Will of Edward Hoblyn, dated 1 November 1653
IN THE NAME OF GOD AMEN I Edward
Hoblin of (Nanswhyden) in the parish of
Collumb Maior and County
of Cornwall Esquire Considering with my selfe the uncertainty of my
life and being Aged and sickly doe in the time of my perfect memory
which God of his mercy hath continued? unto me make this my last
will and Testament for the disposing of my Estate which God of his
goodnesse hath bestowed on mee for the provision of my family and
the settling of peace and unity amongst them which I doe enioyne them
to embrase firmely when it shall please God to Call for mee out of this
mortall life First I commend my soule into the hands of Allmighty God
my heavenly father beseaching him for his sonn Jesus Christs sake
my onely saviour and redeemer to receive it in everlasting habitacon
in the kingdom of heaven whensoever it shall please him to call for
it out of this mortall body which I commend to a decent Christian
buryall in full assurance of a ioyfull Resurrection when it shallbee
againe
unitted to my soule at the last day Item I give and bequeath unto my
well beloved wife Mary Hoblyn all that meadow and
Garden in
Trevalscus in the parish of Saint Goran with the appurtenances
which I heretofore purchased of Nathaniell Trevanion
Esquire to have
and to hold unto the said Mary for terme of hir life
and all that
one field of Land called Greedlecrege? als Trewworack field in the
parish of St. Tue to have and to hold to the said Mary
for terme of hir
life if the respective Estates I have therein or any of them so longe
continue And I also give unto hir the Guilt Tankard which was her
Granfathers the little China Cupp sett with silver and the two silver
warming cipps she useth and my desire that shee doe live with our
Sonne at Nunswhiden and pay him for the Dyett of her selfe and such
servants she shall think fitt to have but if she shall iudge it more
Convenient for her to dwell else where then my will is that dureing
hir life she shall have the use and occupation of my howsehold goods
and plowstuffe at trevalscus and one other bed furnished with
bolsters pillowes Coverledds and blanketts with one paire of Curtaines
one dozen and halfe of pewter one Flaggon all to be Chosen by hir and
of all the brasen vessells which were brought from Barnestaple All
which Goods shall remaine for my Executor after hir death And lastly
I doe ernestly desire my said wife she permitt the inheritance of hir
owne Land in the County of Devon to descend unto our eldest sonn without
manifest disobedience in him which I hope God will direct him to
avoyd and that she doe not revoke the deeds made to our younger
Sonns whereby wee have charged parte of the said Lands with five
hundred pounds to our Sonns Edward and Richard
or shall
hereafter make for the preferment of any of our Children by leasing
any parte of it except it bee for the better raysing of the portions
according
to our mentions Item I give and bequeath unto my daughter Emlyn
Hoblin
the Sume of five hundred pounds to be paid in manner following one
hundred pounds in six months One hundred pounds at the End of
One yeare and two hundred pounds at the end of two yeares after
my death And one hundred pounds at the end of One yeare next
after mine and my wifes death And my will is that she shall have
dyett with my Executor or five pounds in liew thereof and five
pounds more (for) other accomodation until the first hundred
pounds bee paid as is above limitted Item I give and bequeath
unto my Sonns Thomas Hoblin Edward Hoblin tenn pounds
apeece as a token of my love to them haveing otherwaise pvided
for them by severall deeds Item I give unto my daughter in law
Grace the wife of my son Robert and
Grace the wife of my sonne
Thomas and to my sonnes in law Francis Burges
and William
Williams twenty shillings appeece to be bestowed in Rings as a
Remembrance of my love to them Item I give unto my daughter Ann
Burges forty shillings and to her six children Tenn pounds
apeece to (be)
paid them by tenn pounds at the end of every yeare after my death paid
to
the eldest tenn pounds the first yeare and so to all the rest
respectively as theire
age is tenn pounds yearely untill the whole bee paid and my will is that
theire
father if then living give discharge to my Executor for these Legacies
when they shalbee paid and that hee with the advice of my Executor
employ it
for his childrens benefitt respectively as it bee paid Item I give unto
my
grandchildren Judeth and Richard Hoblin
children of my Sonn Robert tenn pounds
apeece and to Robert Hoblin Sonn of my sonne
Thomas tenn pounds which
my will is shalbee paid within twelve months of my death and to bee
employed
by theire father for theire best advantage of them respectively and to
my
Grandchild Edward Hoblyn my ould silver Salt which was
my great
Grandfathers Item I give unto Mary and Ann
the daughters of my daughter
Mary Williams deceased the sume of fifty pounds to bee
equally divided
between them if they live to be maryed or accomplish the Age of one and
twenty yeares respectively which shall first happen and not otherwise
and
if one of them dye before that time then the whole fifty pounds shalbe
paid to the Survivor when she shall accomplish the Age of one and twenty
yeares or be marryed and if both dye before this Legacie grow due then
this legacie shall cease and my Executor shall have the same Item I
give all my goods and chattles not formerly given unto Robert
Hoblin my
eldest Sonn and heere and him I make my Sole Executor charging and
requiring him as he hopeth for a blessing from God uppon his Estate that
hee pay all my honest debts and legacies hereby given and that whereas I
have made certaine Deeds with Conditionall Grant to his brothers for
Security
of portions to them that he either at his hand pay the portions allotted
to
them in such manner as I have by these Deeds expressed or quiettly to
permitt them to enjoy such Lands and Tennements respectively as I have
or
shall hereafter dureing my life alone or ioyntly with my wife granted or
grant unto any of them and that if there bee any failure in the
assurance
in poynte of Law that he confirme it, if he intend not to performe the
Condicions which on his parte are to bee done but I rather advise him to
pay
the money payable by the Condicions and to take into his hands all the
Estates
so granted unto them which was my intent when these grants were made
being otherwise unable competently to provide for them haveing freely
heretofore given him his wifes portion and settled on him the many part
of my Estate neither doe I doubt of his readine? to performe my will but
if my said eldest Sonne shall refuse to bee my Executor or happen to dye
before
me or soone after me death that he doe not prove my will xxx xxx the
Executorshipp on him that my said will may bee by him performed then I
give
all my goods not bequeathed unto Thomas Hoblyn my
second Sonne and him
I make my Sole Executor and if he shall also dye and refuse to performe
my will then I make Edward Hoblin my third Sonne my
Executor and if (he)
shall also dye or refuse the same as is above expressed then I make
Richard Hoblyn my youngest Sonne my Executor but I
trust in the Lord
he will continue my eldest Sonne in life and health to performe the said
office of Executorshipp (placed?) on him by this my will And if any
difference
shall arise between my wife and children or any of them respectively by
either
Concerning this my will or the grants I have made or shall make as above
said either by my selfe or ioyntly with my wife or by me on hir
Surviving or
for any other casse or casses of Debate whatsoever that may arise
betwext
them or any of them I doe hereby desire my welbeloved friends my brother
in law Hugh Trevanion of Trelugen my Cosen Mr
Thomas Hoblyn
of Penhale and my brother Mr Thomas Hoblyn of Trewhela
to whom to?
whome? I desire my sonnes in law Francis Burgis and
William Williams Gent to
bee assistant that they for the love I am assured they beare me and my
family
endeavour a speedie reconciliacon and I require my wife and Children by
the dutie
they owed mee and for the love I have ever showed to them that they
submitt
to the Arbitrement and ward? made by them without Grudginge In wittnesse
whereof I have to this my last will and Testament (revoking and
disanulling all
former will by mee made) sett my hand and Seale the first day of
November
in the yeare of our Lord One thousand six hundred fifty and three
(No:1st. 1653)

THIS WILL was proved at London the tenth day of July One thousand
six hundred fifty six before the Judges for probate of wills and
granting
Administrations lawfully authorised by the oath of Robert Hoblyn
the sonne
of the said deceased and sole Executor named in the said will to whome
Administration of all and singular the goods chattles and debts of the
said
deceased was Committed he being by Commission first sworne truly to
Administer the same./.
