEEN Joseph
Bennett of the Parish of Saint Kew in the County of
Cornwall Clerk of the one part and John Marshall of
Borough of Camelford in the said County Surgeon of the
other part WITNESSETH that the said Joseph Bennett for
and in consideration of the sum of £25 good and lawful
money of Great Britain in hand paid by the said John
Marshall at and before the sealing and delivery of these
presents (the receipt of which is hereby acknowledged)
HATH granted demised and leased and hereby doth grant
demise and lease unto the said John Marshall ALL that
messuage and tenement with all and singular its
appurtenances commonly called or known by the name of
the Horselings and the Wellpark being 2 fields and do
contain by estimation 2 acres and a half and are part or
parcel of the Manor of Trewassa situate lying and being
in the village and fields of Trewassa within the parish
of Davidstow in the County aforesaid and lately in the
possession of Charles Martin his undertenant or
undertenants EXCEPTING and always reserving out of this
present demise and grant unto the said Joseph Bennett
his Heirs and Assigns all timber trees and saplings and
trees likely to become timber now growing or hereafter
to grow in or upon the said premises or any part thereof
with free liberty of ingress egress and regress in and
through the said premises to fell root up cut down and
carry away the same and also free liberty to dig delve
and search for tin or any other metals and quarries and
tin or any other metals or stone there found to take and
dress and carry away and likewise excepting free warren
and all that to free warren belongeth and all Royalties
whatsoever TO HAVE AND TO HOLD and all and singular the
said premises with appurtenances (except before
excepted) unto the said John Marshall his Executors
Administrators and Assigns from the day of the date of
these presents for and during the full term of 99 years
thence next ensuing fully to be complete and ended
Elizabeth Marshall aged 8 years Christian Marshall aged
6 years and Sarah Marshall aged 4 years the daughters of
Nicholas Marshall of Tintagel Gentleman who is the
brother of the said John Marshall or any or either of
them shall so long happen to live HE the said John
Marshall his Executors Administrators and Assigns
YIELDING AND PAYING therefore yearly and every year
during the said Term unto the said Joseph Bennett his
Heirs and Assigns the rent or sum of 4/- of lawful money
of Great Britain clear of all deductions whatsoever at
the 4 most usual days of payment of rent in the year
that is to sayd Michaelmas Christmas Ladyday and
Midsummer by equal quarterly payments the first and
second payments whereof to be made4 at Michaelmas next
ensuing the date hereof and one capon at Michaelmas
yearly or one shilling for the same at the election of
him the said Joseph Bennett his Heirs and Assigns AND
ALSO yielding and paying nuto the said Joseph Bennett
his Heirs and Assigns by and upon the deaths of the said
John Marshall for himself his Executors Administrators
and Assigns DOTH covenant promise and agree to and with
the said Joseph Bennett his Heirs and Assigns that the
said John Marshall his Executors Administrators and
Assigns shall and will pay or cause to be paid unto the
said Joseph Bennett his Heirs and Assigns the said
yearly rent and other payments in manner and form
aforesaid AND shall and will repair uphold maintain and
keep all and singular the said premises hereby granted
with the appurtenances and each part thereof in and with
the necessary reparations during the said term and the
same at the end thereof so well and sufficiently
repaired and kept at his and their costs and charges
shall and will leave and yield up AND shall and will do
and perform suit and service to the Court and Courts of
him the said Joseph Bennetts Manor of TREWASSA and also
execute the office of Reeve as often as thereunto
elected and all other offices and services belonging to
the same Manor AND if it happen the said yearly rent or
other payments aforesaid or any part of them shall be
behind and unpaid after any of the days of payment
aforesaid THEN it shall and may be lawful to and for the
said Joseph Bennett his Heirs and Assigns into and upon
the said premises to enter and distain and the distress
herefound to sieze sell and dispose of according to Law
AND in default of sufficient distress to be found on the
said premises for satisfaction of the rent and other
payments with all costs and charges thereon OR if the
said John Marshall his Executors Administrators and
Assigns shall suffer the said premises or any part
thereof to be ruinous or in decay to the value of 10/-
the same shall commit permit suffer any act or thing
whatsoever prejudicial to the Title oe Estate of the
said Joseph Bennett his Heirs and Assigns and in the
said premises THEN for all any or either of the causes
aforesaid it shall and may be lawful for the said Joseph
Bennett his Heirs and Assigns into and upon the said
premises or any part thereof in the Name of the whole to
re-enter the same to have again repossess and enjoy as
in his or their former Estate notwithstanding anything
herein contained to the contrary AND the said Joseph
Bennett and his Heirs all and singular the said demised
premises with the appurtenances (except before excepted)
unto the said John Marshall his Executors Administrators
and Assigns under the yearly rent covenants conditions
and agreements before expressed against all persons
whatsoever lawfully claiming the same shall and will
warrant acquit and by these presents during the said
term hereby granted defend IN WITNESS whereof the
p[arties aforesaid have hereunto set their hands and
seals the day and year above said 1777
