Will of Henry Weymouth, proved 27 December 1843

27th. December 1843.
The last Will and Testament of Henry Weymouth late of the Parish of St. Buryan Farmer deceased proved in Common form before the Reverend Charles Jenkyns Surrogate.
And admon of the Goods etc. of the said deceased granted to Henry Tregurtha Nephnew of the deceased and Executor named in his said Will.

This is the Last Will and Testament of me Henry Weymouth of Saint Buryan in the County of Cornwall, Farmer.
 
I give and bequeath unto my nephew John Tregurtha, the younger, Blacksmith, son of John Tregurtha the sum of Twenty pounds - and also my large blue clothes chest.
I give and bequeath unto the children of John Ladner of Sancreed Carpenter as shall be living at my decease, the sum of Twenty pounds to be equally divided between them and to be paid them by my Executor hereinafter named to their own exclusive use and benefit independent of their Father and without being in any way subject or liable to his Control, Debts or Engagements.
I give and bequeath unto my Nephew William Tregurtha of Falmouth, Carrier, the sum of Ten pounds.
I give and bequeath to my sister in law Margery Thomas, wife of William Thomas, parish clerk of Saint Buryan aforesaid the sum of Five pounds.
I give and bequeath to John Thomas, son of the aforesaid William and Margery Thomas, Tailor, the sum of Five pounds.
I give and bequeath to my Nephew William Henry Osborne, son of Thomas Osborne of Pendrea, the sum of Five pounds, on his attaining the age of twenty one years.
I give and bequeath to my niece Jane Farley wife of Charles farley, of Truro, Mason, the sum of Five pounds, to her exclusive use, independent of her said husband.
I give and bequeath to Henry Weymouth, son of William Weymouth of Street-an-Nowan, in Paul , Carpenter, the sum of Five pounds.
I give and bequeath to my niece Ann, the wife of John Phillips of Saint Buryan aforesaid labourer, the sum of Ten pounds to her exclusive use and benefit independent of her said Husband and without being

subject to his control, Debts or Engagements.
And I direct that all the before mentioned several Legacies (except the Legacy given to William Henry Osborne) shall be paid by my Executor hereinafter named Six Months after my Decease.
I give to my sister in law, Mary Weymouth, of Tolcarne in Madron, Spinster, my Mahogany Chest of Drawers, and my Mahogany Pembroke Table.
I give and devise unto my said sister in law Mary Weymouth from and after my decease my Freehold Messuage Tenement and premises with the appurtenances in Street-an-Mowan aforesaid, in the occupation of francis Dungey or his undertenants To hold the same unto the said Mary Weymouth and to have and receive the rents and Annual proceeds thereof during her natural life, and from and after her decease I give and devise the said Freehold Hereditaments and premises unto & to the only use and benefit of my Nephew James Weymouth, son of my late Brother Ephraim Weymouth & to his Heirs and assigns for ever.
I give and bequeath to Charles Jacka of Selena in St.Buryan aforesaid, Farmer, from and after my decease All that my Leasehold Dwelling House and premises in Saint Buryan aforesaid which I now occupy - To hold the same unto the said Charles Jacka his Executors, Administrators and assigns during the remainder of any term and interest therein.
I give to Mary Stone, wife of William Stone of Saint Buryan aforesaid, labourer, and to my said sister in law Mary Weymouth a decent suit of mourning each.
All the rest residue and remainder of my Estates, Monies and securities for money, Plate, Household Furniture, Goods, Chattels, personal Estate and Effects whatsoever, subject to the before mentioned several Legacies and to the payment of all my just Debts and

Funeral and Testamentory Expenses - I give and bequeath unto my Nephew Henry Tregurtha, son of John Tregurtha of Saint Buryan aforesaid - and to his Executors, Administators and Assigns - And I hereby nominate and appoint my said Nephew Henry Tegurtha whole and Sole Executor and residuary Legatee of this my last Will and Testament hereby revoking all and every former Wills or Will by me at any time heretofore made and I do declare this only to be my true last Will and Testament - In witness whereof I have hereunto set my hand and affixed my seal this twenty eighth day of April one thousand eight hundred and forty three.
