THIS INDENTURE made the 18th day of February in the year of Our Lord 1815 BETWEEN Nicholas Spry of the Parish of Kenwyn in the County of Cornwall carpenter of the one part and William Clemow of the said Parish of Kenwyn Blacksmith of the other part WHEREAS by Indenture bearing date on or about the 21st day of February 1814 and made between Viscount Falmouth of the one part and the said Nicholas Spry of the other part for and for the considerations therein mentioned the said Viscount Falmouth in consideration of erecting and building of a Dwelling House as therein mentioned Did grant Demise Lease Set and to farm let unto the said Nicholas Spry All that his one part in three parts equally to be divided of and in the aforesaid Dwelling House to be erected and built and 12 acres of land to be enclosed in the said Parish of Kenwyn parcel of the Commons of the Manor of Allet Excepting therein excepted To hold to the said Nicholas Spry his Executors Administrators and Assigns for the term of 99 years if the said Nicholas Spry then aged about 55 years Eleanor his daughter then aged about eleven years and David son of William Spry of the Parish of Veryan in the said County Yeoman then aged about two years or any or either of them should so long happen to live under and subject to certain payments covenants conditions and agreements in the said Indenture reserved and contained AND WHEREAS the said Nicholas Spry hath contracted and agreed to assign and set over unto the said William Clemow the Plot of ground part of the same premises whereon a Blacksmiths Shop has been erected by the said William Clemow in consideration of the sum of £2 to him paid by the said William Clemow NOW THIS INDENTURE WITNESSETH that for and in consideration of the said sum of £2 to the said Nicholas Spry in hand paid by the said William Clemow at or immediately before the sealing and delivery of these presents the receipt whereof he doth hereby acknowledge and of and from the same and every part and parcel thereof doth acquit release and discharge the said William Clemow by these presents He the said Nicholas Spry HATH granted bargained sold assigned transferred and set over and by these presents DOTH grant bargain sell assign transfer and set over unto the said William Clemow ALL THAT the said piece or parcel of Ground whereon the said shop is so erected as aforesaid together with the same shop and the rights members and appurtenances thereunto belonging TO HAVE AND TO HOLD all and singular the same premises hereby assigned or mentioned or intended so to be with their respective appurtenances unto the said William Clemow his Executors Administrators and Assigns for all the residue or remainder of the said term of 99 years in and by the in part recited Indenture of Lease granted and which is now come and unexpired determinable as aforesaid but subject to the observance and performance of the Covenants and Agreements which as is the premises hereby assigned on the Tenants part are to be observed and performed save and except the Rents Dues and other payments reserved contained and made payable by the said Indenture of Lease AND ALSO subject and liable to all rates taxes and other assessments now imposed or hereafter to be imposed on the premises hereby assigned AND the said William Clemow doth hereby for himself his Executors Administrators and Assigns covenant promise and agree unto and with the said Nicholas Spry his Executors and Administrators that he the said William Clemow his Executors Administrators and Assigns shall and will at all times hereafter well and sufficiently save defend keep harmless and indemnified the said Nicholas Spry his Executors Administrators and Assigns of from and against all the payments covenants conditions and agreements in the said in part recited Indenture of Lease contained as far as respects the said Plot hereby assigned and the shop erected thereon as aforesaid and of and from all costs and charges damages and expenses whatsoever to be occasioned thereby or in consequence thereof IN WITNESS whereby the said parties to these presents have hereunto set their hands and seals the day and year first above written
