THIS INDENTURE made the 28th day of
August in the fifty sixth year of the reign of Our
Sovereign Lord George the Third by the grace of God of
the United Kingdom of Great Britain and Ireland King
Defender of the Faith and in the year of Our Lord 1816
BETWEEN SAMUEL ABBOTT of Sladesbridge in the Parish of
Egloshayle in the County of Cornwall Merchant of the one
part and WILLIAM BULLER of the Parish of Endellion in
the said County of Cornwall Cordwainer of the other part
WHEREAS by indenture of lease bearing the date the 3rd
day of October 1804 and made or mentioned to be made
between John Cock of Port Isaac in the Parish of
Endellion in the County of Cornwall Esquire of the one
part and Thomas Buller of the said parish of Endellion
yeoman of the other part FOR the considerations therein
mentioned the said John Cock did demise and lease unto
the said William Butler ALL that dwellinghouse and
garden called or commonly known by the name of Bullers
House situate lying and being in the village of
Trevithick within the said Parish of Endellion and then
in the occupation of John Buller AND ALSO that one
little meadow adjoining to the said dwellinghouse and
garden and then in the occupation of James Hill AND ALSO
all that one piece of ground called or commonly known by
the name of LITTLE PENNY then also in the occupation of
the said James Hill containing about 25 yards of Land
(be the same more or less) and adjoining to Mr Grays
prebend within the said parish of Endellion TOGETHER
with all ways paths passages easements profits
commodities advantages and appurtenances whatsoever
belonging to the said premises thereby demised and every
part thereof EXCEPT as therein is excepted TO HOLD the
said premises (except as before excepted) unto the said
Thomas Buller his executors administrators and assigns
from the 29th day of September then last past for and
during and unto the full end and term of 99 years from
thence next ensuing and fully to be complete and ended
if William Buller (party hereto) son of the said John
Buller then aged 22 years Phillippa Mably then aged 14
years and Humphrey Mably then aged 11 years son and
daughter of Henry Mably of Endellion yeoman or either of
them should so long happen to live ALL and under the
yearly rent if 5/- for an Heriot death of each life and
subject to the covenants therein contained AND WHEREAS
the said Thomas Buller departed this life in the year
1814 intestate and letters of Administrations soon after
his death were soon after his death were granted by the
Archdeaconry Court of Cornwall unto Thomas Buller his
nephew and next of kin and upon a distribution of the
estate and effects of the said Thomas Buller deceased
one quarter part of the said recited lease and leasehold
premises came to the said Henry Mably of Trefeock in the
said Parish of Endellion as his share therein as the
husband of the sister and one of the next of kin of the
said Thomas Buller deceased AND WHEREAS the said Henry
Mably by indenture of assignment bearing date the 20th
day of January last past assigned and made unto the said
Samuel Abbott amongst all and every other his goods and
chattels ALL his estate and interest of and in the said
term in trust for all and every the creditors of the
said Henry Mably as therein mentioned and expressed AND
WHEREAS the said William Buller hath contracted and
agreed to and with the said Samuel Abbott for the fund
raise of the said undivided quarter part of and in the
said leaseheld premises at or for the price or sum of
£13 13/- NOW THIS INDENTURE WITNESSETH that for and in
consideration of the sum of THIRTEEN POUNDS AND THIRTEEN
SHILLINGS of lawful money of the United Kingdom
aforesaid current in England by the said William Buller
to the said Samuel Abbott in hand well and truly paid at
or before the sealing and delivery hereof the receipt
whereof is hereby acknowledged HE the said Samuel Abbott
HATH granted bargained sold assigned transferred and set
over unto the said William Buller his executors
administrators and assigns ALL and singular the said
undivided quarter part of and in that the aforesaid
dwellinghouse garden meadow little piece of ground and
of and in all and singular other the premises comprised
and mentioned in the said recited indenture of lease as
the same are now in the occupation of the said William
Buller together with all ways paths passages waters
watercourses commodities profits and appurtenances to
the same premises belonging and also all the estate
right title interest and term and terms of years
perfectly claim and demand whatsoever both at law and
equity (except as in the said recited indenture of lease
thereof is excepted) TO HAVE AND TO HOLD the said
undivided quarter part of and in all the said
dwellinghouse garden piece of land and premises with the
appurtenances (except before excepted) hereby assigned
or intended so to be unto the said William Buller his
executors administrators and assigns from the day of the
date hereof for and during all the rest residue and
remainder of the said term of 99 years (determinable as
aforesaid) in as full large ample and beneficial manner
and form as he the said Samuel Abbott might or could
have held and enjoyed the same if these presents had not
been made at and under a quarter part of the yearly rent
payable for the same and a due proposition of the
agreements in the said recited indenture of lease
contained on the Lessees part to be paid observed
performed and kept AND THE SAID Samuel Abbott doth
hereby for himself his heirs executors and
administrators covenant promise and agree to and with
the said William Buller his executors administrators and
assigns in manner following (that is toi say) that he
the said Samuel Abbott hath not at any time heretofore
made done committed or executed or willingly or
knowingly suffered any act matter or thing whatsoever
whereby or werewith or by reason or means whereof the
said undivided quarter part of the said premises hereby
assigned or intended so be are is can shall or may be
anywise impeached charged affected or incumbered in
title charge estate or otherwise howsoever IN WITNESS
whereof the said parties to these presents (being duly
stamped) their hands and saels have set the day and year
first above written
