THIS INDENTURE made the day of in the
year of Our Lord 1820 BETWEEN THOMAS BULLER of the
parish of Saint Minver in the County of Cornwall
Cordwainer of the one part and WILLIAM BULLER of the
Parish of Endellion in the said County of Cornwall
Cordwainer of the other part WHEREAS by indenture of
lease bearing date the 3rd day of October 1804 and made
between John Cock Esquire of the one part and Thomas
Buller (since deceased) of the other part FOR the
consideration therein mentioned the said John Cock DID
demise the lease unto the said Thomas Buller ALL THAT
dwellinghouse and garden commonly called or known by the
name of BULLERS HOUSE situate laying and being in the
village of TREVITHICK in the said Parish of Endellion
and then in the occupation of John Buller AND ALSO all
that one LITTLE MEADOW adjoining to the said
dwellinghouse and garden and then in the occupation of
James Hill AND ALSO All that piece of ground called or
commonly known by the name of LITTLE PENNY then also in
the occupation of the said James Hill containing about
20 yards of Lane (be the same more or less)and adjoining
to Mr Grays Prebend in the said Parish of Endellion
TOGETHER with the appurtenances (except as therein is
excepted) TO HOLD the said premises unto the said Thomas
Buller his executors administrators and assigns from the
29th day of September then last past for the term of 99
years IF William Buller (party hereto) Phillippa Mably
and Humphrey Mably or any or either of them should so
long happen to live AT AND UNDER the yearly rent of 5/-
and 5/- for an Heriot on the death of each life and
SUBJECT to the covenants therein contained AND WHEREAS
the said Thomas Buller departed this life in the year of
Our Lord 1814 intestate and Letters of Administration
were soon after his death granted by the Archdeaconry
Court of Cornwall unto Thomas Buller (party hereto) his
nephew and upon a distribution of the estate and effects
of the said Thomas Buller deceased one quarter part of
the said recited lease and leasehold premises came to
the said Thomas Buller as his share therein as one of
the next of kin of the said Thomas Buller for the
purchase of the said undivided quarter part of and in
the said leasehold premises at or for the price or sum
of £15 NOW THIS INDENTURE WITNESSETH that in
consideration of the sum of FIFTEEN POUNDS of lawful
money of Great Britain current in England by the said
William Buller to the said Thomas Buller in hand now
paid the receipt whereof is hereby acknowledged HE the
said Thomas Buller HATH granted bargained sold assigned
transferred and set over and by these presents DOTH
grant bargain sell assign transfer and set over unto the
said William Buller his executors administrators and
assigns ALL AND SINGULAR the said undivided quarter part
of and in ALL that the aforesaid dwellinghouse garden
meadow and Little piece of ground and of and in all and
singular other the premises mentioned in the said
recited indenture of lease as the same are now in the
occupation of the said William Buller TOGETHER with all
ways paths passages waters watercourses commons profits
and appurtenances to the same premises belonging and
also all the estate right title interest term and terms
of years property claim and demand whatsoever both at
law and equity (except as in the said recited indenture
of lease thereof excepted) TO HAVE AND TO HOLD the said
undivided quarter part of and in all the said
dwellinghouse garden piece of land and premises with the
appurtenances (except before excepted) hereby assigned
or intended so to be unto the said William Buller his
executors administrators and assigns from the day of the
date hereof for and during all the residue and remainder
of the said term of 99 years (determinable as aforesaid)
in as full large ample and beneficial manner and form as
he the said Thomas Buller might or could have held and
enjoyed the same in ease there presents had not been
made AT AND UNDER the payment of a quarter part of the
yearly rent payable for the same and a due proportion of
the Heriots AND SUBJECT to the covenants and agreements
in the said recited indenture of lease contained on the
Lessess part to be paid observed performed and kept AND
THE SAID Thomas Buller doth hereby for himself his
executors and administrators covenant promise and agree
to and with the said William Buller his executors
administrators and assigns that the said herein before
in part recited indenture of lease is at the time of the
sealing and delivery thereof good valid and effectual in
the law and in no wise surrendered forfeited or become
void or voidable AND ALSO that he the said Thomas Buller
now hath in himself good right full power and lawful and
absolute and authority to bargain sell and assign the
said individual quarter part of and in the said
dwellinghouse garden piece of land and premises with the
appurtenances in manner aforesaid according to the true
intent and meaning of these presents AND FURTHER that he
the said William Buller his executors administrators and
assigns shall and may from time to time and at all times
during the remainder of the said term (determinable as
aforesaid) peaceably and quietly have hold occupy and
enjoy the said premises with the appurtenances hereby
assigned or intended so to be as aforesaid and to have
receive and take the rents issues and profits thereof to
his and their own use and benefit without any
interruption whatsoever of from or by the said Thomas
Buller his executors or administrators or any other
person or persons claiming or to claim by from or under
him or them or the said Thomas Buller deceased freed and
absolutely discharged of and from all manner of
incumbrances whatsoever (save and except as appears by
these presents) SUBJECT only to the covenants contained
in the said recited indenture of lease on the Lessess
part to be performed AND MOREOVER that the said Thomas
Buller his executors and administrators shall and will
from time to time and at all times hereafter during the
continuance of the said term (determinable as aforesaid)
at the request costs and charges of him the said William
Buller his executors administrators and assigns make do
and execute or cause and procure to be made done and
executed all and every such further and other lawful and
reasonable acts deeds conveyances assignments and
assurances in the law whatsoever for the further better
and more perfectly and absolutely assigning the said
premises unto the said William Buller his executors
administrators and assigns for all the then residue of
the said term of 99 years (determinable as aforesaid) IN
WITNESS whereof the said parties to these presents have
hereunto set their hands and seals the day and year
first above written
