The Will of John Samwell, dated 8 January 1638

In the name of God Amen the Eight Daie of January one thowsand six hundred thirtie Eight I John SAMWELL of Foye [Fowey] in the Countie of Cornewall gent Beinge sick in bodie but pfect of memory thankes be to God Doe make this my last will and testamt in manner and forme followinge First I comend my soule unto the Lord my maker and Redeemer and my bodie to Christian burial.
Item I give unto the poore of the Towne of Foye twentie shillings to be distributed at the discretion of my Executors.
Item I give unto Mary my wife two featherbedds pformed wth sheets and other necessaries.
Item I give unto Mary my wife the great silver guilt boule [bowl] and the tunne [vessel/cup/barrell] wch was given by her Mother.
Item I give unto John SAMWELL the sonne of my sonne William SAMWELL the some of one hundred pounds to be paid wthin one quarter of a yere after my death and to be then sett out by the discrecon and direction of Mr HARRIS Mr RASHLEIGH and Mr TREMAYNE for the most benefitt of the said John SAMWELL untill that he shall accomplish the age of one and twentie yeres.
Item I give unto my Daughter in lawe Anne SAMWELL one featherbedd and one bolster.
Item I give unto my servaunt John KELLOWE fower pounds.
Item I give unto my kinswoman Elizabeth WERRY fortie shillings.
Item I give unt John HARRIS Esqr, Jonathan RASHELEIGH Esquire and Edmond TREMAYNE Esquire Eight hundred poundes to be disposed by them as they in their discretions shall think meete to and for the use and behoofe of Mary my wife for and duringe the terme of her naturall life and to other uses intents and purposes as I have declared limitted and appointed under my hand and seale by Deed indented
bearinge the seaventh daie of this instant January and nowe remayninge in the custodie of the said Jonathan RASHELEIGH appeareth.
Item I doe further give unto Mary my said wife my Spruse Chest and all her apparrell and one Crock and one pann at the discretion of my Executors.
Item I give unto the said John SAMWELL my grandchilde fortie pounds to bee paid unto him after the death of Mary my wife out of the five hundred pounds wch wilbee then remayninge in the hands of my Executors, the residue of the said five hundred poundes and all other my goods and chattells I give and bequeath unto John SAMWELL my sonne
And lastlie I doe constitute and appoint the said John HARRIS Jonathan RASHELEIGH and Edmond TREMAINE to be my Executors of this my last will and testament. Further my intent and meaninge is that if my brother in lawe John GRILLS doe pforme the agreemts pmised on his parte, That then my Executors are intreated by this my Will to performe what was promised and agreed upon on my parte concerninge the provision of Anne GRILLS my Daughter.

The twentie third of January Anno Domini one thowsand six hundred thirtie Eight John SAMWELL gent in his pfect minde and memory havinge a full respect that his will and testament formlie made should stand in full power and effect addeth hereunto. Inpeis I doe give and bequeath to William SAMWELL my eldest sonne the some of five pounds to be paid him by my Executors.
Item I doe give and bequeath to Elizabeth ROSCARCKE my daughter the some of tenn pounds.
Item I do give to Anne GRILLIS my daughter the some of three pounds.
Item my Will is that whatsoever gnifts and legacies that have beene given by their grand=mother CHICHESTER unto my two Daughters formerlie named (1) five pounds to each of them that that moneys shall be paid them by my Executors, All whatsoever I have before this time done given and granted by my will and testament bearinge date the Eight daie of January Anno Domini one thowsand six hundred thirtie Eight shall stand in full power and strength.
This Coddicell to Mr SAMWELLs Will was sealed and acknowledged by Mr
SAMWELL the daie above written in the pr[esen]ce of Mary RASHLEIGH wife to Jonathan RASHLEIGH Esquire and Nicholas HATCH C..r ....

The Probate was written in Latin and was granted on the "vicesimo septimo die mensis May Anno Domini millimo sexcentesimo tricesimo nono" [27th May 1639]
