This Indenture the 18th day of July in the one and twentieth year of the Reign of the Sovereign Lady Elizabeth by the Grace of Good Queen of England and France and Ireland Defender of the faith etc Between William Billinge of Cardinham in the County of Cornwall yeoman of the One part and Sir John Arundell of Lanherne in the County aforesaid Knight of the other part Witnesseth that the Said William Billinge the day of the making hereof as well for the Sum of £160 of good & legal money of England to him by the Said Sir John Arundell Knight before the sealing hereof  said where of and wherewith the Said Wm Billinge knowledgeth himself fully satisfied and paid and the Said Sir J. Arundell his heirs and Executors thereof and of every part and parcel thereof fully and clearly requited and discharged for ever by there presents as for other good and reasonable cause him the Said William Billinge specially moving as particularly in and by there presents doth and may affect hath given and granted bargained and sold by these present Indentured doth give and grant bargain and sell unto the said Sir J Arundell Knight. His heirs and assigns for ever All that fourth part of the Manor of Cardinham with all and singular the right and appurtenance thereof Together with the fourth part of the Advowson and Patronage of the Parish of Cardinham aforesaid in the County aforesaid And also the fourth part of all other Patronage and Avowson to the Said Manor of Cardinham belonging or appertaining And also all the Messuage Lands Tenement reservations service meadows leases woods underwood groves hedgewood waters mills fields moors heaths comons Mines tynes works franchise priveledge waste ground profit comodities and hereditaments which the Said William Billinge and one Wm Fourthe of Cardinham aforesaid Clerk lately purchased to them and to the heirs and assigns of the Said William Billinge of the Right Honorable. Edward. Lord Zouche (gap) in the Towns Fields parishes and hamlets of Cardinham Bodmyn Helland Blisland Warlegan St Nyotte Bradcocke and Temple in the Said County and also whereas and all the rights reservations remainders estate interest and demand of the said William Billinge of and in the premises and every part and parcel thereof Together with all deeds writings escripts evidence charters rent rolls court rolls accompte views of accompte countenances of Leases and other writings concerning the premises or any part or parcel thereof which the Said William Billinge or any (gap) evidence charters rentals and other writings so before bargained and sold the Said William Billinge conveniently for him his Heirs and Executors to deliver or cause to be delivered unto the Said Sir J Arundell his heirs or Assigns on this side the feast of All Saints next excusing the date hereof and at all times after that when the same shall happen to come to the hands of the Said William Billinge or his Heirs Executed and out of this bargain and sale always foreprised certain land and Tenement commonly called or known by the name of Boderdell situate lying and being in the parish of Lanlyvery in the County aforesaid To have and to hold the said fourth part of the Said Manor of Cardinham and all other the premises before mentioned (except before executed) to be bargained and sold unto the Said Sir John Arundell his heirs and assigns for ever to the only and proper use of the Said Sir John Arundell his heirs and assigns for ever to hold of the high Lord or Lords of the fee or fees thereof by the rent and service thereof first due of right accustomed And the Said William Billinge doth covenant and grant for him his heirs Executors and Administrators to and with the Said Sir J Arundell his heirs Executors and Assigns by there presents that he the Said William Billinge at the sealing and delivery hereof is fully and lawfully seized in his dencare As of fee to the only use and behoof of him and his heirs of and in the fourth part of the said Manor and of all other premises before mentioned to be bargained (except before excepted) that the said William Billinge now hath full power and perfect authority to bargain and sell and assure the premises before bargained to the Said Sir John Arundell his heirs and assigns in manner and form aforesaid excepted always and reserved certain leases and Grants which the Said William Billinge and William Fouerty have before the sealing hereof made and granted unto certain persons of in and for part and parcel of the Premises thereafter in there presents are mentioned and declared that is to wit? One Lease for 1000 years made unto Williamm Glyn Gent. As well for the 4th part all the wood of all the Said Manor of Cardinham (except Luttroll wood of which Lutcott wood the Said William Glyn is to have but only the next cut and shred thereof) and also for the 4th part of all those Messuage Land and Tenement with their appurtenances in Grattan Clay more Kellibarret Hilton and Old Cardinham parcel of the Manor aforesaid And also excepted and reserved always certain other leases (gap) of 1000 years made by the said William Billinge and William Fouerty unto John Wills of the 4th part of Milton, Lower Tresane, Higher Tresane Middle Tresane and Inner Berry which Inner Berry one Mary Layow holdeth And unto William Lobb for the 4th part of Higher Cardiest And unto John Rowe the elder for the 4th part of one Tenement in Tresley and of one Tenement in Perches, And unto Nicholas Courtys for the 4th part of one other Tenement in Tresley and unto John (gap) for the 4th part of one other Tenement in Tresley And unto Thomas Will for the 4th part of one Tenement in Penpolle And of one other Tenement in Inner Berry and unto John Rowe the younger for the 4th part of one Tenement in (gap) Cardiest And unto William Pomery For the fourth part of one other Tenement in Tresley And unto William Launarge for the fourth part of one Tenement in Old Cardinham parcel of the Manor aforesaid And also excepted and always reserved one Grant made by the said William Billinge unto the Said Wm Fourth for the fourth part of (gap) lande during the life of the Said William Fourth and common of pasture for the beasts of the Said Williamm Fourth during the life of the said Williamm Fourth in the commons and waste of the Manor aforesaid And also one other grant made by the said William Billinge unto the said Fourth for the next presentation unto the Parsonage of Cardinham aforesaid when the same shall happen to present by reason of the fourth part of the Said Manor before bargained and sold And furthermore the Said William Billinge doth covenant for him his Heirs Executors that he the Said Sir John Arundell his heirs and assigns for ever shall and may by virtue of these presents lawfully have hold And enjoy for evermore the Said fourth part of the Said Manor of Cardinham and all other premises before mentioned to be bargained with all and singular their appurtenances (except all and every before excepted) according to the purport true intent and meaning of these presents And also That as well as the Said Sir John Arundell his heirs and assigns clear and clearly acquitted or by the Said William Billinge his Heirs Executors or Administrators or some one of them sufficiently saved harmless of and from all formes bargains sales fines fines for alienations feoffment recoveries rent recognizance statute Merchant and of the staple (gap) and of and from all other estate titles troubles charge and incumbrances whatsoever the rent of service from henceforth to be due unto the chief lord or lords of the fee or fees thereof in respect of the seynories and all the Said grants and leases and other before mentioned and declared to be made by the Said William Billinge and Wm Fourth and by the Said William Billinge only And all grants by copy of court roll heretofore made before the purchase of the Said 4th part of the Said Manor of the Said Lord Zouche other than (gap) or claim by reason of any estate grant or interest before excepted shall and will and at all times hereafter and from time to time during the space of 5 years now next ensuing upon reasonable request thereof to be made and at cost and charge (as well in the law as in expence of the Said William Billinge thereabouts) of the Said Sir John Arundell his heirs and assigns for the better and further assurance of the same fines and of every part thereof to the Said Sir John Arundell his heirs and assigns to the use aforesaid do make suffer and acknowledge all and every such further reasonable act and acts thing things be it by Time Feoffment Recovery with Voucher or Vouchers deed or deeds enrolled or not enrolled the enrollment of these presents Releave confirmation without warranty of the Said Willm Billinge and his heirs and all persons or otherwise as by the counsel learned in the Law of the Said Sir J Arundell his heirs or assigns shall reasonably devised or advised And the Said William Billinge and his heirs the Said fourth part of the said Manor of Cardinham and all other the premises with all their appertenances (except before excepted) unto the Said Sir John Arundell his heirs and assigns in manner and form aforesaid against all people shall warrant acquit and defend for ever by there presents And the Said Sir John Arundell doth covenant for him his heirs and Executors that he the Said Sir J Arundell shall and will within one half year now next ensuing grant unto Hughe Billinge and William Billinge sons of the said William Billinge first named for terme of their lives and other of them longest living by copy of Court Roll according to the custom of the said Manor of Cardinham the reversion of three parts of four parts of two Tenements with all their appurtenances in Treswithyck which Robert Will Teage Coffer and Richard Garros now hold according to the custom of the said Manor by the rents and services thereof heretofore due and accustomed And finally the said Sir John Arundell in consideration of the Grant bargain and sale in this manner and form aforesaid doth give and grant for him his heirs and assigns unto the Said William Billinge his heirs and assigns common of pasture in the commons and wastes of the Said Sir J Arundell his grantees and of his heirs and assigns within the said Manor for all and so many beasts of the Said William Billinge his heirs and assigns as the Tenement of the Said William Billinge called Prees with its appurtenances in the Said parish of Cardinham is or shall be able reasonably to winter. To have and to hold the Said Comon of Pasture in the Comons and wastes of the Said Sir John Arundell his grantees and of his heirs and assigns within the said Manor to the Said William Billinge his heirs and assigns for ever for all and so many beasts of the Said William Billinge his heirs and assigns as the Said Tenement called Prees with its appurtenances Is or shall be able reasonably to winter without any rent suit service or other thing Yielding or paying for the same In Witness whereof the parties aforesaid to these present Indentures interchangeably have set their Seals upon the day and year first above written 1579.
