The Will of Joan Pomeroy, proved 20 February 1746

In the name of God Amen I Joan Pomeroy of Fowey in the County of Cornwall widow Relict and Administratrix with the Will Annexed of all and Singular the Goods and Chattells Rights and Creditts of my late deced Husband John Pomeroy late of Fowey aforesaid Gentleman deced being in perfect Health and of a Sound and Disposing Mind and Memory (thanks be Given to God therefore) but calling to mind the Uncertainty of this life do make this my last Will and Testament in Manner following hereby revokeing and making Void all former Wills and Testaments by me at any time hitherto made either by Word or in Writeing First and Principally I recommend my Soul into the hands of Almighty God who gave it me in Expectation of a happy Resurrection through my Blessed Saviour Jesus Christ and my Body O commit to the Earth to be decently Interred in the Chancole of Fowey aforesaid According to the Discretion of my Executor in Trust hereinafter named I give and Bequeath unto my dear and well beloved son Joseph Pomeroy the surety of Ten Pounds to Buy him a suite of Mourning in Remembrance of me to the said Joseph Pomeroy being handsomely provided for my sd Husband John Pomeroy and whereas Joseph Pomeroy of Camelford was in and by the Last Will and Testament of my said late decd Husband with me and Other Persons in the Will of the said John Pomeroy named, nominated a Trustee under my Husbands sd Will for his children who are now all under the age of Twenty One Years and I being willing to Advance the Fortune of my Children hereinafternamed I do hereby give devise and Bequeath all the Rest residue and Remainder of any Goods and Chattells unto my children John Pomeroy Edward Pomeroy Hannah Pomeroy Sarah Pomeroy and Elizabeth Pomeroy equally to be divided between them share and share alike but as my said Executors and my sd son Joseph are all under the Age of Twenty One Years and as my Brother Joseph Pomeroy of Camelford hath not hitherto Acted in the Trust reposed in him by my said Dec Husband for the preservation of my said Childrens Fortunes and that they may have Justice done them I nominate Constitute and Appoint my very good Friends Richard Treweeke of Fowey aforesd Merchant and John Wolcott of Fowey aforesaid Chirurgeon to be Trustees and Guardians over my said Children until they shall respectively Attain to the full age of Twenty One Years and I do hereby Give unto the said Richard Treweeke and John Wolcott the Care and Charge of my said Children and of their Effects to Manage to the last Advantage for the Benefitt of my said Children and I earnestly request the said Mr Treweeke and Mr Wolcott to Compele the said Joseph Pomeroy one of the Trustees named in my Husbands said Will to Account with and Pay the Balance to them for the Benefit of my said Children It is my Wiil if my said Trustees shall lose any thing by the Insolvency of any Debtors to me on my said Husband that they shall not be Accountable or Answerable for the same to my said Executors on any Account whatsoever Unless the same be Wilfully Occasioned by the Neglect of my said Executors in Trust the said Richard Treweeke and John Wolcott and they are but to be only Answerable for their own separate Acts and not for their Joynt Actions on proceedings under this Trust (that is one not for the Acts of proceedings of the Other) In Witness whereof I have hereunto Sett my hand and Seal and Published and Declared this to be my last Will and Testament the Twenty First day of May in the Year of our Lord one Thousand Seven Hundred and Forty

The beforewritten Will was proved in Common Forme the 20th Febry 1746 Before the Revd Mr Wm Waddon Clk Mr.of Arts official etc and Admion of the Goods etc of the decd and of all things concerning her Will was Granted to Sarah Pomeroy snr one of the Exects therein named (A power being reserved of Granting the like Admion to the others of the Exectrs named in this Will when they shall come of Age or think fit to take the same) being first sworne etc saveing etc M.J.
 
The beforewritten is a True Coppy of the last Will and Testament of the above named Joan Pomeroy
