Know all Men by these presents that I JAMES JAY of the Parish of Morval
in the County of Cornwall Husbandman am held and firmly bound unto
ROBERT HICKS, ROBERT JORY, THOMAS MITCHELL and ANTHONY LEAN
Churchwardens and ROBERT HANCOCK Esqr. ROBERT GOOLE and CHARLES CONGDION
Overseers of the Poor of the Parish of Saint Germans in the said County
(in trust for the Parishioners of the said Parish) in the Sum of One
hundred Pounds of good and lawfull Money of Great Britain to be paid to
the said ROBERT HICKS, ROBERT JORY, THOMAS MITCHELL, ANTHONY LEAN,
ROBERT HANCOCK, ROBERT GOOLE and CHARLES CONGDION or their certain
Attorney their Executors Administrators or Assigns to which payment well
and truly to be made I bind myself my Heirs Executors and Administrators
firmly by these presents. Sealed with my Seal and dated the the twelfth
day of January in the Second year of the Reign of our Sovereign Lord
George the third by the grace of God of Great Britain France and Ireland
King defender of the faith and so forth and in the year of our Lord
Christ One Thousand Seven hundred and sixty two.
The Condition of the above written Obligation is such that Whereas
HESTER ANDREW of the parish of Saint Germans in the County of Cornwall
Singlewoman, hath in and by her Voluntary Examination taken in writing
and upon Oath before Edwd. ELIOT Esquire One of his Majesty’s Justices
of the Peace in and for the said County of Cornwall declared that she
was then with Child and that the said Child was likely to be born a
Bastard and to be chargeable to the said Parish of Saint Germans and
that the above named JAMES JAY was the father of the said Child. And
Whereas the said HESTER ANDREW on the Fourth day of January now last
past at Cutmeer in the Parish of Saint Germans in the County of Cornwall
was delivered of a Female Bastard Child with which she did charge the
said JAMES JAY with having gotten her with Child of the said Bastard
Child as in and by her Examination taken as aforesaid (?----) will fully
(?-----) (crease in paper). If therefore the said JAMES JAY his
Heirs Executors or Administrators do and shall from time to time and at
all times hereafter fully and Clearly Indemnify and save harmless as
well the above named Churchwardens and Overseers of the poor of the said
parish of Saint Germans and their Successors for the time being. as also
all and Singular the other Parishioners and Inhabitants of the said
Parish of Saint Germans which now are or hereafter shall be for the time
being of and from all manner of Costs, Taxes, Rates, Assessments and
Charges whatsoever, for or by reason of the Birth, Education and
Maintenance of the said Bastard Child, And of and from all Actions Suits
troubles and other Charges and demands whatsoever touching or concerning
the same That then this present Obligation to be void Otherwise to be
and remain in full power force and virtue.

STAMPED NINE PENCE QUIRE

Cornwall to wit. To all Constables, and other his Majesty’s Officers
of the Peace for the said County
WHEREAS HESTER ANDREW of the Parish of Saint Germans in the said County
single Woman, in her Examination taken this Day in Writing and upon
Oath, before me (one of His Majesty’s Justices of the Peace, in and for
the said County of Cornwall) hath voluntarily declared that she is with
Child, and that the said Child is likely to be Born a Bastard, and to be
Chargeable to the said parish of Saint Germans and the said HESTER
ANDREW hath in the said Examination, Charged JAMES JAY of the Parish of
Morval in this County Husbandman with having begotten the said Child on
her Body, with which she is now Pregnant: AND Whereas, CHARLES CONGDION
Overseer of the Poor, of the said Parish of Saint Germans hath made
Application unto me, for the immediate Apprehending the said JAMES JAY
to Answer to the Premises: THESE are therefore, in his Majesty’s Name,
to Authorize and require you, and every of you to Apprehend the said
JAMES JAY and to bring him before me, or some other of His Majesty’s
Justices of the Peace for this County of Cornwall that he may be
proceeded against as the Law directs. Given under my Hand and Seal, this
14th Day of November in the Year of our Lord One thousand seven hundred
and sixty one.
