Assignment of
Kents Downe 1639
To all Christian people To whom this present
writinge Indented shall come. Samuell Hill of Warlegan
in the County of Cornwall Clerke sendeth in our Lorde
everlastinge whereas Peter Stopp of Polruan &
Ibbet his wife by their Deed Poll bearing Date the xviii
th Day of December in the yeeres of the Raigne of our
Soveraigne Lorde James late king of England Scotland
France and Irelande of Egnlande (sic) the eigth of
Scotlande the xliiij th for consideracions therein
mentioned have Given Granted Demysed confirmed & to
ferme better unto Richarde Pollard the elder his
Executors Administrators & Assignes All that parcell of
lande & Tenement with the appurtenances sett lying &
being in Kentes Downe within the parish of Cardinham &
County of Cornwall & all & singular landes Tenementes
leases pastures feedings & Common of pastures whatsoever
with the appurtenances appertayning or belonging unto
that parcell of landes called Kentes Downe aforesaid or
that hath bin accepted taken or usually lett to or with
the same togeather with all their & every of their
rightes Titles Clayme or Demaundes whatsoever of in or
to the same or any parte or parcell thereof Together
alsoe with all leases Deedes and writings touching or
concerning the same or any parte or parcell thereof
To have and to holde all & singular the saide
parcell of landes in Kentes Downe aforesaid & all other
the premisses with the appurtenances unto the said
Richard Pollarde the elder his Executors Administratprs
& Assignes from the day of the date of the aforesaid
verited Deed Poll for and during the terme of eight
hundred yeers then next following fully to be compleat
and ended under the yearly Rent of one graine of wheat
or wheat corne with Diverse other condicions the
covenantes & agreements in the saide Deed Poll mentioned
& contayned where unto reference being had it doth and
may appeare And Whereas the saide Richarde
Pollard the elder by his Bill of sale bearing Date the
xx th daye of Maye in the Eleventh yeere of the Raigne
of our saide Soveraigne Lorde James of England, France &
Irelande & of Scotlande the sixe & fortieth for a
reasonable consideracion therein likewise mentioned Did
absolutly bargaine & sell unto Richard Pollard the
younger sonne of the saide Richarde Pollard the elder
all his Right Title Estate & interest in Kentes Downe
aforesaid with all & singula the appurtenances & every
parte and parcell thereof with the houses landes
meaddowe moores & wastes whatsoever belonging or
appertayning to the same unto the saide Richarde Pollard
the younger for ever during the foresaid Terme of yeeres
yet unexpired unto which Bill of Sale Reference alsoe
being had more at large it doth & may appear And
Whereas the saide Richard Pollard the Younger by his
Indenture bearing Date the sixteenth Day of October in
the Eigth yeere of the Raigne of Our most gracious
Soveraigne lorde Charles now King of England etc for the
consideracion therein mentioned Did Give Graunt Demyse
confirme and to ferme lett unto William Evans of
Cardinham aforesaid yeoman his Executors Administrators
& Assignes All that parcell of lande & Tenement with the
appurtenances sett lying and being in Kentes Downe
aforesaid or that hath bin reputed accepted or usually
lett to or with the same Together with all his right
Title claime and demaunde whatsoever of in & to the same
or any parte or parcell thereof together alsoe with all
writings Deeds and Leases touching the same or
concerning any parte or parcell thereof To have and
to holde All & singuler the saide parcell of Landes
in Kentes Downe aforesaide with all other the premisses
& appurtenances unto the saide William Evans his
Executors and Assignes from the day of the Date of the
foresaide Deed Poll for and During all such terme of
yeeres as are yet to come and expire by force and virtue
of the first verited Deed Poll made by Peter Stopp&
Ibbet his wife to which alsoe reference being had may &
doth appeare And whereas the said William Evans for & in
consideracion of the summe of (fiftene?) poundes in hand
paide of Lawfull English money Did by his Indenture
bearing Date the sixteenth daye of June in the
Thirteenth yeare of the Raigne of our most Gracious
Soveraigne lorde Charles nowe king of England etc Give
Grant Bargaine sell and sett over unto Samuell Hill of
Warlegan in the County of Cornwall aforesaid Clerke his
Executors Administrators and Assignes All & Singuler the
saide demised premisses and Every parte and parcell
therof with all & singuler their & every of their
appurtenances in Kentes Downe aforsaide & all the said
Estate Title interest & right in & by the first vertied
Deed poll given & Graunted as aforesaid, as alsoe all
his whole Estate Right Title Terme and Interest of in &
to the same, & of in & to every parte & parcell thereof
together with the afore verited Deeds made by the said
Peter Stapp Ibbet his wife with all such other Deeds
leases writinges escripts & (minumentes?) whatsoever
touching & concerning the saide premisses or any parte
or parcell thereof To have and to hold All &
singuler the saide parcell of landes in Kentes Downe
aforesaid with all other the premisses and appurtenances
unto the saide Samuell Hill his Executors Administrators
and Assignes from the day of the date of the aforesaide
Deed Poll for and During such terme of yeeres as are yet
to come & expire by force and vertue of the last verited
deed Indented unto which deed also reference being had
more at large it doth & maye appeare Nowe these
presentes Witnes That the saide Samuell Hill for the
naturell love & affection that he hath and beareth unto
Samuell Smith his nephew the sonne of John Smith of
Pimpwell in the parish of Stok Climslande in the County
of Cornwall gent And for diverse good causes &
considerations him thereunto moving Hath Given
Graunted bargayned soever and sett over And in &
by these presentes doth absolutley & freely Give
Graunt Bargaine sell & sett over & assigne & confirme
unto the saide Samuell Smith his Executors
Administrators & Assignes as well all & singuler the
foresaide demysed premisses & every parte and parcell
thereof with all & singuler their appurtenances in
Kentes Downe aforesaide And all the saide estate Title
Interest and right In & by the first verited Deed Poll
Given & Graunted as aforesaide And alsoe all his whole
Estate Title Terme & interest of in & to the same And of
in & to every parte & parcell thereof Together with the
former verited Deed made by the foresaid Peter Stapp &
Ibbet his wife with all other Deeds leases writings
evidence escriptes & (mynumentes) whatsoever touching &
concerning the same premisses or any parte or parcell
thereof nowe in the handes keeping or possession of the
saide Samuel Hill or in the handes keeping or possession
of any other person or persons to his use or by his
deliveraye and consent To have & to holde All &
singuler the foresaide demysed premisses And every parte
& parcell thereof withall & every their appurtenances in
Kentes Downe aforesaid And all the saide Estate Title
Terme & Interest of the saide Samuell Hill of in & to
the same & of in & to every parte & parcell thereof
together with the aforesaid verited Deedes & Writings
unto the said Samuell Smith his Executors Administrators
and Assignes & to every of them Immediatly from the daye
of the Date hereof for & during all such terme of yeeres
as are yet to come & expire by force & vertue of the
first verited Deed Poll made by the saide Peter Stapp &
Ibbet his wife as aforesaid Hee the saide Samuell Smith
his Executors Administrators & Assignes yeelding paying
& doing therefore yeerly all such Rent & dutyes as he
the saide Samuell Hill his Executors & Assignes are
bounde and stande chargable by the fore verited Deeds to
yield downpay and performe for the same And the said
Samuel Hill doth for himselfe his Executors & Assignes
promise Covenant & agree to & with the saide Samuel
Smith his Executors Administrators & Assignes and in &
with every of them by theise presents: That he the saide
Samuel Smith his Executors Administrators & Assignes &
every of them shall & maye from henceforth quietly &
peaceably have holde use occupye possesse &
enioye all the aforesaide premisses & every parte &
parcell thereof with all singular the premisses & their
appurtenances hereby Given graunted meant & intended to
be given & graunted assigned & sett over in manner and
forme aforesaide & for and during the residue of the
saide Terme of eight hundred yeeres aforesaid And by &
under the Rentes & consideracions aforesaid without any
the bitt trouble lawfull claime interruption expulsion
molestation incombrances or Denyall of him the saide
Samuell Hill his Executors Administrators & Assignes or
of any person or persons whatsoever clayming or
pretending any lawfull right Title Terme or interest of
into or out of the same premisses or of into or out of
any parte or parcell thereof in bye from or under him
the saide Samuell Hill his Executors and Assignes In
Witness whereof the partyes abovesaide have hereunto
sett their handes and Seales interchangablye the Tenth
day of March in the fifteenth yeere of the Raigne of our
most Gracious Soveraigne lorde Charles by the grace of
god king of England Scotlande France & Irelande Defender
of the Faith etc Anno Domini 1639
