THIS INDENTURE made the 6th day of January in the Year of Our Lord 1849 BETWEEN THE REVEREND GEORGE POOLE NORRIS of Roscraddock House within the Parish of Saint Cleer in the County of Cornwall Clerk of the first part FRANCIS GLANVILLE of Derriford in the County of Devon Esquire of the second part ANNABEL GLANVILLE the wife of the said Francis Glanville of the third part WILLIAM GRAY of the Parish of Endellion in the said County of Cornwall Yeoman of the fourth part and MARK GUY of the same Parish Yeoman of the fifth part WHEREAS the said Francis Glanville is seized to him and his Heirs in Fee Simple of in and to the Closes or Plots of Land and Hereditaments hereinafter described and intended to be hereby granted and conveyed subject to 2 annuities or yearly rents of £600 and £400 limited and settled upon and in favour of the said Annabel Glanville for life inn case she should survive the said Francis Glanville her said husband by certain Indentures of Lease and Release bearing date respectively on or about the 5th or 6th days of March 1821 the Release being made between Francis Glanville Esquire deceased of the first part the said Francis Glanville (party hereto) of the second part The Right Honourable Reginald Pole Carew and the said Annabel Glanville (by her then description of Annabel Pole Carew spinster) of the third part The Right Honourable Charles Yorke and Gordon William Francis Booker of the fourth part and Sir William Templer Pole Baronet and Francis Scawn Blunt esquire of the fifth part being the settlement made in contemplation of the Marriage bearing date then intended and afterwards solemnized between the said Francis Glanville (party hereto) and the said Annabel his wife AND WHEREAS by Indenture of Release by way of Mortgage bearing date on or about the 24th day of June 1847 and made between the said Francis Glanville (party hereto) by the said George Poole Norris of the other part in consideration of the sum of £1400 paid to the said Francis Glanville (party hereto) by the said George Poole Norris (inter alia) the said Closes or Plots of Land and Hereditaments hereinafter described and intended to be hereby granted and released were conveyed and assured unto and to the use of the said George Poole Norris his Heirs and Assigns for ever subject to the said Annuities and also subject to a proviso for redemption on payment by the said Francis Glanville his Executors Administrators and Assigns to the said George Poole Norris his Executors Administrators and Assigns of the sum of £1400 and Interest at the time and in manner therein mentioned and which said sum is still due and owing AND WHEREAS the said Francis Glanville (party hereto) has contracted with the said William Gray for the absolute sale to him of the said Close or Plots of Land and Hereditaments hereinafter mentioned and described for the price of £26 and which it is agreed shall be paid to the said Francis Glanville (party hereto) AND WHEREAS the said Annabel the wife of the said Francis Glanville (party hereto) has consented and agreed to concur in these presents for the purpose of releasing and discharging the said Hereditaments from the said Mortgage Debt and the interest thereof NOW THIS INDENTURE WITNESSETH that in pursuance of the said Agreement and in consideration of the sum of £26 of Lawful British Money to the said Francis Glanville (party hereto) in hand well and truly paid by the said William Gray at or immediately before the execution of these presents the receipt whereof he the said Francis Glanville (party hereto) doth hereby acknowledge and thereof and there from doth acquit release and for ever discharge the said William Gray his his Executors Administrators and Assigns AND ALSO in consideration of the further sum of 10/- of like Lawful money at the same time paid by the said William Gray to the said George Poole Norris Francis Glanville (party hereto) and the said Annabel his wife the receipt whereof is hereby also acknowledged HE the said George Poole Norris at the request and by the direction of the said Francis Glanville (party hereto) testified by his being such party hereto and executing these presents DOTH by these presents grant release convey and assure and the said Francis Glanville (party hereto) DOTH by these presents grant release convey and assure ratify and confirm AND the said Annabel Glanville the wife of the said Francis Glanville (party hereto) for the purpose of releasing all her claim and Interest of in and to the said Hereditaments in respect of the said 2 hereinbefore mentioned Annuities so limited to arise out of the said Premises (inter alia) as aforesaid DOTH by these presents (which are intended to be duly acknowledged by her the said Annabel Glanville according to the Statute in trial case made and provided for passing Estates of married women ) remise release and forever quit claim unto the said William Gray and his Heirs ALL THOSE 2 Closes or Plots of Land called SNIPE PARK and PLOT containing by Admeasurement 1 Rood and 33 Perches situate at Trelights within the Parish of Endellion in the said County of Cornwall now in the occupation of the said William Gray and unencumbered and described on the Tithe Apportionment and Map of the said Parish as 331 and 333 TOGETHER with all Houses Buildings and Lands Meadows Ways Paths Passages Waters Watercourses Easements Profits Advantages Rights Members and Appurtenances whatsoever to the said Closes or Plots of Land and Hereditaments belonging or appertaining or therewith now or at any time heretofore held used occupied or conveyed AND the Reversion and Reversions Remainder and Remainders yearly and all other rents issues and profits thereof AND all Estate Right Title Interest use trust property possession claim and demand whatsoever both at Law and Equity of them the said George Poole Norris Francis Glanville (party hereto) and Annabel his wife of in or out of the same TO HAVE AND TO HOLD the said Closes or Plots of Land and Hereditaments and all and singular other and all and singular other premises hereinbefore described and hereby granted and conveyed and assured or mentioned and intended so to be with the appurtenances (freed and absolutely discharged of and for the said Annuities and also of and from the said Mortgage Debt and all Interest due and to accrue due for the same (unto the said William Gray and his Heirs to the uses upon the Trusts and for the ends intents and purposes hereinafter declared (that is to say) To such uses upon such trusts and for the ends intents and purposes as the said William Gray shall from time to time or at any time be by ant Deed or Deeds appoint and in default of and until such appointment and subject thereto to the uses of the said William Gray and his Assigns during the Term of his Natural Life and of and in Trust for the said William Gray and his Assigns and after the determination of the said hereinbefore lastly limited Estate To the use of the said William Gray his Heirs and Assigns forever AND the said William Gray doth hereby declare that no widow of him the said William Gray shall be entitled to Dower out of or in the said Hereditaments AND the said Francis Glanville (party hereto) for himself his Executors Administrators and Assigns and for the right Title quiet enjoyment free from incumbrances and further Assurance of in and to the said Hereditaments and Premises with the Appurtenances against him the said Francis Glanville (party hereto) and his Heirs and all persons claiming or to claim under or in Trust for him or them AND LASTLY that he the said Francis Glanville (party hereto) his Heirs and Assigns shall and will at all times hereafter at the request and at the costs of the said William Gray his Heirs Appointees or Assigns unless hindered or prevented by fire or other inevitable accident produce or cause to be produced to the said William Gray his Heirs Appointees and Assigns or to his Counsel or Agent or at or before any Court or Courts of Law or Equity in England or before any Commission for the examination of witnesses and also owe and deliver and permit to be examined any attested Copies of certain Indentures of Lease and Release bearing date the 29th and 30th days of April 1818 made between the said Francis Glanville deceased of the first part the said Francis Glanville (party hereto) of the second part Thomas Francis Jennings the Younger of Carey Street Lincolns Inn Fields in the County of Middlesex Gentleman of the third part and Richard Birch of Southampton Steer Bloomsbury Square in the said County of Middlesex Gentleman of the fourth part and in Exemplication of the recovery suffered in pursuance thereof as of Easter Term 58th of George the Third AND ALSO the hereinbefore referred to and recited Indentures of Lease and Release of the 5th and 6th days of March 1821 and the 24th day of June 1847 IN WITNESS whereof the parties aforesaid to these presents their hands and seals have set the day and year first above written
