Will of Joan Bowhay 21 November 1740

In the Name of God Amen I Joan Bowhay of the Burrough of Callington in the County of Cornwall Widow being at present of a Sound Mind and Memory but Considering the Uncertainty of this Life do make this to be my last Will and Testament. In the first place my Soul I Recommend to him that gave it entirely trusting that in and through the merritts of my Saviour I shall have perfect remission of all my Sins and my Body I comend to Decent Burial at the Discretion of my Executrix hereinafter named and as to my Worldly Estate I Give and Bequeath the same as follows (that is to say) unto my Son Anthony Bowhay I Give and Bequeath all the Household and other Goods that are in the Back Cellar of his Dwelling House and all his late Fathers wearing apparell both linnen and woolen with one pair of Silver Buckles and a broad piece of Gold and I give until my Daughter in law the Wife of my said Son Bowhay one broad piece of Gold. I Give and Bequeath all that my Chattels Estate called newport with its Appurtences situate and lying within the parish of Callington in the said County with all my Goods therein unto Mr John Jope of the said Burrough of Callington to hold to him his Exers. Adms. and Assigns for and dureing all the residue and remainder of the Term and Interest I have therein or shall dye possessed of In Trust and to and for the Only use and Benefitt of my Grandson John Bowhay provided he lives to Attain his Age of One and Twenty years but in case of his Death before that Age then in Trust and to and for the only use and Benefitt of my Grandchildren James, Elizabeth and Mary the younger Brother and Sisters of the said John Bowhay and all children of my said Son and Daughter Bowhay Equally to be divided amongst those three or such of them as survive their said Elder Brother and live to Attain their respective Ages of Twenty One years I likewise give unto my said Grandson John Bowhay my largest Bellmettall? Pott a Silver Spoon with his name on it and a Mourning Ring I also Give and Bequeath unto the said Mr John Jope in Trust for my Grandson James Bowhay aforesaid the sume of Forty Shillings and in Trust for my said Grandator. Elizabeth Bowhay the like sume of Forty Shillings and in Trust for my said Grandator. Mary Bowhay the Sume of Five Pounds – all which said Severall Sums I Desire may be paid unto the said Mr Jope In Trust as aforesaid within Two Years next after my Decease by him to be put and placed out at Interest dureing my said Grandchildrens Minority and paid to them respectively as they Attain their Respective Ages of Twenty One Years together with the Interest he makes of it but in case of any loss occasioned by the badness of a Security which he may take for all any or either of these Sums it is in such case my desire that the said Mr Jope nor his Estate shall suffer thereby but that my said Grandchildren shall all bear the loss in proportion to their said Severall Legacyes. I also Give and Bequeath unto my Grandaughter Charity Ramsey the Sum of Twenty pounds to be paid unto her on her Attainment to the Age of Twenty One Years but in case of her Death before she comes to that age then I give the Sum of Twenty pounds unto my two Grandsons Robert and William Phisick sons of my son in law and Daughter phisick equally to be divided between them share and share alike I also give unto my Grandator. Charity Ramsey (if she lives to the Age of One and Twenty Years) my Silver Cup but in case of her Death before that age then I give the said cup to my said Grandson William Phisick I Give and Bequeath unto my said Son in law Robert Phisick one Broad piece of Gold and I Give and Bequeath unto his two Sons my said Grandsons Robert and William Phisick to each a Mourning Ring I likewise Give and Bequeath unto my Grandator. Grace Phisick to be delivered to her on the day of her Marriage (provided she marries with the good likeing and Consent of her Mother my said Daughter Phisick) my Silver Tankard but in case my said Grandator. Phisick marryes contrary to the good likeing or without the Consent of her said Mother (being then living) In either of those cases on such Marriage I Give my said Silver Tankard unto my said Daughter Joan Phisick I likewise give unto my said Grandator. Grace Phisick a Mourning Ring I Give unto my sister in law Elizabeth Jeffery the sum of Twenty Shillings and such of my Wearing Apparele as my said Daughter Phisick shall think proper for her and lastly all the Residue of my Goods Chattells and Personall Estate whatsoever and wheresoever being (my Debts Legacyes Funerall Expences being all first paid and satisfied) I Give Devise and Bequeath unto my said Daughter Joan Phisick whom I make Whole and Sole Executrix of this my Last Will and Testament hereby revoking all others. In Witness whereof I the sd. Joan Bowhay have hereunto sett my hand and seal the Twenty first day of November in the Year of our Lord One Thousand Seven Hundred and Forty.

I Joan Bowhay the Testator within named design this as a Codicill to my last Will and have annext it thereto accordingly by which I Give and Bequeath unto Mr Jno. Jope within named (in Trust and to and for the use of my said Grandson John Bowhay in case he lives to Attain his Age of Twenty One Years and if not then in Trust and for the like users as I have by my said Will Given my Tenement Called Newport and my Goods therein) one of my Bedds performed which I have in my own Dwelling House and my best Green Rugg and with this alteration alone I Confirm all and every other of my Bequests in my aid Will mentioned In Witness whereof I hereunto sett my hand and Seal the Second Day of May in the Year of our Lord 1742.

The before written Will and Codicill was proved in Common form the 22d Day of September 1746 Before the Revd. Mr Wm. Waddon Clerk Mtr. Of Arts Official etc. and admion of the Goods etc of the Said deced, and of all things Concerning the said Will and Codicil, was Granted to the Executrix in the said Will named (being first Sworn etc/Saveing etc)
