Will of James Tregurtha, proved 28 December 1848

Deanery of Saint Buryan
The last Will and Testament of James Tregurtha late of the Parish of St.
Buryan Miller deceased proved this twenty Eighth day December 1848 in
Common form (John Rogers the younger one of the subscribed Witnesses to
the Execution of the said Will having first made an Affidavit in
verifing that he and Nicholas Jeffery Andrews another like Witness were
present at the same time when the said deceased subscribed his name at
the foot or end of the said Will on the 12th. December 1844) before the
Revd. George Henry Farr Clerk Surrogate and Administration of the Goods
of the said deceased and of all things whatsoever concerning his said
Will was granted to Nicholas Tregurtha of the said Parish of Saint
Buryan Miller one of the Sons of the said deceased and Principal Legatee
named in the said Will.
Saving the right of every other Person.

To all Whom it may Concern
I James Tregurtha do send greeting.
Know ye that I the said James Tregurtha of the parish of St. Buryan in
the County of Cornwall formerly Miller but now Farmer in consequence of
the love good will and affection which I have and do bear towards my son
Nicholas Tregurtha now carrying on the Busness of Miller in the
aforesaid Parish and County do by these presents freely give and grant
unto my said dear Son his heirs executors or administrators all and
singular that Leasehold Dwelling house lands and premises which I now
hold and am possessed of for the term of ninteynine years determinable
on the lives of my three Sons James Richard and Edward Tregurtha and the
said Nicholas Tregurtha is to pay me eight Pounds per year during the
lives of either myself or wife or either of us I give to my Son Richard
ten Pounds to be payed to him by my son Nicholas if he return home to
receive it. I also desire my son Nicholas to pay my sons James John and
Edward Three Pounds each at the end of Twelve Months

after the Death of myself and Wife. I also Give unto my wife in case of
my decease one of the Chambers to fix a Bed and the use of the Kitchen
Chimney to dress Meat.
I give to my Son Thomas Tregurtha my Daughter Ann James and my Daughter
Elizabeth Nicholls that freehould House Garden and premises situate at
the New Downs in the Parish of St. Just in the County of Cornwall after
the decease of myself and Wife. I also give to my son Nicholas Tregurtha
the Bed standing in the Kitchen Chamber formerly my Fathers. I give to
my son Richard Tregurtha my own Bed after the death of my self and wife
if he returns home. I appoint my son Thomas Tregurtha to act in behalf
of his mother after my Death
I acknowledge this to be my last Will and Testament this Twelveth day of
December one thousand eight hundred and forty four

In the Deanery Court of St Buryan
In the Goods &c of James Tregurtha late of the Parish of St Buryan in
the County of Cornwall Miller, deceased.
Appeared personally John Rogers of the said parish of. St Buryan Mason
and made Oath that he is one of the two subscribed Witnesses viz John
Rogers and “Nicholas Jeffery Andrews” to the last Will and Testament of
James Tregurtha late of the said parish of St. Buryan Miller deceased
now hereunto annexed the said Will beginning that "To all to whome it
may concern I James Tregurtha do send Greeting" ending thus "I
acknowledge this to be my last Will and Testament this Twelveth day of
December one thousand eight hundred and forty four James Tregurtha" And
this Deponent and the said Nicholas Jeffery Andrews were present at the
same time when the said deceased on the said twelfth day of December one
thousand eight hundred and forty four subscribed his name at the foot or
end of the said Will And this Deponent and the said Nicholas Jeffery
Andrews subscribed their names in the presence of the said Testator and
of each other as Witnesses thereof
