THIS INDENTURE made the second day of April One thousand eight hundred and ninety eight BETWEEN GEORGE APPLEBY JENKINS of Penryn in the County of Cornwall Official Receiver in Bankruptcy for the Truro District of the one part and THOMAS HICKS of the Parish of St Columb Major in thee(sic) aforesaid County Yeoman of the other part

WHEREAS by an Indenture dated on or about the Twenty third day of February One thousand eight hundred and eighty eight and made between James Parkyn of the one part and the said Thomas Hicks of the other part in consideration of the sum of Six hundred and fifty Pounds then lent and paid by the said Thomas Hicks to the said James Parkyn all the hereditaments hereinafter described and intended to be hereby conveyed were by the said James Parkyn conveyed unto and to the use of the said Thomas Hicks in fee simple but by way of Mortgage only and accordingly subject to the proviso for the redemption of the said premises and the Re-Conveyance thereof unto the said James Parkyn on payment of the sum of Six hundred and fifty Pounds and interest therein at the rate of Four Pounds per centum per annum on the day therein mentioned and long since passed

AND WHEREAS on or about the nineteenth day of December One thousand eight hundred and ninety four the said Thomas Hicks lent to the said James Parkyn on his promissory note of that date the further sum of Eighty Pounds at interest at the rate of Four Pounds per centum per annum and it was agreed that the hereditaments comprised in the hereinbefore recited Indenture of the Twenty third of February One thousand eight hundred and eighty eight should be held by the said Thomas Hicks for securing the said sum of Eighty Pounds and interest thereon as well as the said sum of Six hundred and fifty pounds and the interest thereon.

AND WHEREAS the said principal sums of six hundred and fifty Pounds and Eighty Pounds still remain owing together with arrears of interest thereon amounting to the sum of Thirty Two Pounds

AND WHEREAS on the Second day of February One thousand eight hundred and ninety eight a receiving Order in Bankruptcy was made against the said James Parkyn by the County Court of Cornwall holden at Truro

AND WHEREAS on the Third day of February One thousand eight hundred and ninety eight the said James Parkyn was by the same Court adjudicated a Bankrupt and on the same day an order was made that the Estate of the said James Parkyn should be administered in a summary manner pursuant to section 121 of the Bankruptcy Act 1883 and the said George Appleby Jenkins as such Official Receiver as aforesaid thereupon became and is now Trustee of the Estate and Effects of the said James Parkyn in the said Bankruptcy

AND WHEREAS the said George Appleby Jenkins as such Official Receiver as aforesaid has contracted with the said Thomas Hicks for the absolute sale to him of all the estate right of redemption(sic) and interest of the said James Parkyn the said Bankrupt of and in the hereditaments thereby conveyed for the price or sum of Twenty Pounds

NOW THIS INDENTURE WITNESSETH that in pursuance of the said Agreement and in consideration of the sum of Twenty Pounds so paid as aforesaid to the said George Appleby Jenkins as such Official Receiver and Trustee as aforesaid by the said Thomas Hicks the payment of which sum is hereby acknowledged He the said George Appleby Jenkins as such Official Receiver and Trustee as aforesaid in pursuance of all powers and authorities in anywise enabling him in this behalf hereby conveys unto said Thomas Hicks and his heirs ALL the Estate right of redemption title and interest of the said James Parkyn the said Bankrupt of and in ALL THAT messuage tenement farm and premises situate in or called Towan Wartha and Towan Woolas within the Parish of Saint Merryn in the said County of Cornwall containing altogether Twenty four acres two roods and thirty four perches or thereabouts and lately in the occupation of the said James Parkyn or his under tenants TO HOLD the same hereditaments unto and to the use of the said Thomas Hicks in fee simple freed and absolutely discharged from all right or equity of redemption under or by virtue of the hereinbefore recited Indenture of Mortgage or otherwise

IN WITNESS whereof the said parties to these presents have hereunto set their hands and seals the day and year first before written.
