THIS INDENTURE MADE THE one and thirtieth day of May in
the year of Our Lord 1698 in the ? year of the reign of
Our Sovereign Lord William the Third by the Grace of God
of England Scotland France and Ireland King Defender of
the Faith BETWEENE the Right Honourable John Earl of
Bridgewater of Ashbridge in the County of Bucks John
Burrington of Sandford in the County of Devon Esquire
and John Garland of Whitefold in the sayd County of
Devon Esquire of the one part and Patrick Bunt of
Cardinham in the County of Cornwall yeoman of the other
part WHEREAS Sir Bourtier Wraylate of Tavistock in the
said County of Devon Baronett and Knight of the
Honourable Order of the Baths doth by his last will and
testament in writing bearing the date the sixteenth day
of August in the year of Our Lord 1694 for the defraying
of his honour all charges and for payment of his debts
and legacies and other the intentions in his will
expressed did give devise and bequeath unto the late
John Earle of Bridgewater John Burrington and John
garland their heirs and assigns for ever all his Manors
Lands Tenements Parsonages Rectories Vittarridges and
Hereditaments not conveyed in and by his former
settlement upon trust and to his intent and purpose that
they or the survivors or survivor of them should so
asent to all and every his sayed Pasonages Rectories and
Vittarridges and so often as they or any of them should
become void during his sons minority and assent and
should ? and to the rents issues and profits of his sayd
Mannors Lands and Tenaments and all the inheritance and
fee simple of the same or any part thereof (his Mannors
and hundreds and Burrough of Wantage As to the sale only
completed) as in and by the sayd will relation being
thereunto had now fully may appear and whereas the sayd
debts legacies and ffunds all expenses are not yet
discharged or satisfied but a considerable part thereof
remains due NOW THESE PRESENTS WITNESS that for raising
money towards discharging of the same they the sayed
John Earle of Bridgewater John Burrington and John
Garland for and in consideration of the sum of twelve
pounds of lawful English money to them in hand payd by
the said Patrick Bunt at and before thanksgiving and
delivery hereof the receipt hereof is hereby
acknowledged and thereof and every of them by these
presents HAVE granted released and confirmed and doe by
these presents grant release and confirm unto the said
Patrick Bunt (in his actuall possession now being by
virtue of a lease for one year bearing date hereof and
of the statute transferring uses into possession) And
his heirs all that their eighth part of all that
messuage tenement called or commonly known by the name
of Old Cardinham situate lying and being in the sayd
parish of Cardinham And all their eighth part of all
houses edifices buildings courtiladges garden and
orchards meadows closes fields pastures feedings woods
underwoods wayes pathes water watercourses ffishings
priviladges advantages and hereditaments thereunto
belonging or there with enjoyed as part parcel or member
thereof with the appertanances and the reversion and
reversions remainer and remainders rents issues and
proffitt thereof and all counterparts of leases deeds
and writings with soley ? the of the said eighth part of
the sayd messuages and tenements or any part thereof now
in the hands custody or power of them the sayd John
Earle of Bridgewater John Burrington and John Garland
and true copies of all other deeds evidences and
witnessings of the said Patrick Bunt his heirs and
assigns TO HAVE AND TO HOLD this sayd eight part of the
sayd messuage and tenement and premises hereby granted
or herein mentioned or intended to be hereby granted
with their appurtenances unto the said Patrick Bunt his
heirs and assigns for ever To the only uses and behoofe
of the said Patrick Bunt his heirs and assigns for
evermore to be holden of the High and Chief Lord and
Lords of the fee of the premises by the rent and levies
therefore due and of right accustomed AND the sayd John
Earle or Bridgewater for himself his executors and
administrators doth hereby covenant and agree to and
with the sayd Patrick Bunt his heirs and assigns that he
the sayd Patrick Bunt his heirs and assigns of for and
notwithstanding any Act Matter or Thing done or to be
done by the sayd John Earle of Bridgewater shall and may
from tyme to tyme and at all tymes hereafter have hold
and enjoy the said eighth part of the sayd messuage
tenement and premises lawfully clayming or to clayme by
from or under him and that the sayd John Earle of
Bridgewater hath not done any Act or thing whereby to
insuring the premises hereby granted or mentioned to be
granted or any part thereof in the Tyth charges estates
or otherwise howsoever AND the sayd John Burrington for
himself his executors and administrators doth hereby
covenant and agree to and with the sayd Patrick Bunt his
heirs and assigns that he the sayd Patrick Bunt his
heirs and assigns for and notwithstanding any act matter
or thing done or to be done by the sayd John Burrington
shall and may from tyme to tyme and at all tymes
hereafter have hold and enjoy the said eighth part or
the sayd messuage tenement and premises hereby mentioned
to be granted and every part thereof without the
interruption or denyall of him the sayd John Burrington
and all and every other son and sons and lawfully
clayming or to clayme by from or under him and that the
sayd John Barrington hath not done any act or thing
whereby the incumber these premises doth hereby covenant
granted or mentioned to be granted or any part thereof
in Tythe charge estate other wife howsoever AND the sayd
John Garland for himself his executors and
administrators doth hereby covenant and agree to and
with the said Patrick Bunt his heirs and assigns for and
notwithstanding any act matter or thing done or to be
done by the said John Garland shall and may from tyme to
tyme and at all tymes hereafter have hold and enjoy the
sayd eighth part of the sayd messuage tenement and
premises be from or under him and that the sayd John
Garland hath not done any act or thing whereby to
incumber the premises hereby granted or mentioned to be
granted or any part thereof in Tythe charges or
otherwise howsoever AND LASTLY they the sayd John earle
of Bridgewater JohnBurrington and John Garland
seperately and apart and not the one for the other or
for the Act of the other or for the heirs or assigns of
the other of them covenant and agree for themselves
respectively and for their respective heirs executors
and administrators to and with the said Patrick Bunt his
heirs and assigns that they the said John Earle of
Bridgewater John Burrington and John Garland and their
heirs shall and will from tyme to tyme and at all tymes
hereafter within the space of seven years next ensuing
from the date hereof at the bonafide request and all the
costs and charges of the said Patrick Bunt his heirs and
assigns make do acknowledge heirs executors or cause to
be made done acknowledged levied and executed as by
cousell learned in the law of the sayd Patrick Bunt
shall be reasonably devised assurances and assurance in
the law whatsoever be it by fine or otherwise or for the
more effectual conveyancing of the said premises as by
the Counsell learned in the Law of the said Patrick Bunt
shall be reasonably devised or advised or required so as
the ? (parties) to such further be not compelled for the
causing thereof to travel from their respective
habitations and so as such further assurances contained
no other covenant then is herein expressed IN WITNESS
Whereof the parties above sayd to these present
indentures their hands and seals interchangeably have
