The Last Will and
Testament of
John Pleace
Dated
this 19th. Day of
January 1832
In the Name of God, Amen, I John
Pleace of the Parish of Calstock in the County of Cornwall Yeoman, being
weak of body, yet of Sound and disposing Mind Memory & Understanding, do
make this my last Will and Testament in Manner Following -
First I Commit my Soul into the hands of Almighty God who gave it me &
my body I Commit to the Earth to be Buried with a Decent Christian
Burial, as to my Worldly Estates I give & dispose therof as follows.
I Give devise and bequeath unto my Brother in-law William Nations?
Harper of the Parish of Stoke Dameral in the County of Devon Joiner &
Carpenter and John Pearce of the Parish of Calstock in the County of
Cornwall Yeoman all that my Messuage or Dwelling House Tenement &
Premises being Number twenty two, Richmond Street, Parish of St. Andrew
in the Borough of Plymouth and County of Devon Now in the posession of
Mr. Samuel Hoare and others as Tenants thereof. And also all that my
Copy hold Estates Called or known by the Name of Vagoises? Kings Gardens
and East Coombe Situate in the parish of Calstock County of Cornwall,
and part of the Ancient Duchy of Cornwall, and also all that Field or
Close of Land adjoining thereto called or known by the name of
Dannecombe or Danescoombe, which I lately purchased of Messers. John &
William Worth in fee also Situate in the said Parish of Calstock, with
Their and Every Their Rights Members abd appertunances upon Trust that
they The said William Nations Harper & John Pearce and the Survivor of
Them and The Heirs Executors and administrators of such Survivor do &
shall pay over the whole of the Rents Issues and Profits of the said
Lands until my beloved wife Ann Pleace for and towards The Maintanances,
Education & Bringing up of my Four Youngest Children Namely Joseph
Pleace George Pleace Nicholas Pleace & Mary Ann Susan Pleace until the
Youngest of them the said Joseph Pleace George Pleace Nicholas Pleace &
Mary Ann Susan Pleace shall have so attained Their said ages of Twenty
One Years, then upon Trust to pay unto my said beloved wife Ann Pleace
an Annuity or Clear Yearly Sum of Fifteen Pounds for and During the term
of her Natural Life or as Long as She shall continue a widow which said
sum of Fifteen Pounds per year with one Room in my Dwelling House or two
Rooms in the Tenement Situate in the Tenement Situate in Richmond Street
in the Borough of Plymouth aforesaid, is in Lieu of all claims she may
have upon the said Freehold Lands for Dower and Subject also to an
Annuity of Four pounds a Year to my Eldest Son John Pleace and the Like
Sum of Four Pounds a year to my Second Son William Pleace upon Trust to
convey assign & Transfer the said Messuage or Dwelling house Tenements
&c. in Plymouth The said Copyhold Estates Called Vagoises Kings Garden &
East Coombe & The said Field Called Dannecombe or Danescoombe unto my
said Four Children Joseph Pleace George Pleace Nicholas Pleace & Mary
Ann Susan Pleace in Equal Proportions, Share and Share alike as Tenents
in Common & not as Joint tenants and if either of them shall happen to
die under the said age of twenty one years without leaving Issue
Lawfully Begotten then the Share of him, her, or them so dying Shall be
in Trust for the Benifit of the Survivor of them the said Joseph Pleace
George Pleace Nicholas Pleace & Mary Ann Susan Pleace & Their Heirs as
Tenants in Common & not as Joint Tenants
And I hereby direct & Declare that if my said wife Ann Pleace or Either
of my said sons John Pleace and William Pleace shall attempt to Sell or
Dispose of the Said Annuities so given and Bequeathed to by this my last
Will as aforesaid Then the same shall become absolutely forfited and be
void
Also I Give and bequesth unto the said William Nations Harper and John
Pleace all and singular my Goods & Chattles Live and Dead Stock
Impliments of husbandry & Farming Stock monies and securities for Monies
upon Trust for sale & that they do by and out of The Proceeds of the
said sale pay all my Debts Funeral Expences & charges of proving this my
Will and also any Mortgage or Mortgages on Either of my said Freehold or
Copyhold Lands, and if Paying the same there should any remain then the
same to be applied as before Direected by me Concerning my said Freehold
& Copyhold Lands. And I do hereby nominate constitute and appoint the
said William Nations Harper Sole Executor to this my last Will in Trust
As Before Directed by me, and I hereby Revoke all former & other Wills,
by me at any time heretofore made & do declare This to be my last Will &
Testament Provided always & I hereby Declare that it shall and may be
Lawful to and for my said Trustees to Reimburse himself & themselves of
all Losses Costs Charges & Expenses they may be put unto in Execution of
the Trusts of this my Will, And that they shall not be Answerable for
any Loss that may happen thereto Except by Their own Wilful Default nor
the one of them for the other of them but each for himself only In
Witness whereof I have to this my last Will & Testament contained in One
Sheet of paper set my hand & seal this nineteenth Day of January in the
Year of our Lord One Thousand Eight Hundred & Thirty two.
