Indenture involving Nicholas and Thomasin Leverton,
dated 6 June 1737
This Indenture made this Sixth day of June in the
Tenth year of the reign of our Sovereign Lord George the Second by the
grace of God of Great Britaine France and Ireland King Defender of the
Faith and so forth and in the year of our Lord 1737 Between Nicholas
LEVERTON of the parish of St Ervan in the County of Cornwall Yeoman the
son of Henry LEVERTON late of the same parish yeoman deceased of the one
part and Thomasin LEVERTON his Mother the widow of the said Henry
LEVERTON of the other part witnesseth that whereas the said Henry
LEVERTON made his last will and Testament in writing bearing date on or
about the Twentieth day of August in the year of our Lord One Thousand
Seven hundred and Thirty One and therein and thereby made the said
Thomasin LEVERTON and Nicholas LEVERTON Joint Exers. And whereas the
said Thomasin LEVERTON hath by her Deed bearing even date with those
presents ? sole assigned transferred and made over all her right title
interest Claim and demand of in unto and out all the Goods and Chattles
rights and Creditts of the said Henry LEVERTON and also of in unto and
out of all the Lands Tenements Howditaments and promises both in law and
Equily of the said Henry LEVERTON by vertue of the said will or
otherwise howsoever unto the said Nicholas LEVERTON his heirs Execrs.
Admrs. and assignes In consideration whereof the said Nicholas LEVERTON
Hath given and granted and in and by Those presente Doth give and grant
unto the said Thomasin LEVERTON One Annuity or yearly rent charge of
TwentyPounds of lawfull money of Great Britaine Tenn pounds a year part
of the said Sume of Twenty pounds a year to be issueing and payable out
of his the sd Nicholas LEVERTONs Lands of Inheritance seituate lyeing
and being in the village of Perrose in the said parish of St Ervan and
the other Tenn pounds a year the residue of the aforesaid Twenty pounds
a year to be issueing and payable out of all or any his the said
Nicholas LEVERTON s Chattles Estates (except one Tenement in the
aforesaid village of Perrose in the sd. Parish of St. Ervan which the
said Nicholas LEVERTON holdeth by vertue of a lease from The Right
Honourable the Earl of Radnor dated the Twenty nineth day of September
last) dureing the form of the naturall life of the said Thomasin
LEVERTON the said Annuity or yearly rent charge to be paid unto her the
said Thomasin LEVERTON by even and equall Quarterly payments during the
life of the said Thomasin LEVERTON (That is to say) on the Twenty nineth
day of September the Twenty fifth day of December The Twenty Fifth day
of March and the Twenty fourth day of June in every year during the
Continuance of the same the first payment thereof to be made on the
Twenty nineth day of September next ensueing the date hereof and so from
thence -forth to have Continuance and to be paid unto the said Thomasin
LEVERTON or her assignes at such times and in such manner and form as
aforesaid yearly during the Naturall life of the said Thomasin LEVERTON
and if it happen that the said Annuity or yearly rent Charge of Twenty
pounds be behind and unpaid by the space of Forty days next after any of
the days and times on which the same ought to be paid as aforesaid that
then and from thenceforth it shall and may be lawfull to and for the
said Thomasin LEVERTON or Assignes into and upon the Lands of
Inheritance in Perrose aforesaid to enter and distrein for Tenn pounds
part of the said Annuity or Rent charge of Twenty pounds a year and the
arrears thereof (if any be) and that it shall and may be likewise
lawfull to and for the said Thomasin LEVERTON or her assignes into or
upon all or any of the Chattle Estates of the said Nicholas LEVERTON
(except the before excepted chattels Estate in Perrose aforesaid) for
the Tenn pounds a year the remainder of the said sume of Twenty pounds a
year and the arrears thereof (if any be) to enter and distrein and
severall distresses or either of them lawfully and quietly to take lead
bear drive away and Impound and to hold detain and keep untill the said
Annuity or yearly rent charge of Twenty pounds a year together with the
arrears thereof (if any be) and the costs and charges in that behalf
such and be fully satisfyed and paid and if everysuch distress and
distresses to be taken as aforesaid shall not from hime ? so after as
any such shall be taken be redeemed from the said Thomasin LEVERTON or
her assignes with the space of One month next after the takeing thereof
That then it shall and may be lawfull to and for the said Thomasin
LEVERTON or her assignes to make sale of all and every such distress and
distresses aforesaid and thereof to have levy and enjoy the arrears of
such Annuity or yearly rent Charge of Twenty pounds a year without the
hindrance or Molestation of the said Nicholas LEVERTON or any other
person or persons whatsoever And lastly it is hereby further agreed by
and between the said Nicholas LEVERTON and the said Thomasin LEVERTON
that she the said Thomasin LEVERTON is to have during her naturall life
the use of the Parlour in the house of the said Nicholas LEVERTON on his
Estate of Erevingwiner? in the said parish of St Ervan and also of a Bed
furnished and likewise the use of such other of the said Nicholas
LEVERTONs household goods as she shall have occation for during her the
said Thomasin LEVERTONs naturall life In witness whereof the said
Nicholas LEVERTON have hereunto set his hand and Seale the day and year
first above written
