THIS INDENTURE Made
the 29th day of April in 27th year of the reign of our
Sovereign Lord George the second by the Grace of God of
Great Britain France and Ireland King defender of the
Faith etc. and in the year of Our lord 1754 BETWEEN John
Hill of the Parish of Cardinham in the County of
Cornwall glazier of the one part and Ambrose Dow of the
Parish and county aforesaid Labourer of the other part
WHEREAS Thomas Wills of Penpol in the Parish and County
aforesaid yeoman did by indenture of sale bearing date
the 1st of May in the 17th year of his present Majesties
Reign for the conditions therein expressed did demise
lease and to form sett and lett and confirm unto the
said John Kitt all that messuage and tenement with the
appurtenances commonly called or known by the name of
Kents Down situate lying and being in the Parish and
County aforesaid and then lately in the possession of
William Slyman and Anne Prout or their assigns together
with all houses gardens orchards lanes pastures feedings
common and commons of pasture ways profits whatsoever
which hath soon heretofore taken known or reputed to be
belonging to the same or any part thereof TO HAVE AND TO
HOLD all and singular the said Messuage and tenement
except as therein is accepted unto the said John Kitt
his executors administrators and assigns from the day of
the date of the said indentures of lease for and during
the whole time and term of four score and nineteen years
fully to be completed and ended if he the said John Hill
? there and ? Thomas Hill and Anne Hill father and
mother of the said John Hill or any or either of them so
long shall happen to live yielding paying and defending
as in the aforesaid deeds of lease is to have yielded
paid done and performed whereby the same relation being
thereunto had it doth and may more fully and at large
appear NOW THIS INDENTURE FURTHER WITNESSETH that the
said John Hill for and in consideration of the sum of
thirty five pounds of good and lawful money of Great
Britain seventeen pounds and ten shillings more being
one half of the said sum of thirty five pounds to be in
paid or secured be paid unto the said John hill by the
said Ambrose Dow at or before the sealing and delivering
of these presents and seventeen pounds and ten shillings
more being the other half of the said sum of thirty five
pounds above mentioned to be aid unto the said John hill
his executors administrators or assigns by the said
Ambrose Dow his executors administrators or assigns at
or upon the 25th day of December next ensuing the date
hereof and in and by these presents doth grant demise
assign transfer and sett over unto the said Ambrose Dow
his executors administrators or assigns all and singular
the messuages and tenements aforesaid with all and every
of its appurtenances thereunto belonging as in aforesaid
recited indenture of lease is granted by the said Thomas
Wills excepting and always reserving as in the aforesaid
recited indenture of lease is accepted and reserved TO
HAVE AND TO HOLD all and singular the said messuage
tenement with the appurtenances thereunto belonging
except as in the aforesaid recited indenture of lease
and in this present assignment is accepted and resolved
together with the recited indenture of lease unto the
said Ambrose Dow his executors administrators or assigns
from henceforth from and during all the rest remainder
and residue of the said term of fourscore and nineteen
years in and by the said inpart recited indenture of
lease granted and yet to come and unexpired yielding
paying doing and promising to the landlord as in the
recited indenture of lease is required to be yielded
payed done and performed by the said John Hill his
executors administrators or assigns and the said John
Hill is to free and discharge the said Ambrose Dow from
all rates taxes and all other outgoing whatsoever ? the
25th day of December last passed before the date of this
present assignment and the said John Hill doth hereby
for himself his executors administrators and assigns and
for every and either of them by these presents covenant
promise and grant unto the said Ambrose Dow his
executors administrators and assigns that he the said
John hill hath not done any act or acts thing or things
or any former assignments of the premises to hinder make
void this present assignment but at this present sealing
and delivery hereof hath good right full power and
authority to grant assigns transfer and sett over the
premises aforesaid in manner and form as aforesaid and
during the term aforesaid and that he the said Ambrose
Dow his executors administrators or assigns shall and
lawfully may quietly and peaceably have hold occupy
possess and enjoy all and singular the premises hereby
granted and assigned and every part and parcel thereof
with the appertenances except as before is excepted
without the lawful lett suit trouble hindrance
molestation claim challenge demand of him the said John
Hill or any other person or persons whatsoever claiming
or to claim by from or under him IN WITNESS WHEREBY the
said John Hill hath hereunto set his hand |
