Will of Walter Harris, dated 28 March 1747

IN THE NAME OF GOD AMEN I Walter Harris of Halloone within the parish of St Collumbe Major In the County of Cornwall Gent being weak in body but of a sound and disposeing perfect mind and memory(Praised be God for the same) and Consideringthe frailty and uncertainty of this Present Life and the Sure and Sometimes very sudden approach of Death in order to prevent any Controversies or Contentions that may happen to Arise after my Decease Do make and declare this to be my last will and Testament in manner and forme following Revokeing hereby all former Wills by me made.
IMPTS I Give and Bequeath my Soul ito the Hands of Almighty God who Gave it me Whenever it shall Please him to Call me out of this present Life, Earnestly intreating that for the Sake of my Dear Redeemer he Wo.d Graciously pardon my Sins hopeing in and by the ritts and passion of Jesus Christ my Saviour to Inherit Eternal Life, and Receive me to himself in Glory. And my Body I Committ to the Earth to be Decently Buried at the Discretion of my Executor hereafter named.
Item I Give and Bequeath unto my Dear and Loveing wife Elizabeth Harris the one Third part of the Land of Inheritance of Killawrgy, to her and her heiresfor ever(which was late in the possession of William Williams Gent Decd.) after the Death of Richard Hicks of Plimouth and James Williams son of the said William Williams Decd.now the only Two Lives on the said Premisses.

Item I Likewise Give and Devise unto my Dear and Loveing wife the Land of Inheritance of Halloone during her natural Life and after her Decease unto John Harris son of John Harris Late of Killaworgywith all its Rights and profits thereunto Belonging.
Item I also Give and Bequeath unto the said John Harris(my nephew) the one Third part of the Fee or Inheritance of Carworgy in paying unto Walter Harris (the sum of Six pounds a year) Brother of the said John Harris after the Decease of my Wife Elizabeth Harris Dureing his Natural Life out of the said Lands
Item It is Farther my Will and order that in the Case the before named John Harris Shall pay unto the said Elizabeth Harris The Sum of Thirty Pounds a year Clear of all outgoings That Then the Before named Elizabeth Harris Shall Give up her Right and Claime to the Before mentioned Land of Halloone – And in Default of payment of the sum of the said Thirty Pounds (Clear yearly) it shall end may be Lawfull to and for the said Elizabeth Harris to Re enter , Come into and be Possessed of Halloone as aforesaid, wth. Th Rights and profits thereof.
Item It is also my Will and Order that after the Death of the Above named John Harris, that the before mentioned Lands of Halloone and Carworgy Shall Go unto Walter Harris the son of the said John Harris And in default of Issue in the said Walter _ the before mentioned Lands And premises with all its appurtences there unto Belonging _ Shall go unto and be in the Right of Walter Harris my Nephew (Brother to the before named John Harris) to him and his heirs forever.
Item I Give and Bequeath unto John Harris (son of Samuel Harris) Higher Halloone for a number of years determinable on the Death of Three Lives, after the Decease of John Issabell For his long and faithfull Services done to me in Consideration whereof I Give him Higher Halloone as aforesaid (which was formerly in the possession of Thomas Issabel decd.)
Item I Give unto my Brother in Law Philip Harris one shilling.
Item I Give unto my Brother in Law Samuel HarrisTwenty Shillings a year to be paid yearly by my Executor Dureing his Natural Life after the death of my Wife Elizabeth.
Item I Give unto Grace Harris Daughter of the Before named Samuell Harris . Henry Oxnam senior the Sum of One Guinea to be paid at the End of one year after my Decease by my Executor hereafter named.
Item I Give unto Henry Oxnam Senr. The Sum of one Shilling.
Item I Give unto Charles Treslain (if demanded) one Shilling.

Item I Give unto my Dear and Loving wife all my (Silver) Plate and Rings.
Item It is farther my Will and Order that my said wife Elizabeth Harris shall have ppart of the House of Halloone for a Dwelling with Bedding and other Convenient Household necessaries together with a Horse at her Command to Carry her to Church when where and as often en need shall Be or Require.
Item It is further my Will and order that the one third part of- Carworgy before mentioned shall be obliged together with Halloone to Pay the said Elizabeth Harris the sum of the Before mentioned Thirty Pounds a year for the Better and more Sure payment thereof and within the space of Six months the afores.d Rent be behind and unpaid being Lawfully demanded That then it shall and may be Lawfull To and for the said Elizabeth Harris to Re enter and take into her possession such Cattle and Coine as shall Then be upon the Before mentioned Halloone and Carworgy.
Item All the Rest of my Estate Goods and Chattels, Household stuff and Husbandry Implements I Give and Bequeath unto the Beforenamed John Harris (my Nephew) whom I make and ordaine my whole and Sole Executor of this my last Will and Testament. IN WITNESS whereof I have hereunto Sett my Hand and Seal this Twenty Eighth day of March Anno Domini 1747.

  The Before written is a true Copy Examined and compared with the Original this 6th March 1747.

  The before written Will of the before named Walter Harris decd. Was proved in Common Form the Fourth day of March 1747 and Admion of all and Singular the Goods ard of the said decd. And of all things howsoever concerning the said Will was granted to the Executor therein named (being first sworn)
